MEMORANDUM OF AGREEMENT

This Agreement is entered into this ____________________ at Zamboanga City,

Philippines, between:

LEO PARILLA, of legal age, married, Filipino and a resident

of Sta. Maria, Zamboanga City, and hereinafter referred to as the
“FIRST PARTY”;
-and-

JOHN EDWARD P. GUIA, of legal age, married, Filipino,

and a resident of Barangay Tetuan, Zamboanga City, and hereinafter
referred to as the “SECOND PARTY”.

ON THE FOLLOWING PREMISES:

WHEREAS, the FIRST PARTY is the owner of one Ford Everest bearing Plate No.
KDP897, with Engine Number WEAT122019, Chassis Number MNCU84E907W20351;

WHEREAS on 14 December 2019, the above-mentioned vehicle was driven by his

son, Mr. JAMES AMOS PARILLA;

WHEREAS, on said date, a vehicular incident occurred between the mentioned

driver of the above-described vehicle with the herein SECOND PARTY who was the driver
of one MITSUBISHI ADVENTURE with Plate Number WKJ182;

WHEREAS, the SECOND PARTY undertakes to answer for the expenses that may
be required by reason of the vehicular accident such that there is a need to establish the
obligations and responsibilities of the SECOND PARTY to ensure performance and
provide contingencies in case of default.

THE PARTIES HEREBY AGREE THAT:

a) The SECOND PARTY shall undertake to shoulder the expenses that

may be incurred for the repair of the Ford Everest Vehicle owned by the
FIRST PARTY to get it back to its running condition;

b) In reference to the above, the SECOND PARTY shall pay the

FIRST PARTY the amount of Php 18, 132.00 for the repair of the vehicle
plus an additional amount of Php 6, 000.00 for the payment of the repair of
the paint of the vehicle;

c) The FIRST PARTY hereby undertakes to waive any complaint and/or

action arising from this matter against the SECOND PARTY and desisting from
filing any action in the future relative to this matter.
