JUDICIAL AFFIDAVIT

OF

PLAINTIFF MARY FLOR B. GALVEZ

This Judicial Affidavit of Mary Flor B. Galvez is executed to

serve her direct testimony in the instant case.

I, Mary Flor B. Galvez, of legal age, Filipino, married to Danilo A.

Cruz, and with residence at Blk 7., Lot 8, Narra St., Bakhaw,

Mandurriao, Iloilo City, plaintiff in this case, state under oath as

follows:
 PRELIMINARY STATEMENT

The person examining me is Atty. Meryshel S. Gianan with office

address at 3rd Floor, The Fiat, Lopez Jaena St., Jaro, Iloilo City.

The examination is being held at the same address. I am

answering her questions fully conscious that I do so under oath

and may face criminal liability for false testimony and perjury.

This affidavit/testimony of plaintiff Mary Flor B. Galvez is being

offered to prove that the defendant Oliver T. Olmedo is indebted to

plaintiff the sum of Ten Million Pesos (Php 10,000,000.00),

Philippine Currency. The plaintiff’s testimony is also offered to

prove that defendant Oliver T. Olmedo unlawfully refused to pay

the lawful demand of the plaintiff.

1. Q. Please state your name and other personal

circumstances for the record.

A. I am Mary Flor B. Galvez, of legal age, Filipino, married to

Danilo A. Cruz, and with residence at Blk 7., Lot 8, Narra St.,

Bakhaw, Mandurriao, Iloilo City.

2. Q. Are you the same Mary Flor B. Galvez, the petitioner in

this case?

A. Yes ma’am.

3. Q. Do you know a certain Oliver T. Olmedo?

 A: Yes ma’am. He’s my neighbor and he borrowed money

from me in the sum of Php 10.000,000.00.

4. Q: When did Olmedo borrow money from you?

A: October 10, 2018.

5. Q: Did you sign any instrument that could attest that such debt

was made?

A: Yes ma’am. We executed a written contract where he had

promised me to pay a sum of P10,000,000.00 with a collateral of a

10-hectare agricultural land located at Brgy. Pasil, New Lucena,

Iloilo. (Exhibit “A”). He also executed an Acknowledgement of

Debt. (Exhibit “B”).

6. Q: Did Olmedo pay his indebtedness on October 10, 2019?

A: He failed to pay the said obligation on due date.

7. Q: How did you settle this matter?

A: I lodged a complaint with the barangay officials of

Barangay Bakhaw, Iloilo City.

8. Q: Did he answer your demand?

A: He failed to comply with such demand.

9. Q: What did you do next?

A: I sent him a demand letter. (Exhibit “E”)

10. Q: Do you have any proof that Olmedo indeed refused to

settle his indebtedness?

A: Yes ma’am. Certificate to file Action (Exhibit “C”)

2. I have faithfully recorded or caused to be recorded the

questions I asked and the corresponding answer that the

witness gave;

3. I nor any other person then present or assisting her

coached the witness regarding her answers;
