Proceedings Roc.No.5/2020/Elec-1, dated.07.03.2020 of the Election Authority and Commissioner & Director of Municipal Administration. 4, G.O.Ms.No.115 MA&UD Dept., dated 03.03.2020. a 1 invite your attention to the references cited and enclose herewith Notification along with Schedule issued in the reference 3” cited fixing the number of seats Reserved for ST, SC, BC and women categories in respect of the Municipalities/ Nagarapanchayats as per the schedule annexed to this letter. 2. In this connection, I wish to inform you that instructions in detail have already been issued with reference to the statutory provisions dealing with reservations to the Municipal Commissioners of the Municipalities’ Nagarapanchayats, vide reference 1% cited (copies enclosed), for guidance to take up and complete the process of setting apart the Wards to the categories of ST, SC, BC & Women among the Wards in the Municipalities/ Nagarapanchayats as per reference 3” cited. It is further to inform that, as per Rule-3 of the A.P. Municipalities (Reservation of seats in Municipal Councils and Nagar Panchayats) Rules, 1995, the Government or Authority specified shall declare by a Notification in the A.P. Gazette, the number of seats to be reserved in each Municipal Council for STs, SCs, BCs and Women under Section 8 of the APM Act, 1965. in G.O.Ms.No.37 MA&UD, dt.03.02.1995, Government have delegated its powers to the Commissioner and Director of Municipal Administration to fix the number of offices of Member to be reserved for STs, SCs, BCs and Women in the Municipalities and Nagar Panchayats and also designated him as “Authority Specified” under the said rule for the above purpose. Further vide G.O.Ms.No.38 MA&UD, dt.03.02.1995, Government have delegated its powers regarding determination of specific wards to be reserved to STs, SCs, BCs and Women in Municipalities/ Nagarapanchayats and designated the “District Collector” concerned as “Authority Specified” for the purpose of determining the specific wards to be reserved to ST, SC, BC and Women in the Municipalities and Nagar Panchayats. 3. Further, it is also to inform that as per Rule-12.(1) Before issue of final Notification by the Government or Specified Authority setting apart reserved seats among Wards in Municipalities, a draft Notification shall be sent to the Municipal Council calling for its views by giving reasonable time. As per Rule-12 (2) the Government or the Authority Specified, after considering the views of the Municipal Council, shall issue final Notification setting apart reserved seats among various Wards in the Municipalities and publish it in the AP Gazette and concerned District Gazette also. Now the Government in G.O.Ms.No.115 MA&UD Dept., dated 03.03.2020 (copy enclosed) Rule-12 has been amended and according to the which, the authorities specified i.e., District Collector shall issue Notification setting apart reserved seats among various Wards in the Municipalities and publish it in the concerned District Gazette. 4. In this context instructions have already been issued to all the Municipal Commissioners concerned in the State to approach you with full information required as specified in the Circular instructions issued in the reference 1% cited for determination of the specific wards to be reserved to STs, SCs, BCs and women in the Municipalities/ Nagarapanchayats and apprise the statutory provisions to the District Election Authority & District Collectors and extend necessary assistance to the District Election Authority in the matter. 5 I therefore, request you to determine the specific Wards to be reserved for STs, SCs, BCs and women in the Municipalities/ Nagarapanchayats concerned in the District and issue notification to that effect duly publishing in the District Gazette as per the said Rules and as amended in G.O.Ms.No.115 MA&UD Dept., dated 03.03.2020 and communicate the same to this office by 08-03-2020 positively for further necessary action. Copy to all the Additional Election Authorities & Regional Directors-cum- Appellate Commissioners of Municipal Administration in the State.
