JUDICIAL AFFIDAVIT
I, Nadine Lustre-Reid, Filipino, of legal age, with
address at 24 Kobe Street, Ugac Sur, Tuguegarao City, after
having been sworn in accordance with law, hereby execute
this Judicial Affidavit, in Question and Answer form, pursuant
to Supreme Court A.M. No. 12-8-8-SC, to serve as my
testimony on direct examination as a witness in the above-
captioned case and hereby answer the following questions
below in support of the claims and allegations and to prove
legal basis for the Declaration of Nullity of Marriage pending
before the FAMILY COURT.

My examination was conducted at the office of the

undersigned counsel at Unit 666 Illuminati Building, Caggay
Tuguegarao City Cagayan. Likewise, the examination was
conducted in English, a language known to me. I answered
the questions asked of me, fully conscious that I did so under
oath and that I may face criminal liability for giving false
testimony or for perjury. Thus:

QUESTION AND ANSWER

1. Q. Please state your name and other personal

circumstances.
A. I am Nadine Lustre-Reid, of legal age, Filipino,
married, and has been for more than six (6)
months, a resident of 24 Kobe Street, Ugac Sur,
Tuguegarao City
2. Q. Are you the same Nadine Lustre-Reid, the
petitioner in this case?
A. Yes ma’am.

3. Q. Do you know a certain JAMES MARQUINEZ REID?

A. Yes sir. He is the the man I married on August 8,
2003.

4. Q. Do you have of proof your marriage with JUAN

DELA CRUZ?
A. Yes ma’am. I have here with me the Copy of our
Marriage Certificate.

5. Q. Is this the document you are talking about?

A. Yes ma’am.

6. Q. I am marking the Copy of your Marriage Certificate

that you prepared as “Annex A”. I am attaching it
to your judicial affidavit to form part of it. Do you
confirm my actions?
A. Yes ma’am.

7. Q. How did you meet respondent JAMES MARQUINEZ

REID?
A. We started out as friends. However, one day, out of
alcohol intoxication, we became sexually intimate,
hence, we became instant lovers.

8. Q. What happened after that?

A. I got pregnant and we got married. We got settled
at my family’s house.

9. Q. What happened during your pregnancy?

A. Due to my delicate pregnancy condition, I had to
stop working and depend totally on the financial
support coming from our parents

10. Q. What was the respondent doing when you were

pregnant?
A. Initially, he was jobless, that is why we had to
depend on our parents. Though he later worked as
a tricycle driver, he failed to surrender his
earnings because he continued with his vices
which included drugs, alcohol, computer games,
gambling, and others.

11. Q. What happened after that?

 A. Our first child was born and then five years later
the birth of our second child followed.

12. Q. Do you have of proof of the birth of your children?

A. Yes ma’am. I have here with me the Copy of their
Certificate of Live Birth.

13. Q. Are these the documents you are talking about?

A. Yes ma’am.

14. Q. I am marking these Certificate of Live Birth that

you prepared as “Annex B” and “Annex C”
respectively. I am attaching it to your judicial
affidavit to form part of it. Do you confirm my
actions?
A. Yes ma’am.

15. Q. What happened after you gave birth to your

children?
A. Despite the birth of our children, he did not mend
his ways. He would rather drink and do drugs with
his friends or spend time in a computer shop and
gamble, than work or stay at home to take care of
our children. Worst, I discovered that he was
maintaining an illicit affair.

16. Q. What happened after you found out about his illicit
affair?
A. I confronted him and his mistress. After which, he
chose to be with his mistress over his family and
since then, he did not show up anymore.
Eventually, I learned that respondent and her
mistress are living in Carig Sur, Tuguegarao City,
and now have a son named Jamesy.

17. Q. Do you have proof that he has a son with his

mistress?
A. Yes ma’am. I have here with me the pictures of
him, his mistress, and their son.

18. Q. Are these the pictures you are talking about?

A. Yes ma’am.

19. Q. I am marking these Certificate of Live Birth that

you prepared as “Annex D”. I am attaching it to
your judicial affidavit to form part of it. Do you
confirm my actions?
A. Yes ma’am.
20. Q. What course of action did you take after?
A. I consulted a psychiatrist for an evaluation to dig
into the cause of the failure of our marital relation.

21. Q. What did you find out on your evaluation?

A. I learned that we are both psychologically
incapacitated to take cognizance and perform our
essential marital obligations.

22. Q. Do you have proof that you are both

psychologically incapacitated?
A. Yes ma’am. I have here with me the Psychological
Evaluation Report.

23. Q. Is this the document you are talking about?

A. Yes ma’am.

24. Q. I am marking this Psychological Evaluation Report

that you prepared as “Annex E”. I am attaching it
to your judicial affidavit to form part of it. Do you
confirm my actions?
A. Yes ma’am.

25. Q: Do you have common properties with the

respondent during your marriage?
A: None ma’am.

26. Q: What are you asking this court with respect to this
case?
A: I am praying that the Honorable Court would grant
my petition for Declaration of Nullity of my
marriage with JAMES MARQUINEZ REID on the
grounds of psychological incapacity.

ATTESTATION
 I, Atty. LORNA HAPUNAN, with office address at Unit

attest under oath that I personally conducted the
interrogation of the abovementioned affiant who is the
plaintiff in the above-captioned case; I faithfully recorded the
questions I asked her and the corresponding answers she
gave me; and neither I nor any other person then present
coached her regarding her answers.
