ABSTRACT

This annotated bibliography tabulates and condenses information on the content

and relevance of selected sources central to the thematic concerns of the current
research project: colonial criminality, criminal processing & disciplinary
institutions in late colonial Philippines. It specifies the currency of listed
primary and secondary sources critically in terms of extractable quantitative
and/or qualitative data. As extractability of empirical quantitative data is a
central concern here, a more exhaustive description of corresponding sources on
this score will follow accordingly. Broadly, within this template, therefore,
information entered in the columns designated content and relevance will
underscore and refer to qualitative and (as the case may be, coeval) quantitative
data, respectively.

Noted template organises the tabulated annotations presented in the first two of
three parts of the incumbent report designated as Report # 1. However, unlike
the first two, the third and concluding part of said Report is strictly designed as a
quinquennial directory & statistical serial data-base drawn from (753) penal
cases transacted by the Supreme Court of the Philippine Islands between 1900-
1935. Annotations of supplementary secondary contemporary accounts and a
few official publications in Part 2 further shore up this study’s two major
empirical serial sources which undergird Parts 1 & 3: The Philippine
Commission Reports (PCR) later to be labeled the Report of the Governor
General (RGG) and the Philippine Reports. Altogether the three parts should be
read as logistical/technical reports on which empirical grounds the forthcoming
main chapters of the current dissertation will rest.

Finally, said technical reports (equivalent in fact to an overblown appendix)

were designed to raise research transparency in three crucial senses: 1) as a
referential compass and guide into the main sources for both researcher and
readers; 2) as a venue for raising the latter’s field of vision even in terms of the
process of raw data generation itself in the concluding part of the report; 3) as a
devise for facilitating in a more open and visible manner the process of
finetuning or reformulating preliminary theoretical questions against the
available empirical evidence.

BACKGROUND

The current stock of sources has been the product of two major visits to three
significant archives in Manila, Philippines, viz. Philippine National Archives
(PNA), Lopez Memorial Museum Library (LMML), and the American
Historical Collections (AHC) at the Rizal Library, Ateneo de Manila University.
The first major if exploratory visit took place in 1998 in two consecutive sub-
phases (phase 1: February-April; phase 2: September 1998), during which two
main primary serial sources were retireved, reproduced and filed: Philippine
Commission Reports (PCR) later to be labeled the Report of the Governor
General (RGG) and the Census of the Philippine Islands (1903/1918). Still, a
host of other important statistical and anecdotal sources relevant to the thematic
concerns had then also been acquired. During the second major and recent visit,
(September-October 2003) a continuous quinquennial data sampling survey (for
the period 1900-1935, amounting to several hundreds of penal cases) based on
the serial material, Philippine Reports (PR), the bounded muti-volume chro-
nological reports on cases determined by the Supreme Court of the Philippines,
was conducted. Contemporaneous secondary accounts, monographs, and
periodical articles were added to the current stock.

Mode and extent of retrieval/reproduction of sources varied according to i.a.

existing procedural standards at noted archives, time, resource factors, and, of
course, the thematic concerns. Mode-wise, the bulk of sources retrieved in the
1998 visits, and a few of those secured in 2003, were photostatic copies.
Whereas an overwhelming share of stock acquistion during the latter visit were
digitally reproduced and stored in JPEG image files. In much the same vein,
retrieval/reproduction differed widely, extentwise. Save for some important
monographs, periodical, journal articles and travelogues, and certain volumes of
the two consecutive censuses (1903/1918) – which were retrieved in toto - a
large portion of the main primary and secondary source reproductions consist of
selected pages containing theme-related information.

Consequently, for example, only systematically excerpted theme-related

segments (those containing qualitative and quantitative data on criminality and

corresponding colonial control institutions) from the annual Philippine

Commission Reports (PCR)-Report of the Governor General (RGG) for the
period 1900-1935 (with the exception however of a dozen of later volumes in
the series available in complete copies: see note on sources below), were
photostatically reproduced and filed. Similarly, for the Philippine Reports (PR)
systematic extraction and digital recovery were confined exclusively to Supreme
Court decisions on penal cases at five-year intervals between 1900-1935.

Besides widely contrasting procedures at noted archives, the fact that certain
serial materials (e.g. PCR-RGG) were unavailable in complete sets in any one
place made retrieval and reproduction work on some of the main sources more
arduous and time-consuming than expected. In the bracketed case, filling the
“cavities” in the serial source meant i.a. a lot of time lost on the road,
negotiating traffic while shuttling between two archives (Philippine National
Archives & Lopez Memorial Museum Library) located at opposite ends of
Manila.

NOTES ON SOURCES

PRIMARY SERIAL AND OFFICIAL SOURCES

The primary serial source Report of the Philippine Commission (RPC) was
retitled Report of the Governor General (RGG) in 1916 onwards, at which time
US Congress ratified a new organic law granting political autonomy with a
promise of future independence to the Filipinos. While the once appointive
Philippine Commission had now been replaced by a popularly elected Senate,
the office of the governor general continued to receive its mandate from the
White House, and was officially under the umbrella of the Bureau of Insular

Affairs. The retitling synchronises with this defining moment in American-

Filipino relations. From the RPC volumes (1900-1915) in the series only theme-
related segments were culled. Selective extractions from the RGG portion of the
series (1916-1935) cover the following years: 1916, 1917, 1918, 1919, 1933,
1934, 1935; for the intervening volumes (1920-1932) complete copies were
acquired and photostatically reproduced. The sheer obesity, and thus potential
reproduction costs, of the earlier RPC relative to the RGG volumes largely
dictated noted difference in modes of extraction. Take note that the name (s) of
the governor general (s) (incumbent, incoming, outgoing) for the respective
annual reports appear in the left-most column of the table of annotations.

The Censuses (CPI) of 1903 and 1918 are complete insular-wide censuses,
taken at the outset (1903) under the direction of the Philippine Commission,
then colonial caretaker government, pursuant to a congressional Act (# 467) in
1902. Section 7 of said Act made census-taking a formal precondition to the
eventual holding of general elections for the s-c Philippine Assembly, the
envisioned all-native legislature. The 1903 CPI was published in four volumes,
under the respective headings of (I) Geography, History and Population; (II)
Population; (III) Mortality, Defective Classes, Education, Families and
Dwellings; and (IV) Agriculture, Social and Industrial Statistics. Initial and
limited statistical data on deviance and penology can be found in Chapter VIII
on “Criminals and Prisons” in Volume IV. Tabular data on the other main
categories and sub-categories (e.g. population, climate etc) also came out in the
form of bulletin reports. Finally, for CPI 1903 (including the first three
consecutive bulletin reports), complete copies are in custody. For CPI 1918
however, only selected extracts from Volume I on “Geography, History and
Climatology” were reproduced. On the other hand, original complete copies of
Volumes II-IV (II.“Population and Mortality;” III.”Agriculture, Medicinal
Plants, Forests, Lands, and Proper Diet;” IV.”Social and Judicial Statistics,
Manufactures and Household Industries.”) are in our provisional care through
the courtesy of the archives of the Swedish Central Statistical Bureau.
Comparatively, the 1918 tabular data on judicial and penal statistics are far more
extensive than those in the preceding census, and appear in Volume IV Part II
under the rubric “Judicial Statistics.”

The ensuing gap in serial judicial, criminal and penal statistics for the
intervening post-1918 period has besides the annual commission and governor
general’s reports, partially been bridged in this study by other official statistical
sources available to the author, like the Statistical Bulletin (SB), at least for the
succeeding 10 years (1918-1928, #1-11). SB was first published by the Dept. of
Commerce and Communications, which at the time was in the process of
reorganisation into the Bureau of Commerce and Industry. To qualify however,

relevant if summary statistical data on noted thematic concerns can be drawn

singly from the following issues/years: #3 (1920), #7-11(1924-28).

Deviating from the standard binary structure of the annotations (according to

content and relevance of listed literature), general changes in the Penal Code
(PC) can be gleaned from the exclusively content-specific comparative
annotations of its three successive revisions, viz. 1904, 1911, 1932, as tabularly
summarized in 1.3. The same procedure is repeated for the Civil Code, CC
(1932, 1948) and the Code of Civil Procedure, CCP (1921) in the next section,
1.4.

The Philippine Reports (PR) compiles and publishes cases determined in the
Supreme Court of the Philippine Islands. The first volume came out in 1904,
covering cases transacted between August 8 1901 and February 20 1903. The
insular Supreme Court then was headed by a native Chief Justice and 6 associate
justices (2 natives and 4 Americans), under which served an American attorney-
general, a native solicitor-general, and one American reporter. In the first
volume and subsequent ones, the table of contents usually includes: an
alphabetical list of cases reported as well as those cited in the reports.

In the immediately adjacent reference list are found consecutive indices on

citations and references from: articles of the civil code, penal code, code of civil
procedure (old and new), code of commerce, general orders of the military
governor of the Philippines, mortgage law, and miscellaneous statutes. For the
purpose of the study, strictly penal cases were selected. Selection was done on a
five-year interval basis: 1900, 1905, 1910, 1915, 1920, 1925, 1930, 1935.

Collation of cases proceeded systematically in the following mode: first, penal

articles with their corresponding page designations enumerated in the reference
index “Article of the Penal Code Cited or Referred To in this Volume,” were
“distilled,” or “deflated,” i.e. as there was no necessary correspondence between
penal articles cited and absolute number of penal cases reported in the volume.
Either several articles could very well be cited in the same case reported, or
several cases reported cited the same penal article. Thus, one first had to
determine the pages registering one or more penal articles. This tedious
procedure had a two-pronged purpose: first, to enable one to determine more
exactly the absolute number of penal cases reported in the volume; second, to
expedite chronological photographic retrieval of selected cases from ditto.
Selected cases were finally digitally photographed and stored in JPEG image-
files, an inventory of which appears at the end of this report.

A similar technical problem was encountered in determining the absolute

number of all cases reported, i.e. inclusive of all case categories, insofar as these

were listed alphabetically under the names of both complainant/appellee and

defendant/appellant. Here, the total number of cases could be fixed after
eliminating “double-accounting” instances, as it were. Last but not least, it is
also important to note that the cases included in the survey do not even remotely
approximate the total number of penal cases handled by the whole gamut of
colonial courts (Supreme Court, Courts of First Instance, justice of the peace
courts) throughout the Islands; cases accepted and transacted by the Supreme
Court, the highest appellate court, are of course those with extraordinary legal
merit and constitute as such only a small fraction of the total cases transacted in
the insular court system as a whole. Furthermore, procedural reforms introduced
by the Americans were designed to impose stricter limitations on Supreme Court
case throughput as an antidote to notable dilatory workings of past Hispanic
colonial judicial systems.

Part III of this report, provides a complete case directory and statistical data base
with corresponding serial data sheets in Excel-format, including a summary of
data-base parameters, design, key or legend over column headers, and additional
critical notes on source, data collection & processing.

CONTEMPORARY SECONDARY SOURCES

Blair & Robertson’s (1907) The Philippine Islands 1493-1898 span 51

volumes, among which complete photostatic copies of three (3)
relevant volumes have been included in the current collection.

Deliberately, only contemporary secondary sources (in the form of monographs,

manifestos, travelogues, journal and newspaper articles) are the
targets of annotation in this bibliography. Annotations are organised
chronologically, rather than alphabetically, to easily locate points in
the relevant time scale where frequency of accounts on thematic
concerns are either “thicker” or “thinner” if not vacuous. Following
this logic, for instance, sundry articles from the same journal will be
sorted by year of publication, not author’s name, in the general
chronology (2.3).
