CONSULTANTS / CONTRACTOR MEETING

Agenda: 1.Discuss New proposed program of works in light of failure to beat 8 September Deadline.

2.To agree on a new properly agreed date.

Minutes

-The Architect lamented the continued absence of Mr G.L Njanike in critical Meeting, including crisis
control meetings like this one. The sincerity and cooperation required required for the success of the
project demands all team members to be present.

Original Works

-Main contractors; Njanike construction submitted a revised Program of Works, with a 24 September
for completion of shell works on the whole original scope. (Up to first floor, plumbing; external works,
but excluding second floor extension)

-The meeting requested clarity on the cause for failure of the Contractor meeting the 8 September, 2017
deadline; The main Contractor cited the 20 day Industrial action by their workers due to non – payment
of wages.

-Contractor said that the wages dispute between them and their staff had been partly resolved by
payment of 50% of the wages debt.

-The main Contractor is requesting an advance payment N. 3 for them to :

-The Quantity Surveyor reported that the 1 ST Advance payment was recovered by work done, the 2 nd
Advance payment has not yet been recovered, and he said the 3 rd advance payment if given at all, can
only be given if an acceptable security is given by the Contractor, or if the 2 nd and 3rd Advance payments
are:

-The QS strongly recommended that any further advance payment be only issued of an equivalent and
acceptable security is offered, e.g car registration book, or property title deed equivalent to the value
of all advance payment.

-The QS also requests that the Client endorse in writing that they approved the previous advance
payments and if they will pay the 3 rd Advance payment, to do so. I n the absence of such endorsement
the advance payment shall be reversed for professional reasons.

-The Consultants were not informed of the 20 day industrial action at all, even if the Architect was
supposed to be immediately notified in writing by the contractor at the onset of such a development.

-The consultants concluded that the Proposed program given by the contractor can be implemented
successfully, but in the absence of solutions to the current In – house problems with the contractor, and
a firm commitment that those issues have been solved, the Program will not be followed with success.

-Supply of materials- The contractor said; the supply of materials by the client is very well liked, not
causing any delays.

#Information from consultants – The Contractor also acknowledged that at the moment no information
from the consultants cause delay.

-Cautionary Note: The consultant warned of the necessity of placement of roof, windows and external
does before the first rains falls; in order to avoid several houses on finishes.

# Recommendations

*The Contractor’s Principal must attend the next site meeting in order to personally answer for
questions which need official and written down commitment; specifically matters to do with financial
positions; security of Payments.

*The consultants recommended that we work within the spirit of the contract signed between client
and contractor.

*Previous deadlines have not been met because the same in house problems.

*Emphasis of progress to be placed on Gutter beam and roof.
