Annexure – I
INSTRUCTIONS TO BIDDERS
1 DEFINITIONS

1.1 NCB means the Director General, National Council for Cement and Building Materials or
his successors or assigns.

1.2 Supplier/E-Tenderer means the person, firm, company or body corporate who have
submitted the E-Tender or with whom the order is proposed to be placed and shall be
deemed to include its successors, heirs, representatives, administrators and executors unless
specifically excluded from the contract.
2 INSTRUCTIONS TO BIDDERS

2.1 E-bids are invited from Indigenous manufacturers for the equipment as detailed in
Annexure-II(a).

2.2 Offers should be completed in all respects supported by scanned copies of technical
literature, leaflets etc, as may be necessary for proper comparative evaluation of the offers
and in addition a list of users, to whom items of similar specifications/capacity have been
supplied during last 2 years, with complete address and order reference along with their
performance report should be uploaded.

2.3 E-Bids to be uploaded in Two bid system, with Techno commercial offer in one cover
and Price Bid in second cover.

2.4 E-Tenders without EMD shall be considered unresponsive and summarily rejected.
Scanned copy of demand draft need to be uploaded while submitting the online bid.

2.5 Original copy of Demand Draft (With Bidders name written at back) should reach the

2.6 Non compliance of commercial Terms & Conditions (Annexure III) will result in disqualification of

2.8 After evaluation of the Techno Commercial bid, all the bidders will get information
regarding their eligibility on the eprocurement portal – www.eprocure.gov.in.

2.9 Date & time of the opening of the price bids of the qualified bidders shall be published on the
eprocurement portal – www.eprocure.gov.in.

2.10 The offers, in addition to equipment and its complete accessories, should also include
essential spares which may be required for 2 years of smooth operation of the equipment
after the 12 months (minimum) comprehensive warranty/guarantee. The quotation should
contain the following information:
a) Names of the spares with manufacturers code numbers. (with break up)
b) Quantity recommended for each item
c) Price of each item (to be shown in price bid only)
d) Total cost of Spares (with complete details/break up) for 2 years of smooth
operation (to be shown in price bid only).
e) Shelf-life of the spares/parts.

APPENDIX-A

BACKGROUND AND REQUIREMENT

NCCBM requires a 3D printer for development of a technology for printing an object by using
cement based materials/alternate material of similar nature. The development of 3D printing
technology will be on laboratory scale which involves design and supply of 3D printer compatible to
cement based material and vice versa. The detail specification of 3D printer is given below.

2.0 Special terms and conditions

1. Since the preference is given to Make in India program, bidder should have a manufacturing
facility including service center in India for technical support, maintenance, modifications
and upgradation.
2. Supplier shall engage / depute their dedicated group/team, having at least ½ technical
experts, up to 6 months, for design & execution and day to day development of the project at
NCB after supply.
3. Any modifications in the equipment required during the testing and installation stage shall be
carried out by the bidder at their own cost under R&D program of NCB.
4. The Bidder should have an experience in manufacturing such type of devices and equipment
for minimum 2 years or more from the date of Bid opening.
5. Bidder should submit a schematic/line diagram of the equipment assemblies along with the
bid proposal. An indicative diagram is enclosed for reference.
6. Adequate training of printing software and equipment operation should be given by supplier
at NCB Ballabgarh up to the satisfaction of engineer.
7. Bidder should also quote the Annual Maintenance Cost (AMC) separately.
8. All design including equipment will be intellectual property of NCB and will not be shared
by supplier to any other agency. NCB will be free to file patent as deemed fit. Bidder will
provide all technical support. NCB will be free to transfer the technology to any other agency
and earn/take royalty. No share will be provided to the bidder.
9. All software design codes should be transferred to NCB by bidder for further improvements
in execution software/programming. All software code etc. shall be the property of NCB.
10. For Update/revision in software and monitoring of equipment (during next 3months from
date of installation) bidder should appoint 1 expert (software/mechanical) to ensure smooth
working of 3D printer machine.
11. All patents with regards to technology shall be the property of NCB.
12. Research publication shall be in the name NCB researchers/engineers. However, name of 3D
printer provider shall be duly acknowledged.

Annexure – II (b)

Technical Terms & Conditions

1 Scope of E-Tender: The scope of the present e-tender covers the following:

1.1 Supply of the equipment [refer Annexure –II (a)].

1.2 Supply of essential accessories and smooth functioning after warranty/guarantee (with break-
up).

1.3 Installation, commissioning & performance guarantee test of the equipment as the case may
be.

1.4 Satisfactory continuous trial runs as per Schedule of Contract. (refer Annexure –II (a),
Appendix A, clause 3.0)

1.5 Training to NCB Officials for operation of the equipment supplied.

1.6 Guarantee for supply of spare parts/consumables/accessories for smooth functioning of


equipment for 10 years from the date of supply.

1.7 Optional Items if any to be shown separately with break-up.

2 Specifications: The specifications of the equipment given in Annexure II (a) are only
indicative and not exhaustive. E-Tenderers are requested to offer equipment of their own
specifications or nearer to the specifications as far as possible, the objective of the E-Tender
being to buy the technologically best equipment available at the present times. All associated
accessories should be branded/reputed make to be specifically mentioned against each as far as
possible.

The complete specifications, materials of construction etc. of the equipment offered shall be
given in the offer with overall dimensions and approximate weight of the equipment alongwith
technical literature in duplicate, to enable proper technical evaluation possible.

The E-Tenderers are requested to study the site/location and available/existing infrastructure
with NCB, before quoting and state categorically that they have submitted their E-Tender after
studying the site conditions. The E-Tenderer’s & purchaser’s scope should be clearly specified
in the E-Tender document.

3 Pre-requisites for Installation/Commissioning: The E-Tenderers shall provide the following


information in their offer itself:

3.1 Space requirement for installation of the equipment.

3.2 Site preparation requirement & drawings/civil foundation drawings as the case may be.

3.3 Environment conditions necessary for smooth working and efficient operation of the
equipment.

3.4 Peripheral services expected to be made available by NCB before installation.

3.5 Any additional instrument/equipment necessary, which has to be made available by NCB at
the time of installation (such as voltage stabilizer etc. etc.)

3.6 Any materials/tools which the E-Tenderer may expect NCB to provide at the time of
installation/commissioning of the equipment.

3.7 Any other information considered necessary including the time required for successful
installation / commissioning.

4 Installation & Commissioning: The work of installation & commissioning shall consist of the
following:

4.1 Movement of the equipment & its accessories from the place of storage to installation site.

4.2 Lifting, assembling & placement of the equipment and accessories at the site of installation.

4.3 Performance guarantee test in respect of the equipment.

4.4 All erection tools, tackles, welding machine & electrodes, skilled and unskilled workers for
proper installation of the equipment shall be arranged by the E-Tenderer or his agent at his
cost. However, electric power shall be provided by NCB within a distance of 30 meters of the
installation site.

5 Maintenance & Operation Manual: The supplier shall supply 2 copies of the Maintenance &
Operation Manual/Instructions/Detailed drawings & circuitry (English version only) alongwith
the equipment.

6 Test Certificate: The E-Tenderer shall furnish test certificates certifying that the equipment has
been tested before despatch and it was in perfect working order and had no defects whatsoever.
This certificate shall be either from Manufacturer, NPL, NABL or any recognized national /
international agency.

7 Power Supply: All equipment shall be suitable for operation at 220V, Single phase or 415V, 3
Phase, 50 Hertz A.C supply.

Annexure - III
Commercial Terms & Conditions

1. GENERAL

1.1 The NCB reserves its right to accept partly or wholly or reject any offer without
assigning any reason therefor. The NCB does not pledge itself to accept the lowest or
any e-tender and reserves to itself the right of acceptance the whole or any part of the
E-Tender or portion of the quantity offered and the E-Tenderer shall supply the same at
the quoted rate. Conditional offer is not acceptable. Any deviation in the commercial
terms / conditions is not acceptable to NCB.

1.2 It is in the interest of E-Tenderers to study the technical specifications given in


Annexure - II thoroughly before quoting so that if any deviations (only technical
specifications) are made by the E-Tenderers, the same are prominently brought out in
their offer specifically and clearly.

1.3 Standards: The supplier shall also state according to which National/International
standards the equipment is being quoted. It is expected that quality of the item quoted
shall conform to International Standards in case of foreign equipment and Indian
Standards in respect of Indigenous equipment

1.4 Subletting and Assignment: The supplier or agent shall not sublet, transfer without the
previous consent in writing of NCB or assign the contract or any part thereof or interest
therein or benefit or advantage thereof in any manner whatsoever. Provided,
nevertheless that any such consent shall not relieve the supplier or agent from any
obligation, duty or responsibility under the contract.

2 COMMERCIAL

2.1 Earnest Money: An earnest money deposit as specified in the Notice Inviting E-
Tender in the form of Demand Draft payable to “National Council for Cement and
Building Materials” at New Delhi/Faridabad shall accompany every offer failing which
the offer is liable to be summarily rejected. The earnest money shall be refunded
(without any interest) to unsuccessful bidders in due course. Public Sector Undertaking
of the State or Central Govt. and Small Scale Industries registered with National Small
Scale Industries Corporation need not to submit EMD but they must enclose a latest
attested copy of their registration certificate (in force) from the above agencies.
EMD shall be forfeited by NCB, if the Bidder becomes non responsive any time
after submission of bid till the fulfillment of any obligation. NCB decision in this
regard shall be final.

2.2 Security Deposit: The supplier shall have to deposit within a period of 15 days from
the date of award of the Letter of intent/order, a Security Deposit which alongwith the
sum already deposited as earnest money shall be equal to 5% of the value of the
contract. The Security Deposit shall be in the form of Demand Draft in favour of NCB
payable at New- Delhi/Faridabad (INDIA). If the supplier is called upon by NCB to
deposit ‘Security’ and if he fails to provide the security within the period specified,
such failure shall entitle NCB to forfeit the Earnest Money and to rescind the contract.

No claim shall be entertained by NCB either in respect of interest or any diminution/ or
devaluation in value of any security.

2.3 If the supplier fails or neglects to observe or perform any of his obligations under the
contract, it shall be lawful for the NCB to forfeit either in whole or in part, the security
deposit furnished by the supplier. However, if the supplier duly performs and completes
the contract in all respects, NCB shall refund the Security Deposit (without any
interest) to the supplier after deducting all costs and other expenses, if any, that the
NCB may have incurred and all dues and other money including all losses and damages
which the NCB is entitled to recover from the contractor within one month after
completion of successful installation and commissioning. NCB is however not bound
to prove any demonstrable loss on this account and its decision shall be final.

2.4 Validity of Offers:

The offers shall be valid for acceptance by NCB for a period of 120 days from the
date of its opening and shall remain firm and fixed till the execution and completion
of the contract. The supplier shall not claim any increase in cost due to any reason
whatsoever.

2.5 Transit Insurance: The consignment (for imported items) should be insured for
110% of the CIF value for all transit risks upto NCB Unit at Ballabgarh (Haryana)
INDIA and other respective NCB unit in India via New Delhi Airport. The Insurance
cover should be taken with a reputed International Company having agents in India.

In the event of transit damage supplier will prefer the claim on their Underwriters
under intimation to NCB and make a free supply to NCB on urgent basis. In case of
indigenous supplies, supplier will quote their rates inclusive of transit insurance upto
destination.

NCB shall as soon as possible but not later than 30 days of the date of arrival of stores
at destination, notify the supplier of any loss or damage to the stores that may have
occurred during transit.

2.6 On site Comprehensive Guarantee and Warranty:

On site standard guarantee/warranty for 12 months to be provided free of cost


from the date of installation and commissioning of the item.
i) The supplier shall warrant that every item of supply is free from all defects
and faults in materials, workmanship, functioning of delicate/sophisticated
equipment components and the part manufactured shall be of the highest
grade and consistent with established and generally accepted standards for
materials of the type ordered and in full conformity with the contract
specifications and shall operate properly. To stand with performance
warranty/Guarantee of the equipment the supplier shall have to furnish
unconditional Performance Security (Performance Bank Guarantee)
equivalent to 10% of the total value of equipment plus installation and

commissioning charges if any valid for a period of 60 days beyond the date
of completion of all contractual obligations of the suppliers including
warranty obligations. During the warranty/guarantee while any
repair/replacement becoming necessary the same shall be made good by the
supplier, free of charges, at the respective units of NCB, and if it becomes
necessary to send the equipment(s) or part(s) thereof for repair/ replacement to
supplier’s works, the cost of repairs/replacement, loading/ unloading,
insurance, freight, transportation etc. from the respective units of NCB, to
Supplier’s works and back to NCB Unit shall be borne by the supplier.

ii) After expiry of standard guarantee/ warranty for 12 months (as mentioned
above), the supplier shall also quote for additional warranty (Additional
Maintenance Contract) for 24 months.

Offers from the suppliers not conforming to the above are liable for
iii)
summarily rejection.

2.7 Defect Liability Period: The guarantee period as stipulated in Clause 2.7 above shall
be treated as “Defect Liability Period”. In the event of any defect / fault, arising
during “Defect Liability Period”, all repairs shall be normally carried out at the place
where the equipment is installed without any charge on NCB within one month of
reporting the defect/faults unless permitted by NCB otherwise in writing. In case the
defect/fault is not rectified within the above referred period of one month, the defect
liability period will be extended by the duration the equipment remains non
functional. Should it however become necessary to replace any part or take out part or
whole of the equipment, it shall be done solely at the risk and cost of the supplier and
he shall be responsible for meeting all expenses upto its reinstallation, commissioning
and satisfactory operation. In case NCB has to incur any expenditure on getting the
equipment repaired or replacement of whole of the equipment or part thereof, NCB
shall be at liberty to adjust/recover the cost including other charges if any from
Security Deposit/Performance Bank Guarantee & the decision of NCB in this respect
shall be final and binding and the supplier shall not raise any objection of whatsoever
nature on this account.

2.8 Liquidated damages for delay in supply: Time is the essence of contract, if the
supplier fails to deliver the stores or any installation thereof within the period fixed
for such delivery/installation & commissioning agreed or at any time repudiates the
contract before the expiry of such period, NCB shall without prejudice to its right,
recover from the supplier as agreed liquidated damages a sum equivalent to 1/2%
(half of One percent) of the undelivered portion (in case of supply)/contract value (in
case of supply/Installation & Commissioning) per week or part thereof subject to a
maximum of 5% (five percent).

2.9 Terms of Payment:

The supplier of 3D printer will be selected on acceptance of all compliance of tender and lowest
cost. The payment of supplier will be made on successful demonstration of 3D printer as per
specification and satisfaction of NCB. The payment schedule will be as follow:

A) 30% on arrival of equipment at NCB.
B) 20% on installation, Testing & Refinement of technology in association with NCB team as
part of development of 3D Printing Technology.
C) 20% after successful demonstration of technology.
D) 30% after handing over the document, design, codes and training to NCB officials.

2.10 Bank Charges:

All bank charges in connection with the Letter of Credit within India shall be borne
by NCB.

2.11 Currency of Payment:

a) The Contract price shall be paid in Indian rupees (INR).

2.14 Delivery:

The supplier shall specify the time required for the supply &
installation/commissioning separately against each item in the offer/E-Tender. In case
delivery/shipment is made after the prescribed delivery/shipment date/period except
force majeure, the liquidated damages shall be charged as per clause 2.9.

2.15 Packing: The equipment offered shall be securely packed in Air/Rail/Road-worthy


conditions and it shall withstand without damage rough handling enroute and transit
hazards. All containers (including packing cases boxes, tins, drums and wrappings) in
which the stores are supplied by the supplier shall be considered as non-returnable
and their cost as having been included in the contract price.

2.16 Shipment: Items should be dispatched through registered/reputed transporters.

2.17 Port of Embarkation: The Port of destination shall be New Delhi Airport for
supplies by air. However, if any change in the port of destination is necessary, the
same shall be intimated at the time of placement of order.

2.18 Completion of Supply, erection & commissioning: Supply should be completed


within the delivery period as stipulated in the order. In any case supply, erection &

commissioning, trial run & performance guarantee test to be completed well within
the prescribed time to avoid imposement of liquidated damages.

2.19 Inspection and Rejection: The final inspection of the materials shall be done after
satisfactory supply/Installation/Commissioning at NCB. If the materials are rejected,
NCB shall be at liberty to:

a) Allow the supplier to replace the rejected material. However, such


replacement shall be entirely at the risk and cost of the supplier and NCB shall
not bear any expenses whatsoever incurred on such replacement.
OR
b) Terminate the contract or part thereof, as the case may be, and recover from
the supplier the cost paid together with any loss, which NCB may incur in
buying the replacement of rejected materials from any other sources. The
NCB’s decision as regards rejection as aforesaid shall be final and binding on
the parties to the contract and shall be non-appealable.

2.20 Risk Liability during Installation/Commissioning: Installation and commissioning


shall be done by the supplier taking all precautions, avoiding risk and damage to men
and machinery at site. If in so doing any property or equipment of NCB gets
damaged, the supplier shall make good the loss. However, in case of any damage to
the equipment or property of the supplier or injury to or death of his men during the
course of supply, installation or commissioning, NCB shall not have any
responsibility therefore whatsoever and the supplier shall bear all costs, compensation
arising therefrom. No liability Civil / Criminal / or otherwise in this connection
whatsoever shall be borne by NCB.

The supplier shall take at his cost insurance policies against death/bodily injuries to
the persons connected with the installation and commissioning of the equipment,
during the period of contract.

2.21 Legal Interpretation / Arbitration:

Except where otherwise provided in the contract all questions and disputes relating to
the meaning of any of the clauses of this contract and as to the quality of
workmanship or the quality of materials used or supplied or as to any other question,
claim right matter of things whatsoever, in any way, arising out of or relating to the
contract or the execution or failure to execute the same whether arising during the
progress of the contract or after the completion or abandonment thereof shall be
referred to the sole arbitration of the person appointed solely by the Director General,
NCB. There will be no objection to any such appointment that the appointment has
been made by the Director General, NCB, that he had to deal with the matters to
which the contract relates, and that in the course of his duties as the Director General,
NCB, he had expressed views on all or any of the matters in dispute or difference.
The Arbitrator to whom the matter is originally referred being unable to act for any
reason, the Director General NCB shall appoint another person to act as an
Arbitrator and such person shall be entitled to proceed with the reference from the
stage at which it was left by his predecessor.

It is also a term of this contract that no person other than a person appointed by the
Director General, NCB, as aforesaid should act as Arbitrator. The reference to the
arbitration by the supplier/contractor can be made only after the completion of the
work under this contract, expiry of the period of the contract, and before accepting
payment in full and final settlement. The award of the Arbitrator shall be final and
binding on all the parties to the contract. Subject as aforesaid, the provisions of The
Arbitration & Conciliation Act, 1996 or Statutory modification or enactment thereof
and the rules made there under and for the time being in force shall apply to the
arbitration proceedings under this clause.

This contract shall be governed by the laws of India for the time being in force,
irrespective of the place of shipment or delivery, the contract shall be deemed to have
been made at the place from which the order has been issued.

The venue of arbitration and Jurisdiction to file any application/Petition under the
Arbitration and Conciliation Act, 1996 shall be New Delhi (India)

In this clause, the expression “the Director General NCB” means the Director General
of National Council for Cement and Building Materials for the time being and
includes the officer who is looking after the current duties of Director General or
heading the Institute by whatever name called.

2.22 E-Tender evaluation / Loading criteria:

2.22.1 The comparative assessment of offers will not only be made simply on the basis of
price quoted but also after taking into account the financial implications for the
deviations in terms and conditions in line with unequivocal evaluation criteria viz;
payment terms, delivery period, performance guarantee etc. i.e. as deemed fit by
NCB without any clarification to E-Tenderers on this account.

2.22.2 Conditional discount for converge within a shorter period, for early inspection/
payment etc. will not be considered for the purpose of price evaluation.

2.22.3 If during the contract period, there is a downward trend of rates, any statutory
benefit for the items / any of the items, the supplier will pass on the benefit to NCB.

2.23 Award of contract: NCB reserves its right to award the contract on more than one
supplier at their sole discretion.
