VIOLATIONS OF STAY HOME, WORK SAFE ORDERS

Effective March 24, 2020 at 11:59 pm through April 9, 2020 at 11:59 pm, the Stay Home, Work
Safe Order will take place. The Mayor’s Declaration states that businesses and citizens
comply with the order and each incident should be handled on a case by case basis. Officers
shall begin enforcement of Emergency Declaration #5, Stay Home, Work Safe Orders on the
following violations:

• All public or private gatherings occurring outside a single household or single-family living
unit are prohibited unless specifically exempted under this Declaration. Members of a
household or single-family living unit may gather.

• A food establishment may only provide take out, delivery, drive-in, room service, or drive-
thru services.

• Bars, lounges, nightclubs, taverns, private clubs, gyms or health studios, indoor commercial
amusement businesses, bowling alleys, bingo parlors, and theaters shall close.

The following are Exempted CITIZEN Activities from this order:

• Health and Safety – maintaining the health and safety of the individual or their family or
household members and pets. Examples include:
o Medical supplies or medication
o Doctor visits
o Obtaining supplies from work
• Necessary supplies – purchasing necessary services or supplies. Examples include:
o Grocery store
o Pet supplies
o Home improvement stores
o Home repair
• Outdoor activity- activity in an outdoor space, such as walking, biking, hiking, or running
as long as individuals comply with the social distancing requirements of six feet.

The following are Exempted Businesses:

• Health Care Services – providing or delivering of healthcare services.

o Hospitals/Clinics
o Pharmacies
o Dentists
• Transportation – businesses related to the operation, maintenance, construction, and
manufacture of transportation services. Examples include:
o Public transportation/taxis/ride shares
o Dealerships
o Auto repair shops/tire repair shops
 o Gas stations
• Food, Household Staples Retail – food service and food distribution providers to include
farmer’s markets. Other examples include:
o Laundromats, dry cleaners, and laundry service providers
• Services for Economically Disadvantaged Populations – businesses that provide food,
shelter, and social services and other necessities of life.
• Services to Maintain Operations of Residences or Support Exempted Businesses.
Examples include:
o Hotels
o Shipping services
o Building cleaning/landscaping services
o Plumbers, electricians, moving services, exterminators
o Legal or accounting services
• Financial Institutions
• Funeral Services

ENFORCEMENT
OFFICERS SHOULD NOT MAKE SELF-INITIATED STOPS SOLELY FOR THE PURPOSE OF
DETERMINING IF AN INDIVIDUAL IS IN COMPLIANCE WITH THIS DECLARATION.

• When officers encounter a call regarding violation of the Public Health Emergency
Ordinance, they shall:
o Identify the manager or owner of the establishment/business or residence.
o Give the party an opportunity to disperse the customers or gathering.
o If the manager or owner fails to comply, the officer shall issue the manager or owner
a Misdemeanor Citation (the white ticket, not a blue Cite and Release Citation);
o The violation on the Misdemeanor Citation will be written as:
