PETITION

Petitioner, through the undersigned counsel and unto this Honorable


Court respectfully alleges that:

1. The petitioner is of legal age, Filipino citizen, and a resident of 123


Salingpusa Street, Barangay Balibago, Angeles City. Attached herein
are the following:

ANNEX “A” - Sworn certification of residency;

ANNEX “B” - Sworn statement of counsel of record;

ANNEX “C” - Utility bills in the name of the petitioner.

2. However, the petitioner is currently residing at her parent’s residence at


456 Magulang Street, Barangay Balibago, Angeles City, where she may
be served notices and other court processes;

3. The respondent is also of legal age, Filipino Citizen, and currently


residing at 123 Salingpusa Street, Barangay Balibago, Angeles City;

4. The petitioner came from a wealthy clan in Angeles City. She is


currently the Chief Executive Officer of Krusty Krab Foods, Inc.
Attached as ANNEX “D” is the petitioner's Certificate of Employment.
While, the respondent was an Overseas Filipino Worker in Saudi
Arabia;

5. Petitioner, who was a freshman in college, first met the respondent


sometime in June 2006 at a birthday party of a common friend. The
respondent and the petitioner were introduced to each other by their
friend and they instantly clicked;

6. The respondent, who was thirty (30) years old then, courted the
petitioner for a month and became lovers despite the disapproval of the
petitioner’s parents due to the age difference;

7. Sometime in November 2006, the respondent proposed marriage to the


petitioner. The petitioner was hesitant at first because she was still too
young. The respondent assured her that it was alright since she would
turn eighteen yeas old in a few days;

8. The petitioner finally gave in when the respondent told her that he was
bound to leave the Philippines for abroad on December 2, 2006, and he
would only be back in the Philippines after two years;

9. They celebrated their marriage on December 1, 2006 before the Mayor


of Angeles City. A certified true copy of their Marriage Certificate is
herein attached as ANNEX “E”;

10. The petitioner was born on December 5, 1989. Thus, at the time of their
marriage, the petitioner was only seventeen (17) years old. Attached
herein, as ANNEX “F”, is the petitioner’s Certificate of Live Birth;

11. The first few years of their marriage life were full of happiness. The
respondent would come home every two years. They are blessed with a
five-year old son, who was born on December 25, 2014. Attached
herein is the child's Certificate of Live Birth as ANNEX “G”;

12. However, sometime in 2016, their relationship started to turn sour when
the respondent came back from Saudi Arabia for good as he was
terminated from work;

13. The respondent could not find a high-salaried work in the Philippines
and chose to become a lazy drunkard. He would become violent when
drunk, and start hitting and destroying any appliance or furniture for no
reason. The petitioner tried to understand her husband, thinking that he
might be suffering from depression ever since he got fired from work.
The respondent has been unemployed since 2016;

14. The petitioner has become the sole provider of their small family. Her
parents would often reprimand her, but she would insist that she loved
the respondent and believed that he would change his ways;

15. An incident in February 2020 made the petitioner realize that she could
no longer tolerate her husband. The respondent, who was intoxicated at
that time, slapped their child so hard that the child fell from the chair
and suffered a broken hand. When she asked him why he did it, he
responded that the child was watching the television too loud. He did
not bother to check on their child and just proceeded to take his nap;

16. The petitioner rushed their child to the hospital and has not returned to
their home ever since the incident. Attached herein as ANNEX “H”
and “I” are the Medical Certificate and Report issued by AUF Hospital
on February 3, 2020;

17. The petitioner, along with her son, took refuge in her parents’ house,
where they are currently staying in.

PRAYER

WHEREFORE, WITH ALL THE FOREGOING, it is respectfully


prayed unto this Honorable Court that judgment be rendered declaring that:

1. The marriage between the petitioner and respondent as VOID


AB INITIO by reason of absence of legal capacity to marry
due to minority of the petitioner under Article 35 (1) of the
Family Code;

2. The sole parental custody of their only son, who is below


seven (7) years old, shall be given to the petitioner, pursuant to
Article 213 of the Family Code; and

3. The property relations between the petitioner and the


respondent shall be governed by Article 148 under the Family
Code.

Other reliefs just and equitable under the circumstances are likewise
prayed for.

VERIFICATION AND CERTIFICATION

I, IVANA ALAWI-GO, of Legal age, Filipino Citizen and a resident


of 123 Salingpusa Street, Balibago, Angeles City, after being sworn
according to law, hereby depose and state that;

1. I am the petitioner in the above-stated case;

2. I caused the preparation of the foregoing petition;

3. I have read the contents thereof and the facts stated therein are
true and correct of my personal knowledge and/or on the basis of
copies of documents and records in my possession;

4. I have not commenced any other action or proceeding involving


the same issues in the Supreme Court, the Court of Appeals, or
any other tribunal or agency;

5. To the best of my knowledge and belief, no such action or


proceeding is pending in the Supreme Court, the Court of
Appeals, or any other tribunal or agency;

6. If I should thereafter learn that a similar action or proceeding has


been filed or is pending before the Supreme Court, the Court of
Appeals, or any other tribunal or agency, I undertake to report
that fact within five (5) days therefrom to this Honorable Court.
