MBA proposals post confinement

Cases scheduled during Curfew


To set up a formal mode of communication with the Registry of each court for barristers to
enquire on the dates of postponed cases. The public to liaise with attorneys in civil cases and
police in criminal cases of the postponed dates of those cases which were scheduled during
the confinement.
Second Term
To displace all cases currently scheduled for Hearing/Trial for the Second Term (04 May-31
July).
To use the Second Term to ensure a safe system of work is set up (in terms of sanitary levels,
toilet facilities).
During the Second Term, to dedicate full days for contravention cases with morning and
afternoon sessions during the second term.
The Court to retain discretion to give priority for the hearing of long-outstanding cases under
the proviso that no more than one case should be scheduled for hearing per day.
Resumption of court
The Judiciary to ensure that it is satisfied that adequate sanitary measures are in place to ensure
the health and safety of all court users prior to court resuming. The Judiciary may consider
moving the Term dates.
Allotment of time slots for each case after consultation with counsel.
Hearing to proceed by videoconference as a norm, where practical.
La Mise en Etat
La mise en état to proceed electronically, through an email exchange of documents and
particulars, based on a timetable to be set by the Court, whilst dispensing parties from attending
court.

Chambers cases
Requirement for written submissions to be filed one (1) week prior to the scheduled date of
hearing in all Chambers cases. The Judge in Chambers will still retain the discretion of
requiring oral submissions and/or when such motion is made by counsel, which will proceed
by videoconference.
Deadlines and Delays
To enact legislation for the period of confinement to be discarded from any computation of
time in respect of delays.
Physical Appearance in Commercial Court / Disposal cases
All cases scheduled for Physical Appearance and/or Disposal to proceed by videoconference.
General communication with courts
Each court registry to be provided provided with a secure and formal email address which will
henceforth be used for queries to the registry and the filing of pre-trial documents.
Sanitary measures in all courts
Disinfection of all courtrooms prior to resumption of court and continuous cleaning and
disinfection.
Provisions to provide hand sanitisers in court, to operate lifts via a liftman, to ensure fully
operational and regularly cleaned toilet facilities, to affix notices on hygienic practices in every
courtroom, to enable the court to allow and/require the wearing of face masks where it deems
fit.
To control access in courts based on the supermarket model and to exceptionally limit access
to persons whose presence is required.
