Religious Expression Case Analysis and Rationale Template
Part 1: Case Analysis

1. Brief summary of the case:


Rancho elementary school is located in Carterville school district. The student’s
population reside in Littletown and the surrounding areas of Carterville. The school
district adopted the zero tolerance policy fir all the schools that fell in their district. The
zero tolerance policy included zero tolerance for truancies from school for weapons of
any kind, for physical assaults, and for sexual harassment. Ms. Idleman was placed in
charge of creating the school plan as well as including the zero tolerance policy with it
when finished it was approved by assistant principal Ms. Boxer. A few days after the plan
and policy was sent home a student named Becky in Ms. Idlemans class brought a gun to
school to show that class as part of her project she had completed for class. After the
student had brought the gun out Ms. Idleman told the student to place the gun back in to
the brown bag she had brought it in and she took it from her. Ms. Idleman then gave the
gun back to the Becky at the end of the day and told her to return it to her father. The day
after the incident a parent called onto complain and express concerns as well demands
that something be done before she did something about it.
2. Identify the issues to be resolved:
Student brought gun to school
Teacher returned the gun back to the student at the end of the day
The teacher did not report the incident to the office
A parent called to complain
Principal found out about the incident through the parent calling to complain.

4. One or two existing laws or court rulings that relate to the issues:
Ohio State Law states:
(A) No person shall knowingly convey, or attempt to convey, a deadly weapon or
dangerous ordnance into a school safety zone.

(B) No person shall knowingly possess a deadly weapon or dangerous ordnance in a


school safety zone [ CITATION Ill \l 1033 ].

5. District policies that relate to the issues:


Marion City Schools in Ohio states in their student hand book:
*Possession/Use of Weapons and/or Dangerous Instruments/Objects-Marion City
Schools establishes a safe, respectful, and caring environment and students should
support and maintain this environment. A student shall not possess, handle, transmit or
conceal any weapon or instrument capable of harming another person, such as guns,
knives, ice picks, switchblades, brass knuckles, etc. Included in the prohibitions would be
the use of chemicals and gases, look alike items, explosives, incendiary devices,
fireworks, smoke bombs, etc. Included would be the plans and/or instructions on how to
build or use such items, or making plans to target specific students, teachers, or other
school staff. (ex: Making a hit list). In addition, the use of any object that is used to
threaten, harm, or harass another may be considered a weapon.
*Knowledge of Dangerous Weapons or Threats of Violence-Students, staff members, and
visitors are entitled to function in a safe school environment. Therefore, students are
required to report knowledge of dangerous weapons or threats of violence to a teacher,
counselor, and/or building administrator. Examples of this may include making verbal
threats, written threats, and/or making threatening gestures or making indirect threats
through others [ CITATION 201 \l 1033 ].

6. Possible solutions to the issues:


Suspend student
Suspend/terminate Ms. Idleman
Contact Parents of all students – explain situation/plane
Hold parent meeting
Hold School Assembly
Have councilors available to talk to students if needed

7. The solution you choose to resolve the issues:
Suspend student
Suspend/terminate Ms. Idelman
Send memo to parents parent’s regarding what has happened as well as the steps that is
being taken.
Have councilors available for students if needed

8. Action steps (2-5) for implementing your solution, including a timeline for each step:
Contact school board
Contact Becky’s parents
Contact local law enforcement
Escort Becky to office

9. Potential moral and legal consequences of the solution:


There are many things that can come of this situation both morally and legally. Some of
the legal ramifications could be Becky could be brought up on criminal charges, Becky’s
parents could be brought up on criminal charges, and the school could possibly be sued
for negligence, Ms. Idleman could be sued as well as lose her teaching license. Some
moral consequences that could come of this situation is that the Schools reputation would
be destroyed, the community’s reputation could be tarnished and my reputation as a
responsible and knowledgeable principle could be dissolved.

Part 2: Rationale

As the principal of Rancho elementary school which is located in Carterville school

district. Let me first say that it is my number one priority based upon the PSEL standard 5 to

keep my students and staff in a safe and welcoming environment [ CITATION Pro \l 1033 ].

The solutions I will be using to solve the issues that have risen at our school over the few days

will be; placing Becky Skutter on suspension pending expulsion, placing Ms. Idleman on

suspension pending termination, having a school assembly, and sending memos to school

families. I will also mandate councilors to be present on the school’s campus in case a student

will need someone to talk to.

Rancho elementary school student population is made up of students from areas outside

of Carterville, the school district is made up of various ethnic groups from diverse

socioeconomic backgrounds. The residents of Littletown enroll their children into Rancho

Elementary because it is known to be the best elementary school in the district.

At Rancho Elementary we hold a strong zero tolerance for truancies from school, for

weapons of any kind, for physical assaults, and for sexual harassment and as part of this zero

tolerance policy the district’s superintendent advised all the site administrators in the district

must include the zero-tolerance policy in their respective school plans. This plan and policy has

been set in place to protect the mission and safeguard against the schools and student’s values of

democracy, equity, and diversity. Rancho is a school that is all of these things.

The steps that are being taken to resolve the issues that have risen are after hearing the

parent out on their concerns on the situation I will immediately escort Becky to the office. I will

then contact the superintendent to inform him/her and the school board of what exactly we are

facing, I will then be contacting Becky’s parents and having them immediately come to the

school, at this time I will also be calling the local law enforcement agency. I will then excort Ms.

Idleman to the office where I will ask her to explain to me what happened in the day that Becky

presented her report to the class. I will place Ms. Idleman on suspension pending termination as

she awaits her ethics hearing with the schoolboard.

When Becky’s parents and law enforcement arrive at the school I will explain to them

what has taken place I will place Becky under suspension pending expulsion. I will then let the

authorities take charge and complete their investigation. After this to ensure that I am Promoting

social justice and ensure that individual student needs inform all aspects of schooling I will be

holding a school assembly for all students, where we will talk about the policy, share what is

expected of and for our students when it comes to their safety, wellbeing, and education. I will

also let them know that there will be councilors available to them if they need to speak with

anyone about what has taken place. I will then send memos home to parents letting them know

what has happened at the school and what actions the school is doing to deal with this situation

as well as any future incidents I will express to them that they are welcome to call me with any

concerns, I will apologies, and ensure to them that I am doing what it take s to keep our school a

safe place for our children, doing this will promote collaboration, trust, learning, and high

expectations. In this memo I will also let the parents know about the councilors on campus that

will be present for the students to talk to if they need it. By taking these actions even though they

are not being done as soon as the incident happened I believe as a school we are still promoting

and protecting the school’s vision and mission and safeguard the values of democracy, equity,

and diversity, social justice and ensure that individual student needs inform all aspects of

schooling, and Promote collaboration, trust, learning, and high expectations.
