Warranty and Liability Limitation
• DynaWinch Industries LId. (the "Seller") warrants to the firsl user (the "Buyer"), tha! the new equipment, parts 01
lIs own manufacture ar service (lhe "Product") are subject to the following qualifications:
1. The seller warranls the produet when shipped is
new, 01 good quality and free !rom defects in
material and workmanship for a periad 01 twel\le
(12) months from the date the product is received
by the buyer.
2. No warranty is made ar implied with respect lo
equipment supplied lo the seller by other
manufacturers, nor shall any warranty be made or
implied with respect lo equipment not
manufaclured by the seller. The seller's only
obligation shall be lo assign to the buyer al Ihe time
01 sale whatever warranly the seller has received
Irom olher manufaclurers regarding Iheir
equipment.
3. AII claims for defective product under warranly
musl be submined in wriling immediately upon
discovery within twelve (12) months from the date
• the producl is received by the buyer. For a
warranly claim to be valid, Ihe product must have
been exposed only to normal use and service,
have been reasonably mainlained and kepl
lubricaled, have been otherwise used in
accordance with the seller's inslruclions and have
not been subjecl lo misuse, negligence or
accident.

4. 1Ishatl remaín the selter's aplion upon receipt 01 a
warranty elaim to:
a. repair ar replace the product al a place 01 the
seller's choosíng, or
b. refund an equitable portion 01the purchase price
taking into account the lair wear and tear lo the
product arising from normal use and service.
5. Defective product must be held for Ihe seller's
inspection andlor be returned, al the buyer's sole
expense and upon the saller's requesl, lo the
seller's manufacturing facility or place 01 the
seller's choosing.
6. The seller shall nol be responsible for repairs or
alleralions made to the product except those
performed by an authorized representative 01 the
seller.
7. Any liability for indirect, consequential or incidental
damages is expressly disclaimed by the seller. The
seller's liability in all events for any damages,
losses and causes of action (whether in contract,
lort, negligence or otherwise) shall be limiled in the
aggregate to, and shall nol exceed, the purchase
price paid lor the product.
