Wellness Participation Waiver

In order to sign up to the Event you must agree to this Waiver set out below and by participating in the
Event, you agree that such participation shall be subject to this Waiver​.

WAIVER TERMS AND CONDITIONS

1. For the purposes of this Waiver, references to “we,” “our” “us” or “WeWork” shall be to the WeWork
entity allowing the Event to be hosted in the WeWork premises. References to “you,” “your” and similar words in this
Waiver are to the individual registering for the Event and agreeing to be bound by the terms of this Waiver. You
hereby represent and warrant that you have all necessary right, authority and consent to enter into the terms of this
Waiver.

2. You agree to comply with any event rules enforced by us from time to time which are
communicated to you or displayed in the Location. The event rules may relate to our opening hours, use of our
facilities and your conduct.

3. We reserve the right to refuse you access to the Event and suspend, refuse, or terminate your
future attendance to any Event if: (1) we reasonably consider that your conduct is (a) damaging to our reputation, (b)
is in breach of this Waiver, or (c) such refusal would otherwise be in the interests of other attendees of the Event or
users of the Location; (2) you do not attend an Event that was booked by you (including any class that was allocated
via the waitlist) on three (3) separate occurrences; or (3) you do not sign into the Event in accordance with the Event
Operator’s protocols.

4. WeWork reserves at all times the right to cancel the Event, at any time and with or without cause.
WeWork shall not be responsible or liable for any damages or liability as a result of the cancellation of the Event.

5. We are not medically qualified so if you have any doubts about your fitness or capability to partake
in the Event, we strongly recommend that you get advice from your doctor first. For safety reasons, you are
responsible for correctly using our facilities.

6. You hereby certify that you are physically fit for participation in the Event and/or the activities
specified above or other activities conducted in conjunction therewith and you have not been advised otherwise.

7. In the event of an emergency or non-emergency situation requiring medical treatment, you agree
and hereby grant permission for any and all medical attention to be administered to you, in the event of an accidental
injury or illness. This permission includes, but is not limited to, the administration of first aid and the use of an
ambulance. If you have any medical condition that should be known of in connection with his or her participation in
the Event, this information must be provided to the Event Operator.

8. WeWork shall not be responsible for any loss, theft or damage to your personal property while you
are present in the Location or using any lockers and/or showers provided at the Location, unless caused by the gross
negligence of willful misconduct of WeWork. You assume all risk of loss for any of your personal belongings.
9. In participating in the Event and using the facilities at the Location, you agree to release and
discharge WeWork, its directors, employees, volunteers and supervisors, from any injuries sustained by you as a
result of participation in this Event. You further agree to indemnify and hold harmless, WeWork, any of its employees,
volunteers and supervisors, facilities and owners of WeWork against any liability incurred as a result of such injury or
loss.

10. You agree to indemnify, hold harmless and defend WeWork and its subsidiaries and affiliates, and
each of its and their past, present, and future principals, members, assignees, managers, directors, officers, agents,
employees, successors, and assigns, for and from, and against any and all claims, actions, proceedings, damages,
liabilities, and expenses of every kind, whether known or unknown (including reasonable attorney’s fees), resulting
from or arising out of all fines, suits, proceedings, claims, demands and actions of any kind or nature whatsoever
brought by anyone (including you) whomsoever arising or growing out of or in any other connection with (1) the use of
the location at which the Event is hosted by you, (2) any accident, injury, or damage to any person or property
occurring in the location at which the Event is hosted or any part thereof, (3) any failure on your part to perform or
comply with any of the agreements, terms or conditions contained in this Waiver on its part to be performed, and (4)
any act by you in connection with the Event that infringes or misappropriates on a patent, trademark, service mark,
copyright, trade secret or other proprietary right of another party, including WeWork. If any such claim, action or
proceeding is brought against us, our subsidiaries/affiliates, or any of our past, present and future principals,
members, assignees, agents, successors, or assigns, you will, upon written notice from WeWork, at your expense,
resist or defend such action or proceedings by counsel reasonably approved by WeWork in writing.

11. WeWork’s liability, including but not limited to a failure of WeWork to meet its obligations
hereunder, shall not exceed the amounts paid by you to WeWork in connection with the Event (if any).

12. You shall be responsible for all repairs, whether structural or non-structural, ordinary or
extraordinary, and of any other nature or kind whatsoever if, during the Event you cause any damage or change to
location where the Event is hosted. The remedies set forth in this subsection shall be in addition to any other
remedies set forth in this Waiver or at law or equity.

13. If you take photographs or videos of the Event, such photographs or videos must only capture the
Event and its attendees. Under no circumstances shall you take photographs or videos of any other individuals or
locations in the building where the Event is being hosted. If you take photographs or videos of the Event, you shall
grant WeWork a nonexclusive, worldwide and perpetual license to such photographs or videos. Nothing in this
Agreement shall grant you to take photographs or videos of the Event, the right to use photographs or videos of the
Event, the location or the building where the Event is being hosted.

14. You hereby consent to allow WeWork the use of your name, voice, image, likeness, and any and
all attributes of your personality, in, on or in connection with any film, audio tape, video tape, audio-visual work,
photograph, illustration, animation, or broadcast, in any media or embodiment, now known or unknown, including,
without limitation, all formats of computer readable media, produced by or for the benefit of WeWork in connection
with the Event. You further consent to the use of your name, voice, image, likeness, and any and all attributes of your
personality in any advertising or promotional material created or used in connection with the Event. You hereby
confirm that you have read, understand and agree to the terms set out in the foregoing, and understand that you may
withdraw your consent providing therein to the processing of any materials containing your likeness, and that if you
do so, we shall no longer use such materials in the future, but that such materials may continue to appear in
circulation over which we no longer have control, including any materials of the Event Operator for which we shall not
be held responsible or liable.
15. This Waiver is binding upon you, your heirs, executors, legal representatives, successors and
assigns. The provisions of this Waiver will continue in full force and effect even after the termination of the Event,
whether by agreement, by operation of law, or otherwise.

16. If any term or provision of this Waiver is invalid, illegal or unenforceable in any jurisdiction, that
invalidity, illegality or unenforceability will not affect any other term or provision of this Waiver or invalidate or render
unenforceable that term or provision in any other jurisdiction. All matters arising out of or relating to this Waiver are to
be governed by and construed in accordance with the laws of England & Wales. Any claim or cause of action arising
under this Waiver must be brought only in courts located in London, United Kingdom, and the parties hereby consent
to the exclusive jurisdiction of those courts.

17. By attending the Event, you hereby certify that: (1) you have fully and completely read and
understand the foregoing assumption of risk, and release of liability; (2) you are 18 years of age or older; (3) you
understand that by attending the Event it obligates you to indemnify the parties named for any liability for injury or
death of any person and damage to property caused by your negligent or intentional act or omission; (4) you have the
legal right and authority to consent to, and by attending the Event, you do consent to the terms and conditions of this
Waiver and hereby consent and agree to us or our affiliates capturing materials which may contain the your likeness
and the processing of your personal data in accordance with this Waiver and our privacy policy which can be found
online at ​https://www.wework.com/en-GB/legal/privacy​. You understand that by agreeing to these terms you are
waiving valuable legal rights and you have agreed to this document as your own free act and deed.
