1am an investigative or1aw enforcementofficeroftheUnited States,and havebeen so

employed forapproximately nineyears.1am mssigned to theRichm ond Division,Bristol

ResidentAgency.During mytenureasan FB1SA,lhavehad investigative assignments

related to violentcrimes,gangs,bank fraud,wirefraud,mailfraud,and domestic and

internationalterrorism .

2. Thisaffidavitismade in supportofan application foran arrestwarrantin connection withthe

violationofTitle 18,UnitedStatesCode,Section401(3)(ContemptofCourt),wherethe
defendantknowingly disobeyed an orderfrom the United StatesBankruptcy Coul'
tto appear

andtestify atahearing on September5,2019.

3. The infonnation contained inthisaftidavitisbased on my personalobservations,

observationsofother1aw enforcementoftk ers,observationsofcooperating sourcesasrelated

to law enforcement,m yreview ofofficialpoliceand governm entreports,and consultation

with otherAgentsinvolved in theinvestigation.

During apre-trialconferenceon January 8,2019,Attorney Jolm Lamieprovided to the coul'

information given to him by hisclient,RussellGeyer.Theinformation providedto the court

statedthefollowing:

a. M r.Geyerhad goneto theM ayo Clinic inFloridaforprostatesurgery,complications

developed,andcancerspreadtohisbones.M r.Geyerintendedto stoptreatm entand

return home.

On M ay 16,2019,information pfovided from RussellGeyertoLam iecausedLam ieto tile a

motion with the courtto continuethetrialsetagainstRussellGeyer,whereDeere &

Company wererequestingajudgementforthereturnofcollateralfrom theRussellGeyer.ln

the motion Lnm ieassertedthefollowing:

RussellGeyerwasin hospice carein Floridaafterthe cancurtreatmenthad failed.

Patricia Geyerwasalso inFloridatobewith herhusband whileunderhospice care.

Patricia Geyersuffered cardiacissueswhilethere and recently underwentbypmss

surgery,andbecause ofthebypasssurgery,PatriciaGeyerwasnotreleasçd to drive

hervehicle back to Virginia.

6. On September4,2019,a subpoenawmsissued from theUnited StatesBankruptcy Courtin

theW estern DistrictofVirginia,which commanded theappearanceofRussellGeyerata

hearing on September5,2019.Attonzey John Lam ieinstructedprocessserverKenneth Price

to serve the subpoenaon RussellGeyer.

Duringtheafternoon ofSeptember4,2019,Pricedid serveRussellGeyerwith thesubpoena.

AfterPrice arrived atthe residencelocated at487 StillHouseHollow Road,Saltville,

Virginia,heobserved awhitetruck,butno one washome.Justpriorto leaving,Price

observed asmallvehicleanive.A maleexitedthevehicle and identified themselvesas

RussellGeyer.PriceservedRussellGeyerwiththesubpoena(ATTACHMENT A).
8. On September5,2019,SA Childerswaspresentin the United StatesBankruptcy Courtroom,

and observedthatRussellGeyerhad notappeared to testify asdirected in thesubpoena.

On September5,2019,PatriciaSmith Geyerwasinterviewed,and stated thatRussellGeyer

waslocated attheirpersonalresidence,487 StillHouseHollow Road,Saltville,Virginia,

priorto herleavingforthe 10:30nm courthearing.RussellGeyersaidhewould beleaving for

courtin afew m inutes,and instructedPatriciaGeyerto tellthe truth ifshewascalled to

testify.PatriciaGeyerstatedthatRussellGeyerdid nothavecancer,andthatshehad not

travelled to Floridaanytime inthelastyear.

10.On September13,2019,PatriciaSmith Geyerwasinterviewed,and provided inform ation that

shewaspresenton September4,2019 when RussellGeyerexited theirvehicleand took

possession ofpaperwork from an individualdriving ablacktruck.RussellGeyersaid the

documentswererelated to theircourthearing.

11,PatriciaGeyerhasneverbeen admittedto amentalhealth institution,norhasshe had bypass

surgery on herheart.

12.A coupleofdayspriortotheSeptember5,2019 courthearing wasthefirsttim ethatPatricia

Geyerhad spoken to Attorney John Lamie.Lamielef'

tamessageforheratherplaceofwork,

and she returnedhiscall.Duringtheirconversation,Lamieinformed herthathehad been told

thatRussellhad died ofcancer.

13.Since September5,2019,PatriciaGeyerhasreceivedtextmessagesfrom RussellGeyer

statingthathewasadmitledto ahospitallocated in Charlestop W estVirginia,aftertryingto

comm itsuicide.

Conclusion

l4.Based onthe information outlinedabove,theundersir ed submitsthatthere isprobable

causeto believethatin theW estern DistrictofVirginia,thedefendant,hasviolated Title 18,

UnitedStatesCode,Section401(3)(ContemptofCourt),wherethedefendantknowingly
disobeyed an orderfrom theUnited StatesBankruptcy Courtto appearand testify ata hearing

on Septem ber5,2019.
