To begin, Nevada is in the ninth circuit court of appeals. In the Nevada Constitution the

Education clause is found under the 11th article. Throughout the Education article there are ten

sections.

The first section according to the Constitution is, ‘Legislature to encourage education;

appointment, term and duties of superintendent of public instruction.’ In this section, the

constitution states that education should be encouraged more to the people. No matter what topic,

it should be encouraged because it gets the process of learning going. For example, it states

promotion of intellectual, literary, scientific, mining, mechanical, agricultural, and moral

improvements.’ In a way, I see it as career fields, education will guide a person to their desired

career and future choices. As for the ‘appointment, term and duties of superintendent of public

instruction,’ it is making a statement that a superintendent to assign educational positions. The

superintendent is the one who decides who gets hired, how long, and what they will be doing

while in their position.

In the second section, it says, ‘uniform system of common schools.’ In this section, what

comes to mind is the dress code in schools. There are schools that have uniforms and others just

hold a dress code of casual clothing. It mentions that dress code should be held for the six

months while school is in session. The constitution mentions that if a school does not follow the

certain dress code or uniform system that the funding for the public school gets disrupted.

Towards the end of the section, it mentions that having the uniform system will have a secure

effect on students’ attendance.

In this this section, the constitution discusses about school property. It mentions that any

sort of proceeds that will be received from Congress. An amount will be towards educational

purpose. The money will be portioned to how the money will be given to school purposes and

the sort of education of educational purposes to provide to. However, money given to the state’s

university will be added to the beginning sum that is supposedly only towards for educational

purpose. This section of the article focuses where the funds come from and how the funds go

towards educational purpose. It also mentions how there is a use of interest that goes to the

state’s university.

The section of the article, the fourth one, focuses on State University. It mentions how the

legislature to make a university that focuses on careers that deal with agriculture, mechanics, and

mining. Most of these departments are found in trade schools. The legislature also provides

control and manages over these school. Protection for those in the field no matter if enrolled,

employed, or contractor in the school. They also provide protection for other schools that involve

the departments even though it may not be a school focused mainly on them.

The fifth section of this article is overall about schools, grades, teachers, and professors.

The legislature is to establish the schools for all sorts of grades. It will run from kindergarten to

university. The professors in the university and every teacher must comply with the oath under

the fifteenth of the Nevada Constitution. If all is done without fail, they agree with all that is

mentioned in the section. Once it all comes to agreement without failure under oath, they will

begin their course of teaching.

The sixth section of the article focuses on sessions of the legislature on the support of

university and common schools. Before the sessions officially begin, the legislature discusses

the funds that fit the state budget for the next period of two fiscal years. They discuss on all

school grades, so kindergarten through 12. It is overall how the legislature will support the

schools financially with the budget that they have set with appropriate measures. However, if any

money does not seem to go towards supporting schools, it will be in violation of the subsections

discussed in the sixth section.

The seventh section of this article went over election and duties. It seemed like the

governor, secretary of state, and the superintendent of public instruction were instructed for the

first four years and until their successor which would take their place were elected and qualified.

They would qualify for the board of regents which controlled and managed anything to do with

the University and any sort of funds directed towards the school by law. The board of regents by

law had to hold its regular sessions going toward their end of term. At the end of their term they

would place the election for their positions to their successors and what their job would be being

in the board. However, this section of the article was appealed.

The eight section seems to have gone some changes. The original section stated that any

immediate organization and maintenance of the state university. In the section it discusses how

the first funds that are received will be for the mining department in a way that is most effective

and useful for them. As of provided by the proceeds of the public lands donated by the Act of

Congress. 1862 for the college to benefit agriculture, mechanic arts, and including military

tactics will be invested in. The board of regents would have a separate fund to be exclusively for

the benefit of the departments mentioned in the fourth section. If any amount is misused in any

way the state will replace the amount. The change that took place was that the use of proceeds

from public lands donated by Act of Congress for benefit of certain departments. It was not

much it seems like a shortened version of the original.

In the ninth version of the education article, we see that it mentions ‘sectarian instruction

prohibited in common schools and university.’ The section is not quite lengthy as the others. In

short terms, this section mentions that no sectarian instruction should be tolerated in any school

of University that may be established under the Nevada Constitution. From my understanding it

seems that it may not tolerate any form of negative behavior which the reason for rules could be

placed in schools and universities.

The final section in the article reads, ‘No public money to be used for sectarian

purposes.’ It seems as if any sort of public funds either state, county, or municipal should be used

for anything other than school or university. Funds should be used properly to provide the best

for the students who are heading their rightful career paths. It is all set within this article in our

state’s constitution. These sections demonstrate how schools and universities are handled in the

State’s hands.
