AGREEMENT TO SELL

This agreement to sell is made on this 18 th day of April-2008 at Rawalpindi BETWEEN Mst Saadia
Zahid D/o Sheikh Muhammad Yasin, R/o 21-22, Samar Zar Colony, Kalyal Rawalpindi (hereinafter called
the First Part/Vendor)
AND

Ch. Muhammad Idrees S/o Haji Sukhi Muhammad, R/o Khoi Ratta Tehsil and District Kotli ((hereinafter
called the Second Part/Vendee)

Whereas the first party is owner in possession of House measuring 1 kanals 4-1/2 marlas,
being 22/1157 shares, situated at Samar Zar Colony Kalyal Rawalpindi constructed on
khasra No.222 khewat No.73 khatooni No.88-89, vide transfer mutation No.12065, and
register Haqadarn-i-Zamin for the year 2000-01,

AND WHEREAS the first party is complete owner of the said house and has all the rigfhts to transfer the
same. The property is free from all sorts of encumbrances.

AND WHEREAS the first party has decided to sell and the second party has decided to purchase the
above described house for a total consideration of Rs.33,00,000/-.

NOW THIS AGREEMENT WITNESSETH AS UNDER:-

1. That in consideration of Rs.33,00,000/-, the first party hereby agrees to sell and the second
party agrees to purchase the above described house.

2. That the second party has paid a sum of Rs.5,00,000/- in shape of cheque No.___________
dated ___________ for the sum of Rs.2,20,000/- drawn on Habib Bank Ltd Liaqat Road
Branch Rawalpindi and a sum of Rs.2,80,000/- in shape of Car Toyota Corolla No.LHV-4043
Model 1982 alongwith Open Transfer Letter.

3. That the balance consideration of Rs.28,00,000/- shall be paid by the second party to the
first party on or before 30-05-2008.

4. That the first party before the payment of balance consideration shall provide Fresh Fard of
her entitlement to the second party.

5. That the possession of the vacant house shall be delivered by the first party to the second
party on payment of balance consideration and registration of sale deed.

6. That in case the second party fails to pay the balance consideration within the stipulated
period, the agreement shall stand cancelled and the earnest money paid by the second party
shall stand forfeited by the first party.

7. That in case the second party on tendering of the balance consideration fails to get the sale
deed registered and the possession delivered to the second party, the second party shall be
entitled to get this agreement enforced through court of law and in any such eventuality first
party shall be liable for all the expenses incurred by the second party on litigation.

8. That the legal heirs, successors and assigns of the parties shall be bound by the terms and
conditions of this agreement.

9. That both the parties have entered into agreement without any coercion and with their free
consent.

IN WITNESSES WHEREOF THE PARTIES HAVE PUT THEIR HANDS ON THIS AGREEMENT ON
THE DAY, MONTH AND YEAR MENTIONED ABOVE.
