cuarenta de la mañana, en la Sala de Audiencias del Primer Juzgado
Especializado de Trabajo Permanente de Tacna, que despacha el Señor Juez
Supernumerario Carlos Gomez Chipana (en adelante, El señor Juez), con la
intervención del Secretario Judicial Leonardo Ticona Mamani (en Adelante, el
Secretario Judicial), se reunieron a fin de llevar a cabo la audiencia para la
toma de cargo y juramentación del perito contable judicial designado en el
proceso seguido a Huacca Incacutipa Beatriz en contra de la Municipalidad
Provincial de Tacna sobre el pago de beneficios sociales.

Ante Su Señoría, comparece Don Bernardo Hugo Rejas Chambi, de profesión

Contador con domicilio en la Calle Rufino Albarracín 457 – Para Grande,
provincia de Tacna, acreditándose con su D.N.I. número 61874770, a quien Su
Señoría interrogó y recibió juramento en forma legal.

 INTRODUCCION

El Informe Pericial es una estructura formal de presentación de los resultados

periciales, adecuada para su comprensión e interpretación por parte de lectores que

no son especialistas en la materia peritada. Normalmente, pero no de manera

excluyente, se trata de operadores del derecho, en particular funcionarios judiciales.

Para elaborarlos debemos tener presente en ser muy meticulosos y ordenados tanto

en la fase de elaboración del análisis, como en la elaboración del documento.

El presente trabajo de expediente de Peritaje Contable es de mucha importancia por

haberse incrementado el problema que se vienen dando por los despidos arbitrarios.

De allí que el Peritaje contable sea, en opinión de muchos, una forma de poder

resolver un caso siguiendo los correctos parámetros para llegar a una sentencia

justa.

Desde hace varias décadas en nuestro país la Pericia Contable ha sido considerada

como una prueba fundamental, debido a la vital importancia que ha adquirido el

profesional contable que, actuando como perito, ilustra a los magistrados del poder

judicial en los temas que son de su conocimiento siendo de vital importancia para una

adecuada e imparcial administración de justicia

Los elementos de juicio y evidencias contables, constituyen la base fundamental de

un peritaje contable, pues a través de su examen crítico y sistemático, el perito

contador llegará a conclusiones que serán de ayuda, a quien lo solicite, en la

compatibilización y evaluación de evidencias en torno a lo que investiga. Luego, en la

medida que disponga de todos los elementos de juicio relacionados con él, su opinión

tendrá la validez que el caso requiera.

La importancia del peritaje para la solución de muchos pleitos la pone de manifiesto

la circunstancia de que el Juez, si bien es un técnico en derecho, no lo es por lo

general en otras ciencias ni posee conocimiento sobre cuestiones de arte, de

mecánica y en numerosas actividades prácticas que exigen estudios especializados o

amplia experiencia.

Por todo lo anteriormente mencionado, podemos señalar que, el actual Sistema

Judicial necesita profesionales altamente especializados en el área contable, para

asumir el trabajo pericial en los procesos civiles, penales, laborales, procedimiento

privativo arbitral, acusaciones constitucionales y otros.

 ABSTRAC

The Expert Report is a formal structure for presenting the expert results, suitable for

matter. Normally, but not exclusively, they are law operators, in particular judicial

officials. To prepare them we must keep in mind to be very meticulous and orderly

both in the phase of preparing the analysis, and in the preparation of the document.

The present work of the Accounting Expertise file is very important because the

problem that has been occurring due to arbitrary dismissals has increased. Hence,

the Accounting Expertise is, in the opinion of many, a way of resolving a case

following the correct parameters to arrive at a just sentence.

a fundamental test, due to the vital importance that the accounting professional has

acquired that, acting as an expert, illustrates the magistrates of the judiciary in the

matters that are of their knowledge being of vital importance for an adequate and

impartial administration of justice

The elements of judgment and accounting evidence, constitute the fundamental basis

of an accounting expert, because through its critical and systematic examination, the

expert accountant will reach conclusions that will be helpful, to those who request it, in

the compatibility and evaluation of evidence around what he investigates. Then, to the

extent that you have all the elements of judgment related to it, your opinion will be

valid as the case requires.

The importance of the expertise for the solution of many lawsuits is evidenced by the

circumstance that the Judge, although he is a legal technician, is not usually in other
sciences nor does he have knowledge on matters of art, mechanics and numerous

practical activities that require specialized studies or extensive experience.

For all the aforementioned, we can point out that, the current Judicial System needs

highly specialized professionals in the accounting area, to assume the expert work in

the civil, criminal, labor, arbitration exclusive proceedings, constitutional accusations

and others.
 RESUMEN

El trabajo presentado trata sobre una demanda por indemnización laboral en contra de

la Municipalidad Provincial de Tacna por parte del señor Eloy Huacca Contreras que

otorga una carta poder a su hija para que pueda actuar ante cualquier demanda judicial.

Después de haber presentado el caso ante el primer juzgado especializado de trabajo,

el juzgado le da la razón al señor Eloy Huacca Contreras y se procede a dar sentencia,

después de varias apelaciones por ambas partes la municipalidad provincial de Tacna

tendrá que pagarle al señor por indemnización, más no se le pagara por daños morales

entre otros que no fueron sustentados correctamente.

En este perito también podemos observar la demora que existe al momento de cancelar

los montos de dinero, ya que como se menciona es una entidad del estado y no cuenta

con un presupuesto para hacer dichos pagos en un tiempo corto, es por esto que

también en este expediente se puede observar un cronograma de pagos a fin de que

esta sentencia pueda ser cubierta en su totalidad. También observaremos que existen

otros montos por costos de procesos que también tendrá que ser asumida por la

Municipalidad Provincial de Tacna. Por otro lado, tenemos los intereses que se

produjeron desde el año 2014 hasta la actualidad, es por esto que se contrata los

servicios de un perito contable para poder saber a qué monto asciende el interés que

deberá pagar la Municipalidad Provincial de Tacna.
