DANVILLE, AL --(Ammoland.com)- When Hunter Safety System
opened its doors a decade ago, a new category in the sporting goods
industry was born: the safety harness.
The idea behind the company back then was to make everyone’s
treestand hunting experience as safe as possible, and that idea is still the
primary motivation today.
It all began during the 2000 hunting season when Alabama whitetail
hunter John Wydner’s treestand slipped out from underneath him.
Wydner saved his own life by grabbing a tree branch and hanging on for
dear life, while watching his treestand crash to the forest floor, some 25
feet below. Wydner slowly slid down the tree trunk and made his way to
camp, bloodied and shaken.
Back in the warmth of the hunting cabin, Wydner explained his brush
with death to his hunting companions, brother Jerry Wydner and
nephew Jerrod Karr. Soon, John, Jerry and life-long friend, Jim Barta
found themselves surrounded by sketches as they brainstormed the
concept of an easy-to-use and comfortable safety harness. That
collaboration and those designs would very quickly change the course of

the three men’s lives—and later save many thousands more from injury
or death.

In early 2001, Hunter Safety System was born as new safety harness
prototypes were produced and tested. What initially began as an
ambitious effort by two brothers and a close friend, later culminated in a
new era of treestand safety with HSS becoming the industry-leading

Before the introduction of the HSS safety harness, hunters struggled
with hard-to-use fall-restraint products, they simply put a rope around
themselves or, as in the case of John Wydner, they didn’t use anything at

Ohio Supreme Court Sides with Gun Owners & Upholds Ohio’s
Firearms Preemption Law

Ohio --(Ammoland.com)- The Ohio Supreme Court has, in a 5-2
opinion, once again ruled that Ohio’s “preemption” law is valid.
In a case brought by the City of Cleveland against the State of Ohio, the
court held that R.C. 9.68 is valid in all respects, including, but not
limited to, the mandatory attorney fee provision against any city that
attempts to violate a citizen’s right to self-defense.
HB347, the preemption law, became effective in March of 2007. It
replaces a patchwork of varied and confusing local rules with “uniform
laws throughout the state regulating the ownership, possession,
purchase, other acquisition, transport, storage, carrying, sale, or other
transfer of firearms, their components, and their ammunition.”
The legislature recognized that, like motor vehicle laws, it makes sense
for firearms laws to be uniform throughout the state. Because local laws
can only carry misdemeanor penalties, and almost every crime
committed with a gun is a felony under state or federal law, the local laws
were almost never used to charge criminals and instead served to disarm
the crime victims.
Cleveland’s argument against the state law was simple: they felt the state
and federal government had not gone far enough to regulate your self-
defense rights, so the city should still be free to further handcuff
everyone who happens to be inside city limits.
Writing for the majority, Justice Stratton rejected this
argument, stating “A comprehensive enactment need not
regulate every aspect of disputed conduct, nor must it
regulate that conduct in a particularly invasive fashion.”
Ohio Attorney General Richard Cordray hailed this morning’s ruling
from the Ohio Supreme Court, which affirmed the constitutionality of

“This is an important victory for every gun owner in Ohio,”
Cordray said. “Before 2006, Ohioans faced a confusing
patchwork of local ordinances with different restrictions on
gun ownership and possession. The General Assembly
stepped in, enacting a comprehensive set of rights and
responsibilities for every citizen seeking to exercise his or her
Second Amendment liberties. We vigorously defended that
law, and today the Court upheld it.”
Chris Cox, executive director of the NRA Institute for
Legislative Action, said, “Today’s ruling is a victory for law-
abiding Ohioans. This ruling makes clear that preemption is
the law in the Buckeye State and a patchwork of gun laws is
not acceptable. If Cleveland, or any other city, wants to crack
down on violence, city leaders there should focus on
prosecuting criminals, not enacting new gun laws that only
serve to restrict law-abiding citizens.”
It is particularly noteworthy, and refreshing, that Justice Lanzinger, who
voted against preemption in the Clyde case, acknowledged the legal
concept of stare decisis that admonishes judges to respect prior
decisions, and voted to respect the prior decision where she was in the
dissent. The same cannot be said of Justice Pfeifer, who once again was
in a dissent that had no basis in law or fact. The other dissenting vote
came from Chief Justice Eric Brown, an appointee of Gov. Ted Strickland
who failed in November to win election to a full term.
This ruling also means that Buckeye Firearms Foundation’s suit against
Cleveland will be reactivated, and we expect immediate action on the
injunction requests previously filed with the trial court. The suit seeks a
temporary restraining order and permanent injunction to stop the City of
Cleveland from prosecuting law-abiding gun owners under local
ordinances that restrict gun ownership and concealed carry.
The lawsuit also asks the Court to declare 20 different local ordinances
unconstitutional on the grounds of state preemption of firearm laws.
In Cleveland, gun ordinances have been used for political or
philosophical reasons and had the effect of harassing law-abiding
citizens.

“My right to self-defense, just like my right to attend church
or write an op-ed in the local newspaper or be protected from
illegal search and seizure, is the same in Delaware County as
it is in Columbus or Cleveland,” said Ken Hanson, legislative
chair of the Buckeye Firearms Association.

The Ohio Supreme Court has upheld a 2006 law that allows
the state, rather than cities, to determine firearm restrictions.

A key issue in discussing home rule is whether local
ordinances conflict with general laws, he wrote, noting he
doesn’t believe Cleveland’s ordinances conflict with the law
“because they do not permit something that the statute
forbids or vice versa.”

Dispatch.
In addition to other state media coverage, this important ruling has also
been covered in national media, including Reuters, AmmoLand Shooting
Sports News, UPI, The Wall Street Journal, and The New York Times.
Of particular note in the NYT coverage are the dire predictions by Robert
J. Triozzi, Cleveland’s law director, who led the city’s lawsuit, who said
that “gun owners would now be able to walk through a public square
with rifles, handguns and assault weapons, and that safety rules for
possession of guns near children would also be removed, endangering
residents.”
Not to be left out, Cleveland Mayor Frank Jackson told The Cleveland
Plain Dealer he believes the ruling will put urban populations like
Cleveland’s at greater risk for gun violence.
“Even though we’ve made progress in Cleveland, gun violence
is a very real threat that we face, particularly our young
people,” Jackson said in a statement. “Our inability to enforce
laws that are right for our city flies in the face of home rule
and takes power away the people at the local level.”
Mayor Jackson has been crying about an Ohio law rendering Cleveland’s
so-called assault weapons ban unenforceable since before it passed in
late 2006 (HB347). He complains that he can no longer prosecute people

for all those crimes, and that the loss of that tool has directly resulted in
Cleveland’s increasing violent crime problem. He even stages press
conferences behind a table of scary looking guns, implying that they had
been confiscated through the now-defunct ban. For that to be true, there
must be a significant drop in convictions related to those offenses. We
have the proof – there is not.
In fact, as of the date of our investigation, not only has the city of
Cleveland has not convicted a single person under their so-called assault
weapons ban in the mayor’s entire tenure; they have never even taken
one case to trial!

Hal Shaffer began his life of adventure at an early age; he took his first
buck at 13 in the southernwoods of North Carolina. Hal began his career
in NASCAR, working in the pits changing tires for well-known drivers;
this led him to begin his own racing career.
In 1997, Hal came back to the outdoor industry and started the very
popular radio show, Carolina Outdoors. This show grew rapidly within
five years that it led Hal to television. In 2003, Hal created Carolina
Outdoors TV. Five years later, Hal and good friend Zip took Carolina
Outdoors TV to the next level and birthed Drop Zone TV, a show
dedicated to making their viewers their number one priority.
Byron Ferguson became infatuated with the bow and arrow at the ripe
age of twelve. When he began shooting, he did not worry about hitting
the paper target on a bale of hay; he could not even hit the hay!
Today, he can shoot an arrow through a diamond ring, as seen on the
television show, Super People (Tokyo). Byron is most famous for his coin
trick, shooting eight dimes in a row out of the air and he uses no sights or
gadgets when he shoots. Byron has appeared on American Shooter on
TNN, ESPN, ESPN2 and OLN for ten years where his “SHOT OF THE
WEEK” was the most watched portion of the show. In 2003, Byron
formed BYRON FERGUSON PRODUCTIONS, a full service video

Two Texas Men Indicted for U.S. Department of Justice

indicted two Texas men for surreptitiously trying to buy an automatic

Two Texas Men Indicted for Conspiring to Buy Grenade The indictment filed in U.S. District Court charges ADAM EMMANUEL
Launcher LEWIS, 27, and ANTONIO RODRIGUEZ-ARELLANO, 25, with
conspiring to possess a machine gun that was not registered to either
man in the National Firearms Registration and Transfer Record.

The men were attempting to buy an MK-19 fully automatic grenade

launcher from an undercover agent with the federal Bureau of Alcohol,
Tobacco, Firearms and Explosives, according to the indictment.

“The weapon these individuals sought to obtain is powerful

and destructive. It is a dangerous and frightening scenario
that anyone would seek to purchase an automatic grenade
launcher outside the bounds of law,” Vance said. “The ATF is
to be commended for its diligent work that prevented such a
destructive weapon from being bought secretly and
potentially used criminally,” she said.

“Lewis and Rodriguez-Arellano were looking for a low-key

purchase of an illegal grenade launcher, plain and simple,”
Anderson said. “Fortunately, this investigation stopped that
from happening. Firearm trafficking cases like this one
prevent violence, save lives and keep illegal weapons off the
street,” he said.

According to the indictment, LEWIS’ and RODGRIGUEZ-ARELLANO’s

attempts to buy the grenade launcher developed as follows: LEWIS
contacted an ATF confidential informant on Nov. 29 to arrange the
purchase of an unregistered automatic grenade launcher. On Dec. 3,
both LEWIS and RODGRIGUEZ-ARELLANO traveled from Texas to
Cullman in an attempt to buy the weapon. In subsequent phone calls
from Dec. 3 to Dec. 15, LEWIS and RODRIGUEZ-ARELLANO negotiated
the payment and logistics for buying the grenade launcher with an

undercover ATF agent.

On Dec. 15, RODRIGUEZ-ARELLANO traveled from Texas to Leeds,

where he paid the undercover agent about $24,000 for the MK-19
automatic grenade launcher, according to the indictment.

RODRIGUEZ-ARELLANO and LEWIS both were arrested Dec. 15.

RODRIGUEZ-ARELLANO was arrested in Leeds and LEWIS was
arrested in Texas. The men could face a maximum penalty of five years
in prison and a $250,000 fine.

The ATF investigated the case with assistance from the Cullman County
Sheriff’s Department Narcotics Enforcement Team. Assistant U.S.
Attorney Enid Dean Athanas is prosecuting the case.

Animal Rights Group Threatens Biological Diversity (CBD) filed a notice of intent to sue the U.S. Fish and
Wildlife Service (FWS) if the Service does not create a new nationwide

Animal Rights Group Threatens To Sue FWS If Wolves are Not

populations bolstered in “at least seven interconnected regions”
throughout the continental U.S. This would include: “1) the Pacific
Northwest, including the Olympic and Cascade Mountains, 2) the Great
Basin, including portions of California, Nevada, and Utah, 3) the
southern Rocky Mountains, 4) the northern Rocky Mountains, 5) the
Great Plains, 6) the Midwest, and 7) New England.” Basically all of the
USA.

Licensed Gunsmiths Under Certain Conditions

WASHINGTON, DC --(Ammoland.com)- Any person licensed as a
dealer-gunsmith who repairs, modifies, embellishes, refurbishes, or
installs parts in or on firearms (frames, receivers, or otherwise) for, or on

behalf of a licensed importer or licensed manufacturer, is not required to
be licensed as a manufacturer under the Gun Control Act.
Provided the firearms for which such services are rendered are: (1) not
owned, in whole or in part, by the dealer-gunsmith; (2) returned by the
dealer-gunsmith to the importer or manufacturer upon completion of
the manufacturing processes, and not sold or distributed to any person
outside the manufacturing process; and (3) already properly
identified/marked by the importer or manufacturer in accordance with
Federal law and regulations.
ATF Rul. 2010-10
The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has
received inquiries from firearms industry members asking whether
licensed dealer-gunsmiths who would be engaged in the business of
repairing, modifying, embellishing, refurbishing, or installing parts in or
on firearms for, or on behalf of a licensed importer or manufacturer are
required to be licensed as manufacturers and abide by the requirements
imposed on manufacturers.
In recent years, licensed firearms importers and manufacturers have
contracted certain firearms manufacturing activities on their behalf to
specialized licensed firearms manufacturers. Such activities include
applying special coatings and treatments to firearms (e.g., bluing,
anodizing, powder-coating, plating, polishing, heat/chemical treating).
This has caused confusion over which importers and manufacturers are
required to identify/
mark firearms and maintain permanent records of importation or
manufacture. For this reason, licensed importers and manufacturers
have asked whether licensed dealer-gunsmiths, who are not required to
mark firearms and keep production records, may engage in such
manufacturing activities on their behalf.
The Gun Control Act of 1968 (GCA), Title 18, United States Code
(U.S.C.), section 923(a), provides, in part, that no person shall engage in
the business of importing, manufacturing, or dealing in firearms until he
has filed an application with and received a license to do so from the
Attorney General. A “firearm” is defined by 18 U.S.C. 921(a)(3) to include
any weapon (including a starter gun) which will or is designed to or may
readily be converted to expel a projectile by the action of an explosive,
and the frame or receiver of any such weapon. The term “manufacturer”
is defined by 18 U.S.C. 921(a)(10) as any person engaged in the business
of manufacturing firearms or ammunition for purposes of sale or
distribution. As applied to a manufacturer of firearms, the term “engaged
in the business” is defined by 18 U.S.C. 921(a)(21)(A) and 27 CFR 478.11,
as a “person who devotes time, attention, and labor to manufacturing
firearms as a regular course of trade or business with the principal
objective of livelihood and profit through the sale or distribution of the
firearms manufactured.” The term “dealer” is defined by 18 U.S.C.
921(a)(11)(B) and 27 CFR 478.11 to include “any person engaged in the
business of repairing firearms or of making or fitting special barrels,
stocks, or trigger mechanisms to firearms …” (i.e., a gunsmith). As
applied to a gunsmith, the term “engaged in the business” is defined by
18 U.S.C. 921(a)(21)(D) and 27 CFR 478.11 as a “person who devotes

time, attention, and labor to engaging in such activity as a regular course
of trade or business with the principal objective of livelihood and profit
…”
In Revenue Ruling 55-342 (C.B. 1955-1, 562), ATF’s predecessor agency
interpreted the meaning of the terms “manufacturer” and “dealer” for
the purpose of firearms licensing under the Federal Firearms Act, the
precursor statute to the GCA. It was determined that a licensed dealer
could assemble firearms from component parts on an individual basis,
but could not engage in the business of assembling firearms from
component parts in quantity lots for purposes of sale or distribution
without a manufacturer’s license. Since then, ATF has similarly and
consistently interpreted the term “manufacturer” under the GCA to
mean any person who engages in the business of making firearms, by
casting, assembly, alteration, or otherwise, for the purpose of sale or
distribution. Such persons must have a manufacturer’s license under the
GCA, maintain permanent records of manufacture, and submit annual
manufacturing reports. The Revenue Ruling did not address whether
dealer-gunsmiths who engage in the business of repairing, modifying,
embellishing, refurbishing, or installing parts in or on firearms for, or on
behalf of an importer or manufacturer are engaged in the business of
manufacturing firearms requiring a manufacturer’s license.
Manufacturing
ATF’s long-standing position is that any activities that result in the
making of firearms for sale or distribution, to include installing parts in
or on firearm frames and receivers, and processes that primarily enhance
a firearm’s durability, constitute firearms manufacturing that may
require a manufacturer’s license. In contrast, some activities are not
firearms manufacturing processes, and do not require a manufacturer’s
license. For example, ATF Ruling 2009-1 (approved January 12, 2009)
explained that performing a cosmetic process or activity, such as
camouflaging or engraving, that primarily adds to or changes the
appearance or decoration of a firearm is not manufacturing. Likewise,
ATF Ruling 2009-2 (approved January 12, 2009) stated that installing
“drop-in” replacement parts in or on existing, fully assembled firearms
does not result in any alteration to the original firearms. Persons
engaged in the business of these activities that do not constitute firearms
manufacturing need only obtain a dealer’s license.
Although installing parts in or on firearms, and applying special coatings
and treatments to firearms are manufacturing activities, the definition of
“manufacturer” in 18 U.S.C. 921(a)(10) and 27 CFR 478.11 also requires
that a person be “engaged in the business” before the manufacturer’s
license requirement of section 923(a) applies. Thus, a person who
manufactures a firearm will require a manufacturer’s license if he/she
devotes time, attention, and labor to such manufacture as a regular
course of trade or business with the principal objective of livelihood and
profit through the sale or distribution of the firearms manufactured. If
the person is performing such services only for a customer on firearms
provided by that customer, and is not selling or distributing the firearms
manufactured, the person would be a “dealer” as defined by 18 U.S.C.
921(a)(11)(B) and 27 CFR 478.11, requiring a dealer’s license, assuming
the person is “engaged in the business” as defined in 18 U.S.C.
921(a)(21)(D) and 27 CFR 478.11 (i.e., “gunsmithing”).

Gunsmithing
A dealer is “engaged in the business” of gunsmithing, as defined in 18
U.S.C. 921(a)(21)(D) and 27 CFR 478.11, when he/she receives firearms
(frames, receivers, or otherwise) provided by a customer for the purpose
of repairing, modifying, embellishing, refurbishing, or installing parts in
or on those firearms. Once the work is completed, the gunsmith returns
the firearms, and charges the customer for labor and parts. As with an
individual customer, a licensed dealer-gunsmith may receive firearms
(properly identified with a serial number and other information required
by 27 CFR 478.92) and conduct gunsmithing services for a customer who
is a licensed importer or manufacturer. A dealer-gunsmith is not
“engaged in the business” of manufacturing firearms because the
firearms being produced are not owned by the dealer-gunsmith, and
he/she does not sell or distribute the firearms manufactured. Once the
work is completed, the dealer-gunsmith returns the firearms to the
importer or manufacturer upon completion of the manufacturing
processes, and does not sell or distribute them to any person outside the
manufacturing process. Under these circumstances, the licensed dealer-
gunsmith is not “engaged in the business” of manufacturing firearms
requiring a manufacturer’s license.
In contrast, a dealer-gunsmith may make or acquire his/her own
firearms, and repair, modify, embellish, refurbish, or install parts in or
on those firearms. If the dealer-gunsmith then sells or distributes those
firearms for livelihood and profit, the dealer-gunsmith is engaged in
his/her own business of manufacturing firearms. A person engaged in
the business of manufacturing firearms for sale or distribution is
required to be licensed as a manufacturer, identify/mark all firearms
manufactured, maintain permanent records of manufacture, submit
annual manufacturing reports, and pay any taxes imposed on firearm
manufacturers. A licensed dealer-gunsmith who becomes licensed as a
manufacturer must also segregate all firearms manufactured for that
business separately from firearms for which gunsmithing services are
being performed.
To facilitate inspection and ensure that ATF can determine that a
licensed dealer-gunsmith is not engaged in the business of
manufacturing firearms for his own sale or distribution without a
manufacturer’s license, licensees may take the following steps:
1. maintain a copy of the current, active license of all contracted
licensees;
2. maintain a copy of the contract and all instructions for
gunsmithing services rendered;
3. maintain a copy of the invoices for gunsmithing services;
4. timely and accurately reflect all firearms acquisitions and
dispositions consistent with the contract for gunsmithing services
rendered; and
5. in the case of a licensed dealer-gunsmith, maintain required bound
acquisition and disposition records for all gunsmithing activities
separate from other dealer’s records.

Identification of Firearms

Because dealer-gunsmiths are not required to identify firearms
manufactured, it is incumbent upon the importer or manufacturer, prior ATF Issues Firearms Manufacturing Ruling
to shipping firearms to a dealer-gunsmith for gunsmithing services, to
mark them with a serial number and other required information. With
regard to frames and receivers shipped separately, section 478.92(a)(2)
provides, in part, that the manufacturer or importer must mark all
frames and receivers prior to shipment with all information required by
section 478.92 (i.e., serial number, model (if designated), caliber/gauge,
manufacturer’s name, and place of origin). This will ensure that the
frames and receivers can be traced by ATF in the event they are lost or
stolen during the manufacturing process.

receivers, or otherwise) for, or on behalf of a licensed importer or

While WGO has been in contact with Governor-elect Walker’s press

secretary, Cullen Werwie, no statement on Walker’s position on
Constitutional Carry has been received. Walker did earn an F rating due
to his failure to answer the WGO candidate survey, which asks
candidates their position on no-permit carry. The survey was re-issued to
Walker giving him the opportunity to tell gun owners his views.

Meanwhile, four organizations — Gun Owners of America (GOA),

National Association for Gun Rights (NAGR), Wisconsin Carry, Inc., and
the United States Concealed Carry Association (USCCA) — have joined
the public push by stating their support for “Constitutional Carry.”
