PENSION – Mobility of personnel amongst Central / State Universities and
Autonomous Bodies while working under pensionable establishments after 1.4.2003
– Continuance in the Old Pension Scheme – Orders – issued

ORDER:
In the letter first read above, the Government has clarified that if an employee
of a University appointed prior to 01.04.2003 gets an appointment on or after
01.04.2003 in the same University or in another University in the State he shall be
allowed to continue under Old Pension Scheme and eligible for calculating qualifying
service for pension.

2. In the Office Memorandum second read above, the Government of India

has ordered that the pre-existing arrangement of mobility between State /Central,
Autonomous Bodies of Central / State Government and between Autonomous
bodies that were governed by Old Pension Schemes in force till 31.12.2003 vide
No.28/10/84-P&PW, dated:7.2.1986 and O.M. No.28/10/84/ Pension Unit,
dated:29.08.1984 stand restored although those under Central Provident Fund etc.,

will not be allowed entry into the Old Pension Scheme on appointment from
01.01.2004”. But as per the clarifications issued in letter first read above, employees
appointed before 1.4.2003 under pensionable service were allowed to continue in
the Old Pension Scheme if their mobility pertains to Universities within the State of
Tamil Nadu only.

3. Tvl.P.Veeramani and R.Richard Churchil who were appointed as Assistant

Professor and Associate Professor respectively prior to 01.04.2003 in the Kerala
Agricultural University and subsequently joined in the Tamil Nadu Veterinary and
Animal Sciences University (TANUVAS) after 01.04.2003, have requested to count
their past service for pensionary purposes and to allow them to continue in the Old
Pension Scheme. Meanwhile the Registrar, Tamil Nadu Veterinary and Animal
Sciences University in his letter fourth cited, has requested the Government to clarify
whether the employees who worked in other State Department/ Other State
Agricultural Universities / Central Agricultural Universities in other States before
01.04.2003 and gets appointment in Tamil Nadu Veterinary and Animal Sciences
University on or after 01.04.2003 are eligible to continue in the Old Pension Scheme,
instead of entry into Contributory Pension Scheme and the past services rendered in
other State Government Departments are counted as qualifying service for the
purpose of pension.

4. Government after careful consideration, decided to adopt the Office

Memorandum of Government of India second read above. Accordingly, the
Government direct that the employees who were appointed before 01.04.2003 in
other State Universities or autonomous bodies and appointed on or after 01.04.2003
on transfer / on new appointment through proper channel in any University in Tamil
Nadu and vice versa shall be allowed to continue in the Old Pension Scheme.
