DEFENDANTS’ MOTION TO DISMISS FOR FAILURE TO

STATE A CLAIM AND LACK OF JURISDICTION

Defendants Arlington County, Virginia and Melinda M. Artman (“Ms. Artman” and

together with Arlington County, Virginia, the “County”) move, pursuant to Rule 12(b)(1) and

12(b)(6) of the Federal Rules of Civil Procedure, that this Court dismiss the above-captioned

case with prejudice, in its entirety. As grounds for its motion the County states that (1) the

“Plaintiff’s Original Complaint for Declaratory and Injunctive Relief” (“Complaint”) fails to

state any claim upon which this Court could grant relief; (2) under governing precedent, none of

the five apparent counts in the Complaint states a claim because established precedent precludes

relief; and (3) because WMD lacks standing to challenge the ordinance, this Court lacks subject

matter jurisdiction. The County makes its motion on the specific grounds set forth in the

“Memorandum of Law in Support of Defendants’ Motion to

Dismiss” for Failure to State a Claim and Lack of Jurisdiction,” (“Memorandum”) and submits

that Memorandum in support of this motion.
