th 28 IB Upper Calarian, Zamboanga City, Philippines, hereinafter called the MORTGAGOR in favor of MELBERTO R. CABATO, of legal age, Filipino and a resident of 28 th IB Upper Calarian, Zamboanga City, , hereinafter called the MORTGAGEE
W I T N E S S E T H: that
The MORTGAGOR is the owner of a residential house located at
th 28 IB Upper Calarian, Zamboanga City, Philippines;
The MORTGAGOR obtained and received from the MORTGAGEE the
sum of FIFTY THOUSAND PESOS (P50, 000.00), Philippine Currency, by way of loan payable in monthly basis in the amount of TWO THOUSAND FIVE HUNDRED PESOS (P2, 500.00) per month, for twelve (12) months or one (1) year commencing upon execution of this contract, and to be paid without the necessity of further notice and demand;
That as security for the prompt payment of the afore-mentioned
loan, the MORTGAGOR hereby transfer and convey unto the MORTGAGEE, by way of REAL ESTATE MORTGAGE, his above-described firearm which the MORTGAGOR hereby declare as free from all liens, charges and encumbrances;
In case of non-payment or violation of the terms of this mortgage,
this mortgage shall immediately be foreclosed, judicially or extra- judicially, as provided for by law, and the MORTGAGEE is hereby appointed attorney-in-fact of the Mortgagors with full power and authority to take possession of the mortgaged property without the necessity of any judicial order or any other permission or power, and to take any other legal action that may be necessary to satisfy the mortgaged debt, and all expenses in this regard shall be repaid by the MORTGAGOR and their payments secured likewise by this mortgage;
