dune 1, 2020 To: Middleton School Board Trustees and Board Chairman Kirk Adams CC: Dr. Sherawn Reberry, Kristin Beck, Gina Corrigan Step 4 of the Grievance Procedure in the Negotiated Agreement between Middleton School District No. 134 and the Middleton Education Association. The Middleton Education Association is choosing to begin this grievance at Step 4 of the process due to the nature of the complaint and the fact that it is based against the Middleton School Board and Chairman Kirk Adams. Grievant: The Middleton Education Association President: Dave Stacy © Vice President: Katie Anzalone Brief Description of Complaint: Itis the claim of the Middleton Education Association that on May 29", 2020 the Middleton School Board and Chairman Kirk Adams violated their own Middleton School District Board Policy 1240 which states: “Trustees shall not assume responsibilities of administrators or other staff members”. On May 29", 2020 during a “Special Board Meeting” the Middleton School Board voted to make one of their own trustees (Derek Moore) acting superintendent. This is a direct violation of Middleton School Board Policy 1240. Furthermore, by appointing a Trustee of the Board as acting superintendent the Middleton School Board also violated Idaho Code 33-507 creating a conflict of interest which goes beyond hiring a spouse or participating in any type of nepotism. This also violates the Idaho Educator Code of Ethics by appointing someone who has zero credentials or qualifications to act as superintendent. We feel itis also our duty to make the Middleton School Board aware that the Middleton Education Association is also currently pursuing a complaint with the Professional Standard Commission regarding the lack of professionalism and overall ethics by the Middleton School Board. Remedies Being Sought: 1. Training for the Middleton School Board administered by the Idaho School Boards Association to include specifically: a. Knowing the appropriate actions of a Board of Trustee and the purview of Board responsibilities. 2. Remove Derek Moore as acting superintendent of the Middleton School District. 3. Reassign an appropriate employee of the Middleton School District to act as superintendent while the current superintendent is on leave. 4. The Middleton School Board will refrain from continuing to break their own policies and act as if they are above reproach and are beyond the rules, ethics, principals and laws that should guide them. The timeline for this grievance will follow the Negotiated Agreement between the Middleton School Board and the Middleton Education Association ‘* The Middleton Education Association issues the grievance on Monday, June 1, 2020 ‘* The Middleton Board of Trustees will have 3 days to respond. The clock starts on June 2 and the response will be expected in writing by the end of business on June 4. * If aresponse is not received in writing by June 4* the Middleton Education Association will be awarded the remedies mentioned in this grievance. * If the Middleton School Board does reply within the 3 day window then the Middleton Education Association will have 3 days to issue a response.
