Zaheer-ud-din Babar has tried to explain the form of
violence as gender based violence. According to the
studies carried out in his thesis , he explains violence as, “ Any act involving use of force with the intent that results in physical, sexual or mental harm or suffering of a women, whether in public or private life”. The culture that involves domestic violence are mostly overlooked by the states as it is said to be their private matters, leading them to live their lives as subordinate or inferior in the society; according to the act signed by the UN commission on the Human Rights declares that equal rights should be given to both the genders and world should be violence free, yet these acts of declaration are not legally binding for the states functionally as recommended unlike the international conventions or treaties. In the same way, Islam teaches us to be kind with women and giving them equal opportunities to deal with the daily life and doesn’t impose any kind of restriction and restrains to freedom and privileges of women. Hazrat Muhammad(s.a.w.w) ordered in his last sermon that: “ treat the women well and be kind to them for they are your partners and committed helpers”, Muhammad (s.a.w.w) also explains that never insult or bury them alive and doesn’t favor sons upon them. Secondly, according to Islamic shariah, women cannot be forced to marry anyone against their will, and a man must agree to pay a specific amount of money said to as “ HAQ-e-MAHR” to whom he is going to marry, AL-QURAN gives a women a right of inheritance whether it will be a small amount left by parents or kinsmen or a shared apportioned, but the difference between both the genders are that Men are physically stronger and supposed to work for the nourishment and betterment of the family. Women are given full opportunity to get education besides men. According to the survey analysis taken by the writer, he explains that if Islamic teachings are not practiced in the county like Pakistan as Islamic country. Where traditional and social norms put strict obstacles in the way of progress for women, as though of society denies the rights of women and behaves undignified and blameworthy manner then this country is a victim of traditional tribal structure, but not Islamic.
Zaheer-ud-din defines violence into 3 category
mainly, Cultural, structural and direct violence. Conferring to the study of Harvey and gow theory, “they explain violence against women as being a property and gender role subservient to men”. Pakistan is a true example of Manifesting violence where cultural and norms legislation and perpetuate violence against women are practiced. Men have the right of making decisions and women have to follow their decisions of family tribe, society or community. In rural areas where tradional customs are followed, women are considered for barter and trader to settle debts or conflicts. Women in laws are discussed in the same manner as a material objects and possessions, and Fathers consider their daughter not to educate them as they have to wash dishes and serve their men after marriage. Men actually believe that the actual duty of the women is inside their homes.
International Planned Parenthood Federation defines
gender based violence as physical, psychological and economical abuse of a woman by her partner or by another person within home or family. Physical torture includes burning and murdering woman. Psychological involves verbal abuse, humiliation and deprivation of freedom and rights, whereas economical abuse involves not permitting women to work or take education or taking control over family income. In Pakistan working women are considered bad charactered as they are free of the dependence of a male and they can make decisions on their own, because of deep sealed cultural and traditional practices and inadequate responses of society and government, women are killed on the name of honor, customs and compensation of crimes or bringing insufficient dowry said to as direct violence. Honor killing involves the killing of a women if she married without the will of the parent or relatives and considering the misdeed and insult for them and perceived to be impure behavior of the women.
Ignorant People or traditional views, ideas or
principles tries to proves that these act are according to Islam as practiced in the past, but reality is that it is totally against the true spirit of Islam. In Quran it is clearly mentioned that “ Do not kill the soul which Allah has made sacred except through the due process of law. Islam doesn’t allow anyone to take the law into their hands which leads to social disorder and lawlessness.
In tribal Areas an act named as Karo-Kari is also
practiced, where Kari is a bad woman is killed and Karo is compensated if he pays an amount of money or in response gives his own sister for compensation. Dowry system is also another tradition practiced whose consequences are direct violence of women, around 99% families follow this system and women are killed or tortured on tese baiss and if they do not bring a suffiecient dowry they are killed or burnt alive through kerosene oil or acids. Again such acts are prohibited in Islam as it teaches men to give Mahr to the woman rather than taking dowry against the women will. Furthermore, in direct violence women are threatened through States man, representatives and other official authorities involving politicians, police and army officers practicing their authorities upon women.
