AFFIDAVIT / ATTESTATION

I, TEODORA CAITUM-PUTAN of legal age, Filipino,


widow, with residence and postal address at Brgy. Tabunok, Purok
Talisay, Maasin City, Southern Leyte after having been sworn to in
accordance with law hereby depose and state the following:

1. I am a grantee of Free Patent with Free Patent No. 083719-


27293 and pursuant to such grant an Original Certificate of Title
(OCT) with number P-79794 was issued unto my name on October
21, 2009 by the Registry of Deeds of the Province of Leyte, copy of
the mentioned original certificate of title is attached and forming part
of this sworn statement for ready and immediate reference.

2. On verification and review of the issued Original Certificate


of Title with number P-79794, specifically, at the portion of the
technical description and the boundaries of the property, it appears
and shows that it is not the property for a which I applied for the
issuance of Free Patent considering the following: [1] the property for
which a title or patent I applied for is with an area of One Thousand
Three Hundred Twenty Four (1,324) square meters and not the one
appearing in the title which is Twenty Thousand Four Hundred
Twenty (20,420) square meters; [2] the boundaries of my property are
– on the NORTH Assessor’s Lot No. 022 or Lot No. 10506, on the
SOUTH Assessor’s Lot No. 008 or Lot No. 10610, on the EAST
Assessor’s Lot No. 018 or Lot No. 10549, and on the WEST
Assessor’s Lot No. 016 or Lot No. 10539 while the one appearing on
the title is wider with irregular configuration the boundaries are – S on
line 1-2 by Lot No. 10532 Case 32 Cade. 566-D, SW on line 2-3 by
Lot No. 10531 Case-32 Cad. 566-D, SW corner 3 is common to Lot
10530 Case 32 Cad. 566-D, W line 3-4 by Lot 10529 Case 32 Cad.
566-D, W corner 4 is common to Lot 10527 Case 32 Cad, 566-D, NW
line 4-5 by Lot 10502 Case 32 Cad. 566-D, NE lines 5-6-7 by Lot
10503 Case 32 Cad. 566-D, NE corner 7 is common to Creek with
legal easement (20.00 M. Wide), E on l;ines 7-8-9 by Lot No. 10504
Case 32 Cad.566-D, and SE on line 9-1 by Lot 10534 Case – 32 Cad.
566-D; [3] if the sketch map of the properties in Brgy. Tabunok, the
disparity in the area as well as the place where they are situated will
very much show the error appearing on the issued title issued unto me;
[4] the property I own is covered by Real Property Declaration in
my name and with number 14041 00106 R13 showing the same
boundaries in the property I mentioned to be mine while the real
property declaration in the name of Nacienciano Tantuan has a Tax
Declaration Number 14041 00057 R13 with similar boundaries and

area appearing on my title; and [5] I am in possession of my property
which is not properly described in the title or erroneously described in
therein while the property which is referred to in my title is being
possessed and enjoyed by the relatives of Nacienciano Tantuan.

3. On investigation and further inquiry with the Department of


Environment and Natural Resources (DENR) it showed that there was
an error or duplication in the assignment of one lot number in Brgy.
Tabunok, meaning that one lot number was assigned to two properties
and these properties are that owned by me and that in the name of
Nacienciano Tantuan. These lots similarly bear Lot No. 10727.
However, I am very much aware of what is owned by me and what is
not owned by me. I am only in possession of what is owned by me
and that the title issued unto me does not contain the correct and exact
description and area of what I own. The records of the lots herein
mentioned will show the truth and will correct the error.

4. I have correctly applied for a title to my property, however, I


was issued erroneous description in the title issued – OCT-P-79794.
For such error, I am herein stating under oath that the property
described in my title is not mine and erroneous as
aforementioned. I have no interest over such property which
technical description appears on my property. I and my heirs or
children claim no ownership or right whatsoever therein as it is
an error which should be corrected. In my application for a title, the
Tantuans waived and made a declaration of their non-interest over my
property and in similar manner I am here in making a waiver of
ownership or claim over the property, the technical description of
which appears on my title.

5. I am executing this affidavit knowingly and freely to attest


the truth of the foregoing statements and to declare of my conformity
to the correction of the technical description of my title by the
appropriate authorities and to further declare of my non-interest of the
property which is not owned by me.
