Having examined the Government's Requirements including Instructions to Tenderers and
the Conditions of Contract and the Appendices annexed thereto (hereinafter referred to as the
Prebid Documents) we, the undersigned, offer to design, construct and complete the
said Works in conformity with the said Prebid Documents for the lump sum of Malaysian

3.         We intend, in the event of acceptance of this Tender, to choose one of the
following form of Performance Bond :
 
*i)          Bank Guarantee
I. Finance Company Guarantee
II. Insurance Guarantee
III. Bank Islam Guarantee
IV. Bank Pembangunan & Infrastruktur Guarantee
V. Takaful Guarantee
VI. Performance Guarantee Sum whereby ten percent (10%) of each interim payment
shall be deducted until the total amount deducted aggregate to a sum equivalent to
five percent (5%) of the original Contract Sum.

 4.         This tender shall remain valid for the period of ........ days from the date fixed
for receiving the same and it shall remain binding upon us and may be accepted at any time
before the expiration of that period or within any extended period subsequently agreed by us.
 
5.         Unless and until a formal Agreement is prepared and executed, this Tender,
together with your written acceptance thereof, shall constitute a binding contract between
the Government and ourselves.
 
6.         We agree that if we withdraw our tender anytime during the tender validity period
asmentioned in paragraph 4 above or if we repudiate the Contract when the tender is awarded
to us or if we fail to provide the Performance Bond or if we fail to execute the
Contract Agreement, the Government reserves the right to take disciplinary action against
the undersigned or to cancel the registration of the undersigned as a Government Contractor
as the Government deems fit.
