The terms of this Legal Service Agreement notwithstanding, any amount of attorney’s
fees awarded by the court pursuant to contracts and/or judgment shall pertain and be payable to
the firm and is understood to be separate and distinct from the consideration agreed hereupon
as indicated above.

It is further understood that this Agreement is limited to the handling of the present case
contemplated above, and excludes other proceedings brought before any other court or tribunal
such as, but not limited to, elevation of the case to the Court of Appeals or to the Supreme
Court on appeal or by Certiorari, referral to any other administrative tribunal though its subject
matter is intimately related to the case above.

Actual costs such as telex, fax, telegram, photocopies expenses, representation

expenses, filing fees and sheriff’s fees, expended during our engagement, as well as other out-
of-pocket expenses you may authorize us to incur (which shall always be cleared with you in
