In relation to the previously given assignments, I have listed areas of topic and questions that the
students must be able to answer. This will cover Article 1 to 54 of the Family Code. I will continue
sending you guide topics and question through your beadle. Make use of the suspension of classes
as your opportunity to review in preparation for the Bar and not only to pass the subject. Stay safe
and healthy.

1. Effects on the contract of marriage when there is:


a. Absence of any of the essential or formal requisites;
b. Defect in any of the essential requisites;
c. Irregularity in the formal requisites.
2. Who may contract marriage?
3. Who may solemnize marriages?
4. The legal significance of parental consent vs. parental advice.
5. The effect of divorce obtained abroad by an alien spouse from his or her Filipino spouse.
6. When may a divorce decree obtained abroad be recognized in the Philippines? (see the case
of Garcia vs. Recio, G. R. No. 138322, Oct 2, 2001)
7. Marriages exempted from the license requirement under the Family Code.
8. Distinguish Void and Voidable marriages in the following manner:
a. As to nature
b. As to susceptibility of convalidation
c. As to effect upon property
d. As to effect upon children
e. As to how marriage may be impugned
f. As to who may impugn marriage
g. As to when marriage may be impugned
h. As to necessity of judicial declaration
9. Identify the void marriages under the Family Code. You must identify at least 9 instances.
10. Understand fully well the concept of Psychological incapacity and how the same may be
established.
11. Identify the voidable marriages. Identify at least 6 instances.
12. Know the rules contemplated under article 54 of the Family Code regarding the
classification:
a. Children conceived or born before the judgement of annulment or absolute nullity of
marriage under Article 36 of the Family Code has become final and executor.
b. Children conceived or born of the subsequent marriage under Article 53 of the Family
Code which is considered null and void due to failure to comply with the requirement
to record judgment of annulment or absolute nullity of the marriage in the appropriate
civil registry.
