WHEREAS, Section 2, Article X of the 1987 Philippine Constitution provides that local
government units shall enjoy local autonomy and shall exercise their respective powers within
the limits of the law as an instrumentality of government;
WHEREAS, various judicial decisions have already clarified that enactments of the Local
Government Units (LGUs) shall not contravene to existing laws and other legal orders
promulgated by any instrumentalities of the national government and must conform to the limits
of the powers granted to them.
WHEREAS, Executive Order 168 dated26May 2O14 created the lnteragency Task Force
on Emerging and lnfectious Diseases (IATF-EID) and its regional counterp,-arts to steer the
overall response efforts on any emerging infectious diseases olwhich COVID 1g may fall under;
WHEREAS, IATF Resolution No. 34 dated 08 May 2O2O prescribes that the Regional
lnter-Agency Task Force (RIATF) shall be convened with ihe respective Regional Directors of
the Department of the lnterior and Local Government (DILG) as Chair and Def,adment of Health
(DOH) as Co-Chair, which shall be a distinct and separate-body from the Regional Task Force
(RTF), to focus on sefting policies while RTF shail focus on the operatioial aspect of the
response;
WHEREAS' in a Memorandum dated 18 March 2Q2O trom the Executive Secretary to all
department, agencies and instrumentalities of government including the Local Government
Units (LGUs) are directed to adopt, mordinate ind implement guidelines which the IATF may
issue on the COVID-19 situation, consistent with the respective igency mandates and relevant
laws, rules and regulations;
WHEREAS, various localgovernment units have issued policies outlining their respective
health protocols for APORs, locally stranded individuals and other concerns;
WHEREAS, the City of Zamboanga issued Executive Order No. BC 578-2020, which
declares General Community Quarantine (GCQ) in the City and provides guidelines for its
implementations, which includes additional guidelines for travel of Authorized Persons Outside
of Residence (imposition of additional requirements);
WHEREAS, the Province of Zamboanga del Sur also issued Executive Order No. 2020-
26 imposing additionalguidelines forthe LSls/ROFs and guidelines on the movement of APORs
to include ExiUEntrance Authorization Pass, Negative Test Results and quarantine
requirements;
WHEREAS, the members of the RIATF and RTF COVID 19 unanimously believe that
such policies are bereft of basis;
WHEREAS, the members of the RIATF and RTF COVID 19 expressed concerns thatthe
imposition of the additional guidelines will seriously hamper the movement of APORS, who
perform critical roles in the COVID 19 response;
WHEREAS, there is a need to advise the concerned local government to review and
rectify their respective policies to conform to existing nationalguidelines;
NOW THEREFORE, on the motion of RD Dan Navarro of TESDA lX duly seconded jointly
and severally by the members of the RIATF-RTF, BE lT RESOLVED AS lT lS HEREBY
RESOLVED, to advise the Province of Zamboanga del Sur and the City of Zamboanga to review
their respective local policies and rectify those provisions that do not have basis and are
inconsistent with the national guidelines;
RESOLVED FURTHER, to advise all local govemment units to strictly conform to existing
guidelines issued by IATF, RIATF and other instrumentalities of the national government in
formulating their respective local polices relative to COVID 19 response;
RESOLVED FINALLY, to enjoin all local government units to consult with the Regional
lnteragency Task Force Chairperson prior to enactment of their respective health policies.
