APPLICATION FOR PROBATION

The undersigned accused Jacobo Montoya, for probation under the provisions of
Presidential Decree No. 968, as amended, declares that:

1. He is 61 years of age, male, widower and a resident of Pagdaraoan, San Fernando

City, La Union;

2. He has been convicted of Acts of Lasciviousness and sentenced to suffer the penalty
of eight (8) months and one day to six (6) years imprisonment and to pay a civil
indemnity of One Hundred Thousand Pesos (P100,000.00);

3. He already paid the said civil damages;

4. He has not begun to serve the term of imprisonment imposed on him;

5. The crime of which he has convicted is not an offense against the security of the state;

6. He has not previously been convicted by final judgment of any offense punished by
imprisonment of not less than one (1) month and one (1) day and/or a fine of not less
than two hundred pesos (P200.00); and

7. This is his first time to apply for probation under Presidential Decree No. 968, as
amended.
