1 WHEREAS on January 7, 2011 Defendants Law Office ofOrly Taitz and Dr.
2 Orly Taitz, Esq., D.D.S., J.D. C'Defendants"), filed their Motion to Strike, pursuant to
3 California Code of Civil Procedure section 425.16 as to Plaintiff Charles E. Lincoln,
4 Ill's firs claim for malilcious prosecution ("Motion to Strike") (Dkt. 18);
5 WHEREAS on January 9, 2011, Plaintiff requested that Defendants continue
6 the hearing date on their Motion to Strike from February 7, 2011 to February 14,
7 2011, to allow Plaintiff's counsel to travel from the east coast once rather than twice;
8 WHEREAS the court currently has on calendar and set for hearing. defendant
9 Yosef Taitz' motion to dismiss. Defendants have joined in Mr. Taitz' motion (Dkt.
10 6);
11 WHEREAS Defendants have agreed to accommodate Plaintiff and his counsel
12 so that Defendants' motion may be heard on its merits;
13 WHEREAS Defendants and Plaintiff have agreed and stipulated to continue
14 the hearing date on their Motion to Strike from February 7, 2011 to February 14,
15 201 I,to heard at 10:00 a.m. in courtroom lOD;
16 WHEREAS Defendants and Plaintiff have further agreed and stipulated to
17 allow Plaintiffs' opposition and Defendants' reply to be calendared pursuant to the
18 new hearing date of February 14,2011;
19 IT IS HEREBY STIPULATED that the hearing date for Defendants'
20 Motion to Strike Plaintiffs' first claim for relief, currently set for hearing on February
21 7,2011, shall be continued to February 14, 201l and to be heard at 10:00 a.m. in
22 courtroom lOD.
