AFFIDAVIT FOR ARREST WARRANT

Comes now the affiant, Detective Brian Savelli (EID 3175), a sworn law enforcement officer, to wit: a
Deputy Sheriff for the Orange County Sheriff's Office, Florida, before The Honorable
____________________________________, Judge, in and for Orange County, Florida, Ninth Judicial
Circuit, who makes this affidavit and states under oath that affiant has probable cause to believe that certain
laws have been violated Orange County, Florida, and that on/between July 28, 2020, the Defendant, NAEL
ZABEN ABRAHAM, did violate Florida State Statute(s), and commit the offense(s) of:
C1: Second Degree Murder with a Firearm FSS: 782.04(2)-18
Your affiant, Detective Brian Savelli (EID 3175), is and has been since December 4, 2007, a duly
sworn Deputy Sheriff, with the Orange County Sheriff's Office, Florida.

YOUR AFFIANT, IN THE COURSE OF THIER OFFICIAL DUTIES, HAS COME TO INVESTIGATE:
On July 28, 2020, at 6:33 p.m., the Orange County Sheriff's Office responded to the intersection of
Consulate Drive and South Orange Blossom Trail, Orlando, Orange County, Florida, in regards to
an unresponsive male in a black truck. Deputy Sheriff Rafael Ferrer (EID 9628) responded and
located the victim, 45-year-old Eric A. Schnetzer, in the driver’s seat with a suspected gunshot wound
to the right side of his head. Orange County Fire Rescue 53 responded and transported Eric
Schnetzer to Orlando Health. On July 28, 2020, Dr. Abram pronounced Eric Schnetzer deceased.
Deputy Ferrer noted the vehicle Eric Schnetzer was in was a 2018 black Chevrolet Silverado bearing
Florida tag number IM31WC, which was registered to Eric Schnetzer. The vehicle Eric Schnetzer
was located in had the passenger window rolled fully down at the time of the incident.

I arrived on scene on July 28, 2020, at 7:19 p.m., as the lead detective.

Orange County Sheriff's Office Crime Scene Investigator Alexandra Benedetto responded as the lead
crime scene investigator. Investigator Benedetto located one Hornady 9mm Luger spent cartridge
casing in the intersection of Consulate Drive and South Orange Blossom Trail.

I made contact with the business representative of Melao Bakery, which was equipped with
surveillance video that stretched into South Orange Blossom Trail.

The video surveillance revealed on July 28, 2020, at 6:31 p.m., Eric Schnetzer was traveling
southbound on South Orange Blossom Trail, followed by an Infiniti QX60. The Infiniti QX60 started
to pull alongside Eric Schnetzer and as the Infiniti QX60 approached him, Eric Schnetzer began to
roll his window down. The Infiniti QX60 pulled alongside the passenger side of Eric Schnetzer’s
black Chevrolet Silverado and briefly stopped alongside him. The Chevrolet Silverado came to a
complete stop, and a few seconds later idled through the intersection. The Infiniti was gray in color
with chrome trim, and had a trailer hitch attached to the rear of the vehicle.

Additional surveillance video was located via an Orange County red light camera that was located at
the intersection of Consulate Drive and South Orange Blossom Trail. The video depicted the Infiniti
QX60 pull alongside the passenger side of the victim’s Chevrolet Silverado with the front driver
window rolled down. The driver of the Infiniti appeared to stick his hand out of the open driver’s
window, and it raised in a manner consistent with the recoil movement of shooting a handgun. This
is also in the area where the 9mm spent cartridge casing was located. Upon the movement of the
Infiniti driver’s hand out of his open window, the victim’s Silverado came to a sudden stop, before
slowly idling through the intersection. The Infiniti then turned right (west) on Consulate Drive and
fled the scene at what appeared to be a high rate of speed.

Upon making next of kin notification to the family of Eric Schnetzer, I learned he was on his way to
work and routinely traveled on the Florida Turnpike. Video surveillance was located on the exit toll
plaza of the Florida Turnpike at South Orange Blossom Trail. The video depicted a potential road
rage incident, which took place between the Infiniti QX60 and the victim’s Chevrolet Silverado.

Upon further investigation, I learned that Eric Schnetzer entered the Northbound Florida Turnpike
on July 28, 2020, at 6:19 p.m. at the Kissimmee-St. Cloud Entrance. I further learned that a 2018
Infiniti QX60 bearing Florida tag number LHG-U63 drove onto the Florida Turnpike at the
Kissimmee Park on-ramp on July 28, 2020, at 6:21 p.m. The surveillance video from that toll plaza
entrance revealed the vehicle in-fact had a trailer hitch attached to it, as well as an Apple sticker on
the top left corner of the rear windshield. Video surveillance from the Florida Turnpike revealed the
Chevrolet Silverado and the Infinity QX60 were driving aggressively toward one another as they
both exited the Turnpike at South Orange Blossom Trail.

That Infiniti was the same vehicle that was captured on video pulling alongside Eric Schnetzer’s
pickup truck at Consulate Drive and South Orange Blossom Trail. The Infiniti QX60 was registered
to 25-year-old Nael Abraham with an address of 427 Cobblewood Drive, Rockledge, Florida.

On July 29, 2020, Dr. J. Stephany of the District Nine Medical Examiner’s Office conducted an
autopsy on Eric Schnetzer. Dr. Stephany determined the cause of death to be a gunshot wound of
the head and the manner of death to be a homicide.

Detectives located the vehicle backed into a parking spot at the Ignite Smoke Shop located at 513
South Cocoa Boulevard Suite C, Cocoa, Florida 32922. I confirmed the vehicle was still equipped
with the distinct trailer hitch as well as the Apple sticker on the top left windshield. Note- The
business at 513 South Cocoa Boulevard Suite C was labeled as the Ignite Smoke Shop, however the
corporate registration is NZA Enterprises, Inc. Nael Abraham owned this business.

On the evening of July 29, 2020, the Orange County Sheriff’s Office Felony Surveillance Squad
requested the assistance of the Brevard County Sheriff’s Office’s for surveillance at 513 South Cocoa
Boulevard, Suite C, at the Ignite Smoke Shop/NZA Enterprises, Inc. BCSO Agent Brandon Sellers
positively identified Nael Abraham inside Ignite Smoke Shop. Agent Sellers watched as Abraham
carried items to and from the shop to the Infiniti. At approximately 2115 hours, Agent Sellers
watched Abraham and his employee, Johnny Rodriguez Jr., exit the smoke shop. Abraham produced

keys and locked the store’s door, and unlocked/started the Infiniti QX60.

Abraham was detained pursuant to this investigation at this time, by BCSO Task Force Agents. In
the possession of Abraham was his cellular phone, a white Apple iPhone a1921. I took possession of
Abraham's cellular phone.

Next, I interviewed Johnny Rodriguez Jr. The following is general summary of his sworn interview:
He stated that he has known Nael Abraham for 8 years and has worked for him for 2 years at Ignite
Smoke Shop. He stated that Abraham is the only person who drives the Infiniti, and that on July 28,
2020, Abraham was only at the shop between approximately 12-1:00 p.m. He stated that he talked to
Abraham via Facetime at approximately 8:30 p.m., and he noted Abraham was driving his Infiniti.
Rodriguez noted that Abraham did not pick up the business’ cash deposit at the close of business on
July 28, 2020.

Nael Abraham was interviewed by Detective Savelli Post-Miranda and under oath. He waived his
rights and agreed to speak with Detective Savelli. The following is a general synopsis of his sworn
interview:

Nael Abraham stated he left the shop at approximately 3:00 p.m., and went to Melbourne, Florida to
pick up product for his shop. He then returned to his store at approximately 6:00 p.m. and denied
being in Orlando. Nael Abraham was hesitant but did identify his vehicle on Turnpike Authority toll
plaza video, immediately prior to this homicide. Nael Abraham confirmed to detectives that his
cellular phone number was 321-432-5040. He denied being in Orlando, and involvement in the
homicide of Erick Schneltzer, and when confronted with the inconsistencies in his statement, invoked
his rights and requested an attorney, all questioning was stopped at that point.

Nael Abraham’s testimony conflicted with the sworn testimony of Johnny Rodriguez. Johnny
Rodriguez told detectives in a sworn statement that Nael Abraham never came back to the store after
he left in the afternoon of July 28, 2020. Nael Abraham however, told detectives he was at the Ignite
Smoke Shop on July 28, 2020, at approximately 6:00 p.m.

On July 30, 2020, Agent Don Reynolds of the Brevard County Sheriff’s Office executed a search
warrant at the Ignite Smoke Shop located at 513 South Cocoa Boulevard Suite C, Cocoa, Florida
32922. Agent Don Reynolds recovered the DVR system at the Ignite Smoke Shop, a HIKVISION
Digital Video Recorder. Agent Reynolds relinquished custody of the video recorder to me on July
30, 2020.

On July 31, 2020, I authored the following search warrants:

• The cellular phone that Nael Abraham was in possession of on July 30, 2020.
• The DVR from Ignite Smoke Shop, a HIKVISION digital video recorder.
• The 2018 Infinity QX60 which belonged to Nael Abraham.
• Historical Cell Site records for cellular phone number 321-432-5040.

I presented the search warrants to the Honorable Judge Renee Roche. Upon reviewing the affidavit,
Judge Roche signed the search warrants.

With the assistance of Digital Forensic Investigator James Montgomery, the search warrant was
served on the digital video recorder. Upon reviewing the data on the digital video recorder, it
depicted Nael Abraham in the store on July 28, 2020, at approximately 1:41 p.m., and was wearing a
black shirt and light denim jeans. Nael Abraham left the ignited smoke shop on July 28, 2020, 2:55
p.m., and never returned.

The video surveillance disproved the sworn testimony of Nael Abraham when he stated he was at the
Ignite Smoke Shop on July 28, 2020, at 6:00 p.m.

On August 2, 2020, Crime Scene Investigator A. Benedetto processed the Nael Abraham’s 2018
Infinity. Inside the glove box, Investigator Benedetto located a single live Hornady 9mm Luger bullet.
This matched the same spent cartridge casing at the homicide scene on July 28, 2020.

With the assistance of Digital Forensic Investigator James Montgomery, the search warrant was
served on the cellular phone of Nael Abraham. Investigator Montgomery confirmed the phone
number the cellular phone was ported to was the phone number that Nael Abraham gave detectives
in his interview, 321-432-5040. In the phone of Nael Abraham, was a sales receipt from the FedEx
shipping center located at 3960 Dow Road, Melbourne, Florida from July 28, 2020.

On August 10, 2020, I received the historical phone records for the phone number 321-432-5040. A
preliminary review of the historical phone records revealed the device was in the area of Ignite Smoke
Shop (513 South Cocoa Boulevard) on July 28, 2020, at approximately 1:26 p.m., which was
consistent with the video surveillance from the business. This confirmed that Nael Abraham was
utilizing the cellular phone on July 28, 2020. Additionally, the cellular phone records placed Nael
Abraham utilizing cellular phone towers in the area of the entrance ramp onto the Florida Turnpike
at the Kissimmee Park Road entrance, and then further used cellular phone towers along the Florida
Turnpike in a northern direction. This is consistent with Nael Abraham’s vehicle entering the
Florida Turnpike and traveling northbound traveling into Orlando. The historical cellular phone
records further placed the cellular phone in the general area of the homicide scene on July 28, 2020.

The cellular phone records further disproved Nael Abraham’s alibi and placed him in Orlando,
Florida at the homicide scene, and not at the Ignite Smoke Shot in Brevard County.

On August 4, 2020, I reviewed the video surveillance from the FedEx Shipping center located at 3960
Dow Road. The video revealed on July 28, 2020, at 4:48 p.m., Nael Abraham drove his Infinity QX60
into the parking lot and exited the driver’s door. Nael Abraham was the only occupant of the vehicle
and as he exited, he was wearing light denim jeans and a black shirt, the same outfit he was wearing
at the Ignite Smoke Shop on July 28, 2020. Nael Abraham completed the transaction and drove the
vehicle out of the parking lot on July 28, 2020, at 5:00 p.m.

This investigation revealed Nael Abraham was the sole occupant of his registered 2018 Infinity QX60
on July 28, 2020.

The probable cause for Nael Abraham is summarized as follows:

• The victim, Eric Schnetzer is dead as a result of a gunshot wound of his head. Dr. Stephany
from the District Nine Medical Examiners determined the cause of death to be a homicide and the
manner of death to be a homicide.
• The death was caused by Nael Abraham as he fired a single gunshot from his vehicle into the
vehicle of Eric Schnetzer at the intersection of Consulate Drive and S. Orange Blossom Trail.
• The expressway authority confirmed Nael Abraham’s vehicle drove onto the Florida
Turnpike on July 28, 2020, at 6:21 p.m. and was observed in a road rage incident with Erick
Schnetzer’s vehicle as they exited the Florida Turnpike onto South Orange Blossom Trail.
• Nael Abraham’s vehicle sped off at a what appeared to be a high rate of speed driving on west
on Consulate Drive.
• Nael Abraham provided sworn testimony that he was at the Ignite Smoke Shop located at 513
S. Cocoa Boulevard; however, the video surveillance from Ignite Smoke Shop and historical phone
records revealed he was not there, and was in-fact at the murder scene.
• The cellular phone records placed Nael Abraham at the toll plaza where he entered the
Florida Turnpike, as well as in the general area of the homicide scene on July 28, 2020.
• A live round which matched the same round at the homicide scene was located in the vehicle
of Nael Abraham.
Based on the aforementioned facts and circumstances, I has probable cause to believe Nael Abraham
acted in ill will, and had no regard for human life as he drove alongside Erick Schnetzer and fired a

single round into his vehicle, striking him in the head and killing him. As a result, I have probable
cause for the arrest of Nael Abraham for Second Degree Murder with a Firearm, F.S.S.
