TENDER CALL NOTICE NO. 196/OMC/S&M/2014 FOR SEIZED ORE

Sealed quotations are invited for sale of various grades of Seized Iron Ore & manganese ore
& Coal available at different locations under Joda Mining Circle, Dist: Keonjhar & Koira
Mining Circle, Dist: Sundargarh & Cuttack Mining Circle, Dist: Cuttack as per terms and
conditions as detailed below. The bidders are required to submit their sealed quotations in the Tender
Drop Box of Sales & Marketing Section of OMC Ltd, Bhubaneswar by 1 PM on 27.03.2014
1. The sealed quotations are required to be submitted in two separate sealed envelopes
as Technical bid envelope and Price bid envelope in the prescribed format.
Technical Bid : (Technical Bid Sealed envelope):
The Technical Bid sealed envelope containing Technical Bid format duly filled in along with the
following documents (Legible/clear copies duly signed to be submitted)
(i) Copy of valid Sales Tax/VAT/CST/TIN Registration Certificate in name of the bidder .
(ii) Valid license under Odisha Minerals (Prevention of theft, Smuggling & Illegal Mining and
Regulation of Possession, Storage, Trading and Transportation) Rules, 2007 to deal
concerned ore.

(iii) IBM Registration Certificate under Rule 45 of MCDR (Amendment) 2011


(iv) EMD for requisite amount in shape of DD. in favour of Odisha Mining Corporation Ltd,
Bhubaneswar, payable at Bhubaneswar.

(v) Tender Notice (all pages) signed in each page as token of acceptance of terms &
conditions.
(All the bidders must submit above documents positively, failing which the bid shall be
rejected)
Price Bid : (Price Bid Sealed envelope)
Price Bid shall comprise of the price quoted itemwise per WMT by the tenderer for the desired lot(s).
The Bidder must indicate “Tender for Seized Ore” on the envelope while participating in this tender.
Quotation for part quantity of any lot shall not be accepted and the bid shall be rejected.
The entire information including Technical Bid and Price Bid should be typed written. Any deviation
from above in submission of bids, the same will be subject to rejection. The Technical Bid will be
opened on 27.03.2014 at 3.00 PM and the Price Bid of successful bidders in Technical Bid
shall be opened subsequently in presence of the participants or their authorized
representatives.

OMC authorities will not be responsible for variation of quality (grade) of above lots. The H-1 bidder
shall not be allowed to lift more than the tendered quantity.

Iron Ore lessees are not eligible to participate in this tender.

3. INSPECTION : The interested bidders may inspect Ore Lots ( for which they are interested)
lying at different locations indicated at Clause-1 taking consent of concerned Dy. Director of
Mines/Mining Officer prior to submission of their tender/bids for satisfaction. No complaint in the
material quantity/ grade shall be entertained after execution of contract / issue of allotment Order.
4. EARNEST MONEY DEPOSIT (EMD): The bidder has to deposit Earnest Money in shape of
Demand Draft as per EMD amount indicated against each item(s) drawn on any Scheduled Bank at
Bhubaneswar in favour of Odisha Mining Corporation Ltd., Bhubaneswar, payable at Bhubaneswar
along with the bid. No interest shall be paid on EMD. The DD against EMD for each item has to be
submitted separately in Technical Bid in order to facilitate scrutiny & quick refund of EMD amount to
unsuccessful bidders. In the event, the H1 bidder fails to lift the available quantity (limiting to the
tendered quantity) or minimum 90% of allotted quantity whichever is less against the above tender
participation within the stipulated time in conformity with tender norms, the EMD deposited with OMC
by the buyer will be forfeited. However, if the reason of non-lifting/ shortfall in lifting is found
to be not attributable to the buyer, then OMC may decide to refund the EMD.
The bidder will put the seal of the company/ mention the name of the agency at the rear side of
each DD deposited towards EMD. In order to facilitate refund of EMD by hand to the unsuccessful
bidders on the date of opening of tender, the bidder may submit an authorization letter through the
bearer to take back the DD by hand. The EMD of unsuccessful bidders shall be refunded within 15
(Fifteen) days by post after opening of offers in absence of such authorization.
5. VALIDITY OF OFFER : Bidders offer shall remain valid at-least for 30(thirty) days from the
date of opening of tender.
6. PLACE & MODE OF DELIVERY : Indicated at Clause-1.
The buyer shall keep the seller indemnified for any liability which may arise during the contract
or thereafter on account of loading, transport and such other matters as are thereto to their exercises.
As per “The Environment Protection Act-2006” and guidelines, the buyer should ensure that the
loaded trucks are to be covered with tarpaulin during transport.
7. SUPPLY/LIFTING PERIOD : 4(Four) months from the date of issue of allotment order.
8. PAYMENT TERMS : After tender processing, the accepted highest bidder (H1) will be issued
allotment order for tendered quantity. The H1 bidder shall deposit 100% of the amount in advance in
shape of Demand Draft/Banker’s Cheque with the concerned Regional Office, OMC towards price of
allotted quantity and other Government/statutory dues within 15 days from the date of issue of
allotment order as per details below:

If H1 bidder fails to deposit the advance in stipulated time limit, the allotment order
issued to H1 bidder will be cancelled and EMD amount deposited by the bidder will be
forfeited without further correspondence.
B: Invoicing shall be made by OMC Ltd depending on the quantity of Ore lifted time to time.
The advance amount paid shall be adjusted with the invoicing amount. The bidder shall be entitled for
refund of the balance advance amount against which the material has not been lifted. However, for
short lifting, or for non-lifting by the buyer, the EMD shall be forfeited as per Clause 4 .
9. SPECIAL CONDITION: MD/CMD, OMC Ltd, may extend the period for removal of mineral on
reasonable ground.
The highest quoted price (H1) for different grade/type/item of ore received through this tender
shall be scrutinized by OMC Ltd, as per prevailing market condition. OMC reserves the right to accept or
reject the highest quoted price received through this tender for any grade/type/item of ore tendered,
without assigning any reason thereof.
The buyer shall carry out loading and transporting of materials and comply strictly with all
provisions of Mines Act – 1952, Rules – 1955, Metalliferous Mines Regulation – 1961, MMRD Act,
Payment of wages (Mines Rules), Maternity benefit Act of 1961, Industrial dispute Act – 1947, M.V. Act,
Contract Labour (R&A) – 1970 etc. and other government / statutory regulations, decisions,
recommendations prevailing and applicable from time to time.
The buyers allotted ore /material, shall submit a true copy of the said contract with signature in
each page to concerned Regional manager prior to execution of SO (Sales Order), as a token of
acceptance of terms and conditions of contract.
10. PRICE : The buyer has to quote Price per WMT (Wet Matric Tonne) for desired item(s) of
ore separately on ex-stack yard (Place where ore is lying) basis including royalty. Other Govt./statutory
duties/ taxes will be charged extra. The buyer shall remove the mineral at his own expense and
arrangement. The Price Bid including quoted price should be neatly typed in English language both in
figure and words (except signature).
Some lots (as mentioned in Clause – 1) are consist of several grades (Mn/Fe percent in ore). The
accepted H-1 price per WMT for a lot shall be applicable uniformly for the entire quantity of that lot
irrespective of diverse grades.
11. SALES TAX : Sales Tax/VAT as applicable shall be charged extra. To avail concessional rate of
sales-tax, buyers are required to deposit required form duly filled-in, with OMC before removal of
mineral failing which sales tax in full rate will be recovered from the buyer.
12. WELFARE CESS: The buyer shall pay Labour Welfare Cess duty as applicable in addition to bid
amount. For the purpose, the buyer shall deposit the cess duty with the Welfare Commissioner in due
time and produce documentary evidence in support of such payment to OMC.
13. WEIGHMENT : Weighment as recorded in OMC/Govt. weighbridge or decided weighbridge of
OMC in case OMC’s weigh bridge is not available shall be final for the purpose of transit permit as well
as for invoicing.
14. DISPUTE : In case of any dispute arising out of this tender the decision of the Managing
Director/ CMD, OMC Ltd, shall be final and binding upon the bidder.
15. AUTHORISATION OF AGENTS/REPRESENTATIVE: For the bid submitted by
agent/representatives, the name of their principal shall be furnished along with a letter of authority
issued by the Principal authorizing the agent/representative to participate in the tender process on their
behalf.
16. TENDER PAPER: For the purpose of filing tender documents, this Tender Call Notice along with
Technical & Price Bid format to be down loaded from the website of the Corporation i.e.
www.odishamining.com for filing of tender documents. No provision exists for sale of tender
papers.
17. OMC management reserves the right to defer/accept/cancel the whole or part of tender without
assigning any reason thereof.
