PARTICULAR PRELIMINARIES
1/1/1 NOTES TO PRELIMINARIES Item 0.00

1. The Form of Contract shall be the Agreement and Schedule of Building


Contract 1999, Edition published by the Joint Building Council of Kenya.

2. Tenderers are referred to the above mentioned documents for the full intent
and meaning of each clause thereof. These clauses are hereinafter referred to by
clause number and heading only.

3. Where standard clauses or alternatives are not entirely applicable to this


contract, such modifications, corrections or supplements as will apply, are given
under each relevant clause heading.

4. Notwithstanding the terms of Clause 8, where modifications or amendments


as described are made, such modifications and/or amendments shall supersede
any conflicting provision in the relevant clauses of the Agreement and Schedule of
Conditions of Building Contract and Tenderer shall make due allowance for
whatever costs and charges he may consider necessary for the carrying out and
observance of the provisions of the clause as modified and/or amended.

5. Where any item is not relevant to this specific contract, such item is marked
N/A (signifying not applicable).

6. Tenderers shall allow opposite each clause for all costs involved in complying
with such clause. Items left unpriced shall be understood to be covered in prices
against other items throughout these Bills of Quantities. No claim for any extras
arising out of the tenderers omission to price any item shall be entertained.

7. Notwithstanding anything to the contrary contained in any of the contract


documents including the Agreement Schedule of Conditions of Building Contract
and the Preliminaries, the provisions of the Preliminaries as hereafter set forth
shall prevail and shall take precedence.
8. Unless otherwise defined the term Sub-Contractor shall mean Nominated Sub-
Contractor.

1/1/2 CONTRACT PARTICULARS Item 0.00

FORM OF CONTRACT

The Contractor will be required to enter into a Contract which will be the current
Form of Agreement and Schedule of Conditions of Building Works published by
The Joint Building Council, Kenya (April 1999 Edition) excepting in so far as varied
hereafter.

The Contractors attention is called to the following Clauses of the Conditions of


Contract, which shall be read as incorporated herein, and he shall allow any sums,
which he considers necessary for the carrying out and observance of such
conditions.

Clause 1.0Definitions.

Clause 2.0Articles of Agreement

Clause 3.0General obligations of the Employer.

Note:Sub-Clause 3.4 will be deleted.

Clause 4.0General obligations of the Contractor.

Clause 5.0General obligations of the Architect.

Clause 6.0General obligations of the Quantity Surveyor.

Clause 7.0Contract Documents.

Clause 8.0Contract Bills and Contract Price.

The Contract Bills have been prepared in accordance with the Standard method of
measurement of Building Works for East Africa, Second Edition Metric (Second
Printing) July 1989, published by the Architectural Association of Kenya, Chapter
of Quantity Surveyors, which is available for inspection at the offices of the
Quantity Surveyor by appointment.

Clause 9.0Contractors Site Agent and other staff.

Clause 10.0Clerk-of-Works.
Clause 11.0Liability against Injury to Persons Property.

Clause 12.0Insurance Against Injury to Persons and Property.

The Contractor shall effect and maintain in the joint names of the Employer and
the Contractor the following insurances as required by Clause 12.1.1 and 12.1.2
and shall allow for all costs thereof:

(i) ( Employers Liability (Workmens Compensation)

(ii) Third Party (Public Liability) for an Indemnity of not less than Shs. 5,000,000.00
for any one accident or series of accidents arising from the same event (unlimited
in aggregate).

(iii) Should the Contractor already hold annual Insurance covering the whole of
his activities, and the Indemnity required under this contract exceeds the
indemnity under the existing policy/ies, then further insurances shall be effected
and maintained to cover such excess.

(iv) The Contractor shall ensure that all Sub-Contractors effect and maintain such
insurances as are necessary to cover their liabilities in respect of injury to persons
and property and Workmens Compensation.

Clause 13.0Insurance of the Works (Contractors Liability)

To give effect to the Conditions of Contract and the requirements contained


herein, the Contractor shall effect a Contractors All Risks Policy to cover the full
value of the following and allow for all costs thereof.

(i)The Works and Temporary Works erected in performance of this Contract.

(ii)The materials on Site, Plant and Tools.

(iii) The cost and expense of removing debris of the property insured,
destroyed or damaged by any peril insured.

(iv)Professional Fees (to be allowed at 14.50% of the Contract Sum)


Clause 14.0Insurance of the Works (Employers Liability).

The Contractor shall insure against loss or damage to his own Plant, Tools and
Equipment on the Site, Road Vehicles and the Temporary Buildings and Hutments
erected in performance of this contract.

Note:Clause 14.0 and 15.0 will be deleted.

Clause 15.0Insurance of Works (Works of Alterations, etc.)

The Insurance shall be effected by the Employer.

The Contractor shall insure against loss or damage to his own Plant, Tools and
Equipment on the Site, Road Vehicles and Temporary Buildings and Hutments
erected in performance of this contract.

Note:Clause 14.0 and 15.0 will be deleted.

Clause 16.0Performance Bond.

Sub-Clause 16.1 will be amended to delete the words certified date of Practical
Completion and add the words issue of the Final Certificate.

Sub-Clause 16.2 shall be deleted.

Clause 17.0Compliance with Regulations, Notices, etc.

The Contractors particular attention is drawn to the requirement to include in his


tender for costs relating to the Training Levy and the Standards Levy.

The Contractor shall include for all costs arising from Observance of these
requirements in the space provided elsewhere in these Bills of Quantities.

Clause 18.0Programme of Works.

The Contractor will be responsible for arranging the programme with all Sub-
Contractors including the Nominated Sub-Contractors and Nominated Supplies.

Clause 19.0Access to the Works.

Clause 20.0Possession of Site and Commencements of Works.


Note: Sub-Clause 20.2 will be amended by the addition of the words or such
other date as arises by virtue of extensions of time granted under Clause 36 of
these Conditions.

Clause 21.0Leveling and setting out.

Clause 22.0Architects Instructions.

Note: Sub-Clause 22.5 will be amended to read Any instructions given directly by
the Employer to the Contractor shall be of no immediate effect but the Contractor
shall request the Architect for confirmation within seven days, failing which the
Contractor shall confirm the same in writing in the same manner as is provided for
in Sub-Clause 22.4. If confirmed by the Contractor, such instructions shall be
deemed to be Architects instructions.

Clause 23.0Specification of goods, materials and workmanship.

Note:Sub-Clause 30.3 will be amended by the deletion of the words the Employer
and.

Sub-Clause 30.14 will be amended by changing 0.01% to read 0.10%.

Daywork Rates:

Any Daywork ordered under Sub-Clause 30.6.3 shall be executed at the following
rates:-

Labour: The Prime cost to which *_________________ per centum shall be


added.
Materials: The Prime Cost (delivered to Site) to which *____________ per centum
shall e added.

Plant: The Net Hire Charge to which *______________ per centum shall be
added.

These percentage additions shall cover all insurances, use of small tools and non-
mechanical plant, sharpening tools, water, supervision, watching, power and
lighting, establishment and overhead charges and profit.

Dayworks will be allowed only where specifically ordered by the Architect in


writing.

All Daywork Sheets must be signed by the Architect and the Contractor or their
authorized representatives.

Clause 31.0Nominated Sub-Contractors.

Note:Sub-Clause 31.19 will be deleted.

The Contractor will be required to ensure that all Nominated Sub-Contractors


enter into the Sub-Contract Agreement issued under the authority of the Kenya
Association of Building and Civil Engineering Contractors and as amplified or
varied hereinafter and he must deposit with the Quantity Surveyor a signed
extract of the relevant details thereof.

Clause 32.0Nominated Suppliers

The Contractor will not receive any cash, trade or other discounts on Prime Cost
and Provisional Sums. Any profit in lieu of these discounts, which the Contractor
desires must be priced by him against the appropriate item, provided in the Bills of
Quantities.

When tendering for works covered by Prime Cost and Provisional Sums the
Contractor will be treated as any other Nominated Supplier or Sub-Contractor.
The Employer reserves the right to pay direct on the Certificates of the Architect
some or all accounts in respect of works and materials covered by Prime Cost and
Provisional Sums due to Nominated Sub-Contractors or Nominated Suppliers and
to deduct any amounts so paid from any sums otherwise payable to the
Contractor, should this reservation be adopted due to default on part of the
Contractor, any profits which the Contractor may have allowed on Prime Cost and
provisional Sums will be omitted from the Contract. Direct Payment will not be
deemed to construe omission of the works from the Contract and the Contractor
will continue to be responsible for the work or goods in accordance with the terms
of the contract.

Clause 33.0Work by other Persons engaged by the Employer.

Clause 34.0Payments.

Sub-Clause 34.14 and 34.15 will be deleted.

Sub-Clause 34.28 will be amended by addition of the words.:-

Any amount of such penalties or fines shall be added to the Contract price, and if
an interim certificate is issued after imposition of such penalties or fines, any such
amount shall be added to the amount which would otherwise be stated as due in
such a certificate.

Clause 35.0Fluctuations

Sub-Clauses 35.3 to 35.8 will be deleted.

Clause 36.0Extension of time.

Clause 37.0 Loss and Expense caused by disturbance of Regular Progress of the
Works.

Clause 38.0Termination of the Contract by the Employer.

Clause 39.0Termination of the Contract by the Contractor.

Clause 40.0Termination of the Contract by either party.

Clause 41.0Practical Completion and Defects Liability.

Sub-Clause 41.60 will be amended to read as follows.:-


Any defects , shrinkages or other faults which shall appear within the Defects
Liability Period stated in the Appendix to these conditions and which are due to
materials or workmanship not being in accordance with the contract shall
periodically be specified by the Architect in a schedule of defects which he shall
deliver to the contractor with the last such schedule being issued within 30 days
after the expiry of the Defects Liability Period.

After receipt of such schedule, the defects, shrinkages and other faults therein
specified shall be rectified by the contractor and (unless the Architect shall
otherwise instruct) entirely at his own cost within 30 days or such other period
that the Architect may instruct. If the Architect so Instructs, then an appropriate
deduction shall be assessed by the QS and made to the contract price in respect of
any such defects, shrinkages or other faults not rectified."

PRELIMINARIES

GENERAL PRELIMINARIES

1/2/1 SUFFICIENCY OF TENDER Item 0.00

Tenderers shall be deemed to have satisfied himself before tendering as to the


correctness and sufficiency of his Tender for the Works and of the rates and prices
stated in the priced Bills of Quantities, which rates and prices shall cover all his
obligations under the Contract and all matters and things necessary for the proper
completion and maintenance of the Works.

1/2/2 DEFINITIONS AND ABBREVIATIONS Item 0.00

Terms used in these Bills of Quantities shall be interpreted as follows:

Approvedshall mean approved by the Architect

as directedshall mean as directed by the Architect

B.S shall mean the current British Standard specification published by the British
Standards Institution, 2 Park Street, London W.1., England.

Figured dimensions are to be followed in preference to dimensions scaled from
the Drawings, but whenever possible dimensions are to be taken on the Site or
from the Building. Before any work is commenced by Sub-Contractors or
Specialist Firms, dimensions must be checked on the Site and/or buildings and
agreed with the Contractor, irrespective of the comparable dimensions shown on
the Drawings. The Contractor shall be responsible for the accuracy of such
dimensions.

1/2/4 BILLS OF QUANTITIES Item 0.00

All quantities contained in these Bills of Quantities are indicative of the volume
and type of work to be executed.

Where items of work are to be built in or covered up, these shall be left uncovered
for a reasonable time to allow all measurements to be taken by the Quantity
Surveyor. Immediately the work is ready for measurement, the Contractor shall
give notice to the Quantity Surveyor.

If the Contractor makes default in these respects he shall, if the Architect so


directs, uncover the work at this own expense to enable the measurements to be
taken.

1/2/5 TRANSPORT TO AND FROM THE SITE Item 0.00

Tenderers shall include in their prices for the transport of materials, workmen,
etc., to and from the Site of the proposed Works, at such hours and by such routes
as are permitted by the Authorities.

1/2/6 PUBLIC AND PRIVATE ROADS, PAVEMENTS, ETC. Item 0.00

The Contractor will be required to make good, at his own expense, any damage he
may cause to the present road surfaces and pavements within or beyond the
boundary of the Site, during the period of the Works. In particular, all existing
trees, shrubs, plants, etc., which may be destroyed or damaged during the
progress of the Works are to be made good by the Contractor to the approval of
the Architect.

1/2/7 POLICE REGULATIONS Item 0.00

Tenderers are to allow for complying with all instructions and regulations of the
Police Authorities.

1/2/8 PHOTOGRAPHIC RECORD Item 0.00


A four weekly photographic record is to be provided by the Contractor, recording
the state of progress of the Works. Two copies of each photograph, suitably
mounted and annotated with the location and date, are to be made available to
the Employer via the Architect.

1/2/9 THE SITE Item 0.00

The site is on Plot LR No. 2495/2 along Magongo Raod at Changamwe in Mombasa
County. This location falls somewhere between the Airport and the City Centre

1/2/10 ACCESS TO THE SITE Item 0.00

Access to the site shall be designated by the Architect.

1/2/11 AREA OF THE WORKS Item 0.00

The area of the site to be occupied by the Contractor shall be pointed out by the
Architect. The Contractors shall not extend his operations (including working and
storage space) beyond the defined area of the Works.

1/2/12 SUPERVISION AND WORKING HOURS Item 0.00

The work must be carried out to cause the minimum inconvenience to the
occupants of the existing and adjoining premises.

1/2/13 VIEWING OF SITE Item 0.00

Tenderers shall view the site and any existing structures thereon and make
themselves thoroughly acquainted with the conditions under which the Works are
to be done. They shall acquaint by themselves by personal examination of the
means of access to the Works, the condition of the roads and generally of all
matters which may influence the execution of this contract.

1/2/14 EXISTING SERVICES Item 0.00

Prior to commencement of any work the Contractor is to ascertain from the


relevant Authorities the exact position, depth and level of all existing electric
cables, water pipes provisions or other services in the area and he shall make
whatever provisions may be required by the Authorities concerned for the support
and protection of such services. Any damage or disturbance caused to any services
shall be reported immediately to the Architect and the relevant Authority and
shall be made good to their satisfaction at the Contractors expense.
1/2/15 EXISTING AND ADJACENT PROPERTY Item 0.00

The Contractor must take all steps necessary to safeguard existing and adjacent
property, make good at his own expense any damage to persons or property
caused thereon, and hold the Employer indemnified against any such claim
arising.

The Contractor will be held fully responsible for the safety of the existing and
adjacent buildings and for any damage caused in consequence of these Works. He
must reinstate all damages at his own expense and indemnify the Employer
against any loss.

The Contractor must take such steps and exercise such care and diligence as to
minimize nuisance from dust, noise or any other cause to the occupiers of the
existing and adjacent property.

1/2/16 MANAGEMENT OF WORKS Item 0.00

The Contractor shall be responsible for the management of the sequence of the
carrying out of the works in such manner that the subsequent cutting or patching
of finished work is avoided.

The Contractor shall obtain all necessary particulars of sub-contractor' work


timeously so that provision for recesses, chases, holes, etc, may be made.

1/2/17 CONTRACTOR'S SUPERINTENDENCE Item 0.00

The Contractor shall constantly keep on the Works a literate English-speaking


Agent or Representative, competent and experienced in the kind of work involved,
and who shall give his whole time to the superintendence of the Works. Such
Agent or Representative shall receive on behalf of the Contractor, directions and
instructions from the Architect and such directions and instructions shall be
deemed given to the Contractor in accordance with the Conditions of Contract.
The Agent shall not be replaced without the specific approval of the Architect.

It is to be a specific condition of this Contract that the successful Tenderer shall


provide on site, throughout the period from the completion of the substructure to
the date for Practical Completion, a suitably qualified, experienced and competent
person to ensure that the Works are carried out to the standard required by the
specification and detailed on the Drawings; and shall ensure that upon
termination of employment, a suitable replacement is found
Before the Tenderers offer is accepted the Architect will personally interview the
Tenderers proposed Representative. A curriculum vitae of past experience and
qualifications must be provided for the Architects scrutiny.

Copies of the programme and its supporting documents together with all updates
shall be provided by the Contractor for the use of the Architect.

1/2/18 PROGRESS MEETING Item 0.00

Meetings related to the progress of the Works will be held at regular intervals and
at such other times as may be necessary, attended by the following:

1. the project manager

2.the architect

3.the contractors representative

4.the employers representative where applicable; and

5.the quantity surveyor and other agents as may be required

Sub-Contractors shall not be present at progress meetings unless specifically


requested by the Contractor or Architect.

The Architect shall record the minutes of the meeting and distribute them to all
affected parties.

1/2/19 TECHNICAL MEETINGS Item 0.00

Separate meetings to deal with technical and Sub-Contractors co-ordination


matters shall be held at the instance of the Architect or the Contractor.

1/2/20 MATERIALS AND WORKMANSHIP Item 0.00

GENERALLY

All materials shall be new unless otherwise directed or permitted by the Architect
and in all cases where the quality of goods or materials is not described or
otherwise specified (see Section 2 for General Description and Materials &
Workmanship), is to be best quality obtainable in the ordinary meaning of the
works best and not merely a trade signification of that word.
All materials and workmanship shall, unless otherwise specified or described,
conform to the appropriate British Standards Institution Specification current at
the date of Tender.

1/2/21 REJECTED WORKMANSHIP OR MATERIALS Item 0.00

Any workmanship or materials not complying with the specific requirements or


approved samples or which have been damaged, contaminated or have
deteriorated, must immediately be removed from the Site and replaced at the
Contractors expense, as required.

1/2/22 PROPRIETARY MATERIALS Item 0.00

Where proprietary materials are specified hereinafter the Contractor may propose
the use of materials of other manufacturer but of equal quality for approval by the
Architect.

All materials and goods, here specified to be obtained from a particular


manufacturer or supplier are to be used or fixed strictly in accordance with their
instructions.

1/2/23 SAMPLES Item 0.00

The Contractor shall furnish at the earliest possible opportunity before work
commences and at his own cost, any samples of materials or workmanship that
may be called for by the Architect for his approval or rejection, any further
samples in the case of rejection until such samples are approved by the Architect
and such samples, when approved, shall be the minimum standard for the work to
which they apply.

1/2/24 CONCRETE TESTS Item 0.00

Concrete test cubes,i.e per set of three as later described,including testing fee,
labour and materials, making moulds, transport and handling,etc

1/2/25 ORDERING OF MATERIALS Item 0.00


These Bills of Quantities are not intended for and shall not be used for ordering
purposes.

The Contractor shall order all materials to be obtained from foreign sources
immediately upon the award of the Tender and shall also order materials to be
procured from local sources as early as necessary to ensure that such materials
are on site when they are required for use in the works.

Should it become apparent prior to and during the construction period, that the
procurement of certain material may cause a delay, the Contractor shall
immediately inform the Architect of such possible delay who shall then instruct
the Contractor upon the action to be taken. Unless the Architect has failed to
specify materials timeously in terms of the accepted contract programme or
agreed revision thereto, the delay in the delivery of materials shall not justify any
extension of the Construction Period.

The Contractor shall obtain all necessary permits and licenses.

The Contractor shall be responsible for and shall replace or make good at his own
expense any materials lost or damaged.

Should the Tenderer consider that he will be unable to obtain materials for any
item on the drawings or items described in the Bills of Quantities or to obtain such
materials timeously in the specified sizes, he is to report this in writing to the
Architect before the closing date for the tenders and obtain the Architects written
directives in connection therewith.

If the Tenderer fails to do this, this tender will be taken as firm of all items
described in the Bills of Quantities and he will be responsible for supplying such
materials timeously to meet the programme for the Works.

1/2/26 OFFICE AND SHEDS Item 0.00

The Contractor shall erect and maintain temporary office accommodation for his
own use, and ample temporary watertight sheds for the proper storage and
protection of materials and for the use of artisans and remove when ordered.
Floors of sheds shall be at least 150 mm above ground level.

1/2/27 OFFICES AND SERVICES FOR THE ARCHITECT Item 0.00


The Contractor shall provide, erect and maintain where directed on the site, an
approved weather and sun-proof lock-up office for the sole use of the Architect
and his representatives with a total floor area of not less than 15 square metres.
The office shall be constructed with concrete or wood floor and the walls and
ceilings internally lined with fiberboard.

Glazed windows of not less 1.5 square metres and a stout door with lock and
fastenings shall be provided and the office furnished with wooden stools, tables
and chairs and drawing table along the full length of one side, complete with
drawers of sufficient size to carry the Drawings laid flat.

The Contractor shall also provide, erect and maintain a lock up European type
latrine for the sole use of the Architect and his representatives and to the
satisfaction of the Local Authorities and shall provide the services of a sweeper,
pay all charges and keep both office and latrine in a clean and sanitary condition
during the whole period of the Works.

The office and latrine shall be removed on completion.

The Contractor shall keep on site and maintain in good condition one dumpy or
quicker level and leveling staff, and one 30 metre steel tape for the use of the
Architect and his representatives.

1/2/28 PLANT, TOOLS AND SCAFFOLDING Item 0.00

The Contractor shall provide all necessary hoists, tackle, plant, vehicles, tools and
appliances of every description for the due and satisfactory completion of the
Works and shall remove same on completion.

The Contractor shall provide, erect and maintain all temporary scaffolding,
sufficiently strong and efficient for the due performance of the Works, including
Sub-Contractor Works, provide special scaffolding as and when required during
the Works and remove on completion and make good.

Such scaffolding shall be constructed of tubular steel or timber of sufficient


scantlings and be provided with planked footways and guardrails to approval.

All such plant, tools and scaffolding shall comply with all regulations whether
general or local, in force throughout the period of the Contract and shall be
altered or adapted during the Contract as may be necessary to comply with any
amendments in or additions to such regulations.
Scaffolding is not measured hereinafter, and the Contractor must allow in her or
his rates for the above.

1/2/29 HOARDING Item 0.00

The Contractor shall enclose the Site as required by the Local Authorities, with a
hoarding 2.40 metres high, with opening and gates as required, constructed of
substantial timbers to approval and covered with new galvanised iron corrugated

All water shall be fresh, clean and pure, free from earthy vegetable or organic

The Contractor shall provide at his own expense all temporary distribution pipes,

Tenderers shall satisfy themselves that the existing supply is adequate for the
proper execution of the Works and if this is not the case they shall make the
necessary arrangements at their own expense to provide an adequate supply.

The Contractor shall provide at his own risk and cost all artificial lighting and
power for use on the Works, including all Sub-Contractors and Specialists
requirements and including all temporary connections, wiring, fittings, etc. and

The Contractor shall provide either a mobile phone, a landline or a wireless phone
for the period of the Works, and shall pay all fees and/or rental for same.

The Contractor shall provide the necessary latrines for their staff and workmen to
the requirements and satisfaction of the Health Authorities and maintain the
same in a thoroughly clean and sanitary condition and pay all conservancy fees
during the period of the Works and remove same on completion.

1/2/37 NOMINATED SUB-CONTRACTORS Item 0.00

The Contractor shall be responsible for Nominated Sub-Contractors in every


respect and in particular it shall be the Contractors responsibility to ensure that
each Sub-Contractor commences and completes the work in such a manner and is
ready on the Site with his materials, labour and special plant at such times so as to
conform with the Progress Schedule, as specified previously, and to ensure
satisfactory progress.

The Contractor shall also accept liability for and bear the cost of General
attendance for the Nominated Sub-Contractors, which shall be deemed to include
of:

Allowing the use of standing scaffolding, maintenance and alteration of all


scaffolding, retention of all scaffolding until such time as all relevant Sub-
Contractors works are complete and removal of all scaffolding on completion.
Providing space for office accommodation, and for storage of plant and materials;
allowing use of sanitary accommodation; the supply of all necessary water, and
lighting; and clearing away all rubbish.

The items for General Attendance given hereinafter following P.C. Sums in respect
of Sub-Contractors work shall be deemed to include all the above.
The Contractor shall also accept liability for and bear the cost of Special
Attendance on Nominated Sub-Contractors, which shall include for one or more of
the followings:

Unloading, storing, hoisting, placing in position, providing power, provision of


special scaffolding.

The items of Special Attendance given hereinafter following P. C. Sums shall


include any one or more of the above items as set out in the particular reference.

Cutting away for and making good after the work of Sub-Contractors as may be
required will be measured and valued separately by the Quantity Surveyor.

The Cost of Fix Only materials to be obtained from Nominated Suppliers which are

The tenderer shall state the amount of V.A.T (16%) of the priced items

(excluding P.C Sums, Provisional Sums and Contingencies) at the Final

Tenderers are to allow opposite each item for all costs in connection therewith.
All prices to include, unless otherwise stated, for all materials, fabrication,
conveyance and delivery, unloading, storing, unpacking, hoisting, labour, setting,

accordance with the Standard Method of Measurement) patterns, models and
templates, plant, temporary works, returning of packing, duties, taxes, imposts,

INTERPRETATION OF DRAWING, SPECIFICATIONS AND BILLS OF QUANTITIES Item 0.00

Should any part or parts of the Drawings, Specifications or Bills of

Quantities not be clearly intelligible to the Contractor, or the material

or articles to be used in the execution of the Works be considered

insufficiently described or the manner in which the work is to be

carried out not be clear, the Contractor must obtain from the

Architect the necessary information to clarify such Drawings,

Specification, Bills of Quantities or instructions which request shall

be in writing. The Contractor shall be held solely responsible for and

shall, at his own expense, rectify any errors arising out of incorrect

interpretation of the Drawings, Specification, and Bills of Quantities

or instructions.

1/2/45 SHOP DRAWINGS Item 0.00

Shop drawings are drawings, illustrations, schedules, performance


charts, brochures and other data which are prepared by the

Contractor or Sub-Contractor, Manufacturer, Supplier or Distributor

and which detail some portion of the work.

Where applicable, the necessary copies of shop drawings shall be

supplied to the Contractor by Sub-Contractors or Suppliers, who

must obtain the Architects approval of such shop drawings

before the relevant work is put in hand. A proper record of shop

drawings must be kept by the Contractor including dates of receipt,

submission and approval.

The Contractor is to present a complete schedule showing the

sequence of submission of shop drawings, including

submission dates and the scheduled dates for approval of drawings.

This schedule is to take into account that the Architect and the

Consulting Engineer require a reasonable check period from the date

of receipt of shop drawings before returning the drawings to the

Contractor in accordance with the Works programme.

The Architects approval of shop drawings or samples is limited to

check conformity with design and specification and shall not relieve

the Contractor from his responsibility for erection and/or installation.

In addition to the shop drawings, the Contractor shall also supply to

the Architect marked-up structural or other drawings showing any

changes and/or additional requirements to be made in the structure

in order to fit in dimensions of apparatus and materials to be installed


by him. This information to be supplied in accordance with the

works programme.

1/2/46 GUARANTEES AND MAINTENANCE INSTRUCTIONS/MANUALS Item 0.00

The Contractor shall obtain and hand over to the Architect on

Practical Completion all relevant guarantees, any operating and

maintenance instruction manuals, data or instructions required by the

Architect or provided by manufacturers, suppliers or

Sub-Contractors.

The Contractor shall ensure that all warranties and guarantees

received fully ceded to the Employer on Final Completion, failing

which the release of Surety Bond will be withheld until this is

satisfactorily completed.

The guarantees shall state that workmanship, materials and

installations are guaranteed for a specified reckoned from the date

of Practical Completion of the Works and that any defects in the

workmanship, materials and installation that may arise during that

period shall be made good at the expense of the firm doing the work

upon written notice from the Architect or the Employer to

do so.
