ORDER

A verified Petition dated January 10, 2020 having been filed by


petitioner, through counsel, praying to this Honorable Court, that after due
notice, publication and hearing, judgment be issued as follows: (1)
RECOGNIZING the divorce document or decree between Satoshi Tabata and
Jonalyn S. Tabata as issued by the competent government agency of Japan; (2)
TO ALLOW ITS ANNOTATION to the local marriage contract between them as
recorded in the records of Philippine Statistics Authority (PSA) to have an effect
of REVERTING the status of the petitioner from married to single.

Petitioner thru counsel, alleges in the petition: “that petitioner is of legal


age, Filipino and a resident of No. 27 Masipag Street, Maunlad Homes, Phase
1, Caingin, Malolos City, Bulacan. She was married to one Satoshi Tabata on
July 1, 2005 in Okazaki-Shi, Aichi-Ken, Japan. That, after a period of almost
ten(10) years of marriage witih the petitioner, Satoshi Tabata , a Japanese
national initiated a divorce application before a competent government office in
Okazaki City, Japan and such action for divorce was granted and duly
registered in proper government agency of Japan on April 14, 2015; that the
effect of foreign decree of divorce initiated by the foreign spouse, Satoshi
Tabata in this case against the Filipino spouse is to extend its effect to the
latter without undergoing further trial to determine the validity of dissolution of
marriage; that as a result of the granted and accepted divorce Certificate by the
Japanese government in favor of the foreign spouse of the petiioner, she is now
considered single pursuant ot Article 26 of the Family Code.

WHEREFORE, let the instant petition be set for hearing on November


11, 2020 at 8:30 o’clock in the morning before Branch 11 of this Court,
sitting at the Provincial Capitol Compound, Malolos, Bulacan, at which date,
time and place all persons concerned may appear and show cause, if any, why
this petition should not be granted.

Let copies of this Order be a) published once a week for three (3)
consecutive weeks in a newspaper of general circulation in the Province, the
last publication of which must fall thirty (30) days prior to the initial date of
hearing; b) be posted at the Bulletin Board of the Provincial Capitol Building,
Malolos, Bulacan and at the Bulletin Board of the City Hall of Malolos(O
DAPAT CITY HALL OF MANILA???) at the expense of the petitioner, and, c)
be furnished the Local Civil Registrar of

Malolos, the Philippine Statistics Authority, Quezon City, the Office of the
Solicitor General, the petitioner and her counsel by registered mail.

Likewise, petitioner is hereby directed to furnish the Office of the


Solicitor General a copy of the petition and its corresponding annexes by
registered mail and to submit compliance to this court within five (5) days
therefrom.

ORDER

This Court is in receipt of a Verified Petition for Recognition of Decree of


Foreign Divorce between Satoshi Tabata and Jonalyn Solis Tabata dated
January 20, 2020. However, while preparing the Order for the initial hearing of
the case, the Court noticed that there are some important details in the
petition which the undersigned needs to clarify from the petitioner and
counsel.

In view thereof, let the above-entitled petition be set for Clarificatory


Hearing on August 26, 2020 at eight thirty o’clock in the morning.

Let copies of this Order be furnished the petitioner and counsel by


registered mail.

SO ORDERED.
