SUBJECT : COMPLIANCE TO ARTA-DICT-DILG-DHSUD-DPWH-


CAAP-DOH-FDA JOINT MEMORANDUM CIRCULAR
NO. 01 S. 2020 “STREAMLINED GUIDELINES FOR
THE ISSUANCE OF PERMITS, LICENSES, AND
CERTIFICATES FOR THE CONSTRUCTION OF
SHARED PASSIVE TELECOMMUNICATIONS
TOWER INFRASTRUCTURE (PTTIs)”

Section 15 of RA 11032 otherwise known as the Ease of Doing Business


and Efficient Government Service Delivery (EODB-EGSD) Act of 2018
mandates the expedited processing of licenses, clearances, permits,
certifications or authorizations for interconnectivity infrastructure
development in the country.

Pursuant to this, ARTA-DICT-DILG-DHSUD-DPWH-CAAP-DOH-FDA


Joint Memorandum Circular No. 01 s. 2020 titled “Streamlined
Guidelines for the Issuance of Permits, Licenses, and Certificates for
the Construction of Shared Passive Telecommunications Tower
Infrastructure (PTTIs)” was released and signed on July 23, 2020 which
provides guidelines for the construction of shared PTTIs that will be built
by Mobile Network Operators (MNOs) and Independent Tower
Companies (ITCs) duly registered with the DICT in order to facilitate their
accelerated rollout.

The salient features of this JMC includes the following:


1. Removal of Sanggunian Bayan, Panlungsod, and Barangay
Resolutions as part of pre-requisites,
2. Removal of Home-Owners Association (HOAs)/ Neighbors consent
in the requirement of locational clearance,
3. Streamlined the securing height clearance in CAAP identified critical
areas,
4. Requirement of Radiofrequency Safety Evaluation Report only
during the installation of cell site equipment and
5. Emphasis on the DILG-DOF JMC No. 2019-01 on the adoption of
reasonable fees and charges.

In view of the above, all Local Governments Units (LGUs) are hereby
enjoined to observe the provisions of the JMC. To monitor compliance,
LGUs are encouraged to:

1. Submit an inventory of pending applications for the permits,


clearances and certifications in relation to the construction of the
shared telecommunication towers infrastructures to DILG at
https://forms.gle/MnSLBPqcEt3cL3zH8 not later than August 7,
2020 and

2. Fast track processing and approval/disapproval of such permits,


clearances and certifications in accordance with the provisions of
the JMC.

Failure to comply with these guidelines will merit penalties and liabilities
as indicated in Section 9 of the JMC on Shared PTTIs and other applicable
laws, rules and regulations. Summons will be first served to the BFP
Officers and LGUs who will not comply on this JMC.

All DILG Regional Directors and the MILG-BARMM Minister are hereby
directed to cause the widest dissemination of the attached JMC to all
concerned authorities within their jurisdiction.
