ACTIVITY NO. 03: WRITING AN INITIATORY PLEADING (PETITION)

THE TRANSCRIPT OF INTERVIEW

Lawyer: Good morning sir. What’s your name?

Client: Good morning Attorney. I am Jonathan D. Rivera, a 5th year student
taking up Bachelor of Science in Electrical Engineering at DMMMSU-
MLUC.

Lawyer: From where are you Jonathan?

Client: I am from Catbangen, San Fernando City, La Union sir.

Lawyer: What brings you here Jonathan?

Client: I am having a problem with my name I am using sir.

Lawyer: What about it?

Client: It’s like this sir. I am using the name JONATHAN RIVERA y DE GUZMAN
ever since. My baptismal record, school records (from elementary to
college) and medical records bears such fact.

Lawyer: Yes go on.

Client: I was registered as JONATHAN DE GUZMAN y REYES. I was registered
using the middle name and surname of my mother because my father
and mother were not yet married at the time of his birth but they
eventually married each other the year after he was born.

Lawyer: So what’s wrong about it? You can use your father’s surname anyway.
Your parents will just simply execute an Affidavit of Legitimation and
have it registered with the Civil Registrar.
Client: Yes sir. My parents did that but the application was denied for the
reason that my father was married to another at the time of the
marriage of my parents. Here are my Certificate of Live Birth, the
Certificate of No Marriage of my father and the Certificate of Marriage
he contracted. (Client hands down the documents to the lawyer and
the lawyer examines the same.)

Lawyer: Now that’s the problem.

Client: Yes sir. Now I am graduating from college and I am required to submit
a PSA copy of my Certificate of Live Birth. As I have said earlier I had
used and up to now is using the name JONATHAN RIVERA y DE
GUZMAN. This would create a problem on my record. Can I continue
using said name and have it reflected in my Certificate of Live Birth?

If your answer is in the affirmative, write a petition to be filed with the
court of competent jurisdiction that would seek a correction on the
middle and last name of Jonathan.
