    To compute a legitime, donations such as condonation of debt given without consideration must be added to the net hereditary estate, even if the testator states they are non-collationalbe. Otherwise, this would circumvent the law on legitime. Support as defined in the Family Code, except for wedding gifts defined under Article 1030, must also be included for the computation.

    How to compute for legitime

    Collation when

    - Anything given without consideration are donations

    Kahit sabihin ng testator na non collationable iaadd padin sa net hereditary estate

    Otherwise it circumvents law on legitime

    Donations could be in so many way

    Condonation is a form of donation, debt which have been condoned are donations

    Support - which have been define under fam code

    Wedding gifts are not support except if it would fall under definition of wedding gifts under art 1030

    Look for 1061
