SUPREME STUDENT COUNCIL

CONSTITUTION AND BY-LAWS

PREAMBLE
We, the dedicated students of Cronasia
Foundation College, Inc. through the
aid of the Almighty God, in order to
establish an autonomous Student
Government to support the goals and
objectives of the Institution, willing
to serve for the harmonious campus
relationship, establish a well defined
rights and obligations, promote
social, political, economic, and
spiritual development, determined to
uphold the rights and welfare in the
pursuit of the students through
equality, justice and paternity, do
hereby ordain and promulgate this
constitution.

ARTICLE I.  NAME AND SCOPE

Section 1. The organization established hereon under this


constitution shall be known as Cronasia Foundation College, Inc.
Supreme Student Council, and its acronym shall be CFCI-SSC.

Section 2. The Constitution shall cover all bona fide


undergraduate students of Cronasia Foundation College, Inc.

Section 3. The CFCI-SSC shall be located within the campus of


CFCI, Andres-Dizon Building, Pioneer Avenue, General Santos City,
Philippines.

Section 4. The constitution shall be the highest governing


constitution within the campus student organizations.
 

ARTICLE II. DECLARATION OF PRINCIPLES AND


POLICIES

Section 1. The CFCI-SSC shall be the supreme and autonomous


student council in the University.

Section 2. The CFCI-SSC shall adhere to the policy of peace,


equality, justice, freedom, cooperation and unity of all sectors
of the society.

Section 3. The CFCI-SSC shall adhere to the policy of non-active


violence in pursuing its guidelines and policies.

Section 4. The CFCI-SSC shall promote genuine concern for the


students in an effort to attain their holistic development.

Section 5. All laws and policies formulated in the Department


Councils and other student organizations such as Arte Pintora,
religious, class and non-class organizations shall conform to the
CFCI-SSC constitution.

Section 6. The CFCI-SSC shall safeguard student rights and


welfare, and inculcate profound nationalistic consciousness
necessary for the constructive citizenship.

Section 7. The CFCI-SSC shall establish a strong student


representation in the formulation and application of policies
affecting academic and student affairs.

ARTICLE III. BILL OF RIGHTS

Section 1. Every student shall have the right to enjoy freedom of


expression through speech or any non-violent form toward any
individual or body including organizations, councils or even
University Administration.

Section 2. Every student shall have the right to exercise freedom


of religious worship and spiritual practice not contrary to law.

Section 3. No CFCI Administration policy shall be passed


abridging the right of the student to peaceably assemble and
petition to the College Administration or any other organization
for the redress of grievances.

Section 4. Every student shall have the right for information of


public concern, access to academic records, documents and papers
pertaining to official acts, transactions or decisions of the
College subject to such limitations as stated in this
constitution shall be recognize.

Section 5. The right of the student against excessive fines,


compulsory payments and involuntary servitude, subject to such
limitations as stated in this constitution shall be recognized.

Section 6. Every student shall have the right to seek full


assistance from the CFCI- SSC whenever necessary.

Section 7. Every student shall have the right to speedy service


in any office of the Institution.

Section 8. No student shall be subject to excessive use of


unofficial time without the consent of the majority of the
students.

ARTICLE IV. DUTIES AND OBLIGATIONS OF MEMBERS

Section 1. It shall be the duty of every member of the CFCI-SSC


to abide all provisions of stated in the constitution as stated
herein:
a) To observe the existing laws of the SSC and the Institution;
b) To attend all general assemblies and dialogues called by the
CFCI-SSC
c) To pay the CFCI-SSC fee;
d) To support and participate all activities concerning the
upliftment of the whole studentry;
e) To pay all fines justifiable imposed by their respective

department councils as a consequence to any violation herein.
Fines shall be uniformly imposed as determined by the SSC,
provided that the activity shall be Institution wide; and
f) To cast their votes, provided that he/she is qualified in
every election being conducted.

ARTICLE V. FUNDS

Section 1. The funds of the CFCI-SSC shall be derived from the


semestral SSC fee worth twenty five pesos (Php 25.00), fines,
donations and other fund raising activities.

Section 2. Fines will be five pesos (Php 5.00) for every major
SSC activity which shall be collected by the SSC Treasurer upon
signing the clearance.

ARTICLE VI.  SUFFRAGE


Section 1. The right to suffrage shall be exercised by all the
students of Cronasia Foundation College, Inc. provided that
he/she must have enrolled and completed at least one (1) semester
of academic work preceding the elections.

Section 2. The Political and Election Committee shall provide a


system securing the sanctity of the ballots.

ARTICLE VII. THE CFCI-SSC OFFICERS

Section 1. The CFCI-SSC officers shall be composed of the


President, Vice-President, Secretary General, seven (7)
Councilors and Department Chairpersons.
1. The President, Vice-President, Secretary General and 7
Councilors shall be elected at large.
2. The Department Chairperson, one from each department,  shall
be elected by their constituents in their department, and the
three sectoral representatives which shall include one (1)
from Arte Pintora, one (1) from Team Indayog, one (1) from
Sining Kalilintad, one (1) from the other active sectoral
organizations of the institution.
3. The Department Chairpersons automatically become members of
the CFCI-SSC.

Section 2. Any bonafide student of CFCI may run for the SSC
Office provided he/she must:

1. Have enrolled and completed at least one (1) semester of

academic work;
2. Not graduating during the first semester of his/her tenure
of office;
3. Carry at most normal load prescribed by his/her college;
4. Have not been found guilty of any disciplinary case or any
act involving moral turpitude;
5. Not have an off-campus field practicum, except during
school breaks.

ARTICLE VII. POWERS AND FUNCTIONS OF THE CFCI-SSC


OFFICERS

Section 1. The Council has the power to interpret the provisions


of the constitution it and when questions arise.

Section 2. The Council shall draft a budgetary allocation for its


activities which shall be approved by two-thirds (2/3) vote of
its officers.

Section 3. The Council shall:


1. Have the power to deliberate and approve the program of
activities submitted by the different constitutional
committees as well as resolutions passed by the councilors;
2. Organize, coordinate, and direct student activities
designed to promote their general welfare, as well as to
prepare them for constructive citizenship;
3. Serve as the direct linkage between the studentry and the
Administration;
4.  Assist the school authorities in disseminating information
among students and educating them on the rules and
regulations and the student conduct and discipline; and
5. Have the power to declare the existence of boycott or
strike upon two-thirds (2/3) vote of the officers.

Section 4. The President as the chief executive of the Council


shall have the following powers and functions:
1. Sign all communications, papers and resolutions of the
Council, provided that the resolution is concurred by a
majority of the officers present during the meeting of the
Council;
2. Create “ad-hoc” special committees and appoint its staff
members such as: Treasurer, Auditor and 3 support staff;
3. He must represent the Council in his/her official capacity
as Chair in occasions and events where the organization
needs representation;
4. Responsible for informing his/her constituents of the

undertakings, plans and programs of the Council;
5. Preside all General Assembly meetings;
6. Become as ex-officio member of the University policy making
body in the formulation of laws and policies affecting the
academic and extra-curricular of the studentry, with a non-
voting status;
7. Perform such other duties, as may be necessary or
incidental to the discharge of the functions of his/her
office.
8. Can avail 100% discount of his/her tuition in the
institution.

Section 5. The Vice-President shall:


1. Preside over all meetings of the Council, provided that in
case he/she desires to take part in the discussions or
debate, he/she may name any member of the Council to take
the Chair; and
2. Take over the functions of the President whenever his/her
office is vacant by reason of death, resignation, removal,
suspension, illness, absence, physical or mental incapacity
or failure to qualify for office.
3. Can avail 50% discount of his/her tuition in the
institution.

Section 6. It shall be the duty of the Secretary General to:


1. Keep the journal of all proceedings of the Council;
2. Keep all papers, records, documents and files, and
correspondence of the Council;
3. Announce all meetings of the Council; and
4. Performs such other functions as the President or the
Council may from time to time assign him/her.
5. Can avail 50% discount of his/her tuition in the
institution.

Section 7. The Appointed Treasurer shall:


1. Collect and receive all the required CFCI-SSC fee(s) to be
assisted by other Council officers;
2. Act as a custodian or bookkeeper and deposit in the bank
the funds of the Council;
3. Disburse funds in accordance with an appropriation of the
Council;
4. Submit a financial statement/report at the end of each
semester to the Council which shall be published in the
Institution official publication; and
5. Performs such other functions as the President or the
Council may from time to time assign him/her.

Section 8. The Appointed Auditor shall:

1. Keep an inventory and take charge of all the Council
properties;
2. Act as watchdog/overseer of the money matters of the
Council;
3. Audit the money allocated by the Treasurer to the different
he constitutional committee, and the Council as a whole;
4. Performs such other functions as the President or the
Council may from time to time assign him/her.

Section 9. The Councilors shall take over the functions of the


President in case the Vice President is incapable/unavailable to
take over the seat by reason of death, resignation, removal,
illness, absence, physical or mental incapacity or failure to
qualify for office.

Section 10. The Councilor shall:


1. Chair a standing committee in the Council as appointed by
the President;
2. Have the power to pass resolutions that promote students’
welfare;
3. Pass a program of activities to the council before the
council makes its over-all program of activities;
4. Present and pass a financial report in every activity they
have conducted to the Council to be kept by the Secretary
General as duly approved by the Auditor.

Section 11. The Department Chairperson shall:


1. Serve as the linkage between the different Department
Councils and the Supreme Student Council;
2. Have the power to make resolutions that promote students’
welfare;
3. Support and participate in all activities sponsored by the
CFCI-SSC.

ARTICLE IX. THE STANDING COMMITTEES

Section 1. The Committee on Governmental Affairs shall have the


following powers and functions:
1. Formulate rules, guidelines, policies for CFCI-SSC and
investigate all matters pertaining to disciplinary action;
2. Deal matters related to the constitution and by-laws of the
CFCI-SSC;
3. Create programs concerning the enhancement and development
of the CFCI-SSC officials.

Section 2. The Committee on Ways and Means shall:

1. Initiate and plan the income generating activities and
projects in  behalf of the CFCI-SSC;
2. Endorse all funds raised by the committee to the CFCI-SSC
Appointed Treasurer for custody;
3. Find ways and means in a direct or indirect manner for the
success of certain activity or project of the CFCI-SSC.

Section 3. The Committee on Grievance shall:


1. Entertain all matters pertaining to rights and privileges
grievance and improper conduct of the students;
2. Conduct consultation and dialogues regarding student
grievances and pressures within CFCI campus activity; and
3. Investigate and solve problems referred to by students.

Section 4. The Socio-Cultural Committee shall:


1. Initiate activities for the enhancement of social and
cultural aspects of the studentry; and
2. Create programs and activities that promote and integrate
cultural practices among students.

Section 5. The Religious Affairs Committee shall:


1. Initiate activities for the spiritual development of the
students; and
2. Create programs and activities that promote camaraderie,
moral and values formation among students.

Section 6. The Sports Committee shall:


1. Initiate activities that promote sports development among
the students;
2. Coordinate with existing sports associations in the campus
for the benefit of the studentry; and
3. Counterpart financially in supporting deserving varsity
players in the campus.

Section 7. The Academic and Educational Affairs Committee shall:


1. Enhance the academic and educational background of the
studentry through sponsoring activities such as
symposia, lecture, fora, quiz bowl, tutorials, debates,
public speaking contests and the like.

Section 8. The Political and Electoral Committee shall:


1. Initiate programs concerning political activities which
enhance political awareness among students;
2. Responsible for the election process of the CFCI-SSC
officials;
3. Have jurisdiction over all election protests and its
decision shall be final and executor;
4. Formulate election guidelines consistent with the CFCI-SSC

constitution including accreditation of political parties;
5. Maintain impartiality at all times as COMELEC
6. Appoint a COMELEC Chairperson as approved by the SSC
Counci.

Section 9. The Health and Insurance Committee shall:


1. Facilitate the membership of all students in Red Cross;
2. Facilitate the processing of claims of students; and
3. Act as the link between the Red Cross and the CFCI-SSC.

ARTICLE X. MEETINGS AND QUORUM

Section 1. Meetings shall be regular: adjourned or


special/emergency.

Section 2. The regular meeting of the CFCI-SSC officers shall be


held during the second and fourth Fridays of the month.

Section 3. All meetings shall be called by the President or by


the designated in-charge.

Section 4. A regular general assembly shall be called once in


every semester by the CFCI-SSC three weeks after the start of
regular classes.  However, the President may call a general
assembly anytime as deemed necessary.

Section 5. The meetings of the standing committees may be called


by the chairperson or by the designated in-charge.
1. The committee shall hold a monthly regular meeting in which
the date shall be determined by its members.
2. The Committee chair shall report all the transactions they
have in every regular meeting of the Council.

Section 6. One third (1/3) of the total number of the CFCI-SSC


officers shall constitute a quorum for the Council to legally
transact business.

Section 7. Matters concerning the approval of resolutions and


adoption of committee reports need a simple majority vote for
consideration.

Section 8. Matters concerning the approval of the budgetary


allocation, decision of the existence of boycott or strike,
amendments to the constitution and impeachment of members need
two-thirds (2/3) vote of all officers for consideration.
 

ARTICLE XI. THE GENERAL PROVISIONS

Section 1. This constitution shall govern the CFCI-Supreme
Student Council.

Section 2. Permanent vacancy exist when a seat in the CFCI-SSC


has been vacated by reasons of death, resignation, impeachment,
expulsion, or permanent disability and other reasons that hinder
the officer to perform his/her duties in the CFCI-SSC; upon the
existence o permanent vacancy, a special election may be called
for such reason.  In case the permanent vacancy occurs one month
prior to election, the council shall appoint any person deemed
capable to fill-in the vacated seat for the remaining term.

Section 3. The election of the Department Officers shall be


according to the time and date stipulated in their Department
Council constitutions.

Section 4. The election of CFCI-SSC officers shall be held


every month of February.

Section 5. There must be formal turn-over of the finances,


properties, and functions of the outgoing set of officers to the
incoming set.

Section 6.      Induction of the newly elected officers shall be


held during SIGAY Awards.

Section 7.     The powers and functions of the new set of


officers shall take effect immediately after the taking oath of
office and shall terminate after the oath-taking of the
succeeding officers.

Section 8.  All monetary appropriations must be spent solely for


the intended purpose, hence, there shall be no realignment of
funds.

Section 9. Multi-party shall be recognized in every election,


provided that all parties that shall exist must be recognized and
registered in the Commission on Election.

Section 10. The students’ orientation of the CFCI-SSC shall be


included in the freshmen orientation or the values education.

Section 11. All laws being promulgated which is not in


conformity with the Philippine Constitution shall be considered
null and void.

ARTICLE XII. IMPEACHMENT, EXPULSION, AND
DISCIPLINARY ACTIONS

Section 1. a.) If a council officer fails to attend three (3)


consecutive regular meetings without informing the body of
his/her status or the reason(s) of his/her absence, he/she shall
automatically be dropped from the roll. He/she shall cease to be
a member of the Council.
                     b.) If the dropped member of the council
wishes to return, he/she should explain and justify his/her
side.  With the concurrence of two-thirds (2/3) affirmative vote
of the officers, he/she shall be reinstated into the Council.

Section 2. Any officer of the SSC may be suspended or


impeached, as determined by the council for any of the following
cases:
1. Any willful violation of the constitution;
2. Gross neglect of duty;
3. Any dastardly behavior during council sessions/meetings.  

Section 3. The Governance Affairs Committee shall spearhead the


investigation in cases there is a petition for suspension or
impeachment of any officers.

Section 4.      After the verification of the said committee


about the complaint, it shall endorse the complaint with
the prima facie evidence in the form of resolution to the CFCI-
SSC officers.  The complaint must be settled within two (2)
consecutive regular meetings/sessions of the council.

Section 5.      Two-thirds (2/3) of the members present during


the meeting can tackle and discuss petition for impeachment or
suspension of officer(s).

Section 6. Any CFCI-SSC officer may be removed from office by


the concurrence of two-thirds (2/3) vote of all council members.

Section 7. For purpose of suspension, disciplinary proceedings


at which the penalty is being determined shall be required,
provided that:
1. The members present shall constitute a quorum;
2. The period of suspension shall not exceed sixty (60) days.

Section 8. The complainant or respondent shall have no right to


vote in any disciplinary proceedings.
 

ARTICLE XIII. AMENDMENTS

Section 1. The constitution of the CFCI-SSC shall be revised or
amended by an affirmative vote of two-thirds (2/3) of all the
officers of the council, provided that the proposed amendments
must have been presented to the members priorto its
consideration.

 
ARTICLE XIV. TRANSITORY PROVISION

Section 1. The constitution shall take effect immediately after


ratification of the School Administration, Department Heads and
other School Heads of Cronasia Foundation College, Inc. and the
majority of all the legal votes casted in a plebiscite and shall
automatically supersede.

Section 2.     All upon ratification of the CFCI-SSC


constitution shall continue to hold office and exercise their
function until the new set of CFCI-SSC officers shall be elected
and have assumed office following their oath taking.
