Laws applicable to retail and wholesale pharmacies


 Any person who intends to start a pharmacy should have a license to sell drugs by
retail in schedule II & schedule III.
 The person who obtained a license to sell drugs in retail called license retail dealer of
drugs.
 Any person who intends to sell drugs in wholesale basis, should have a wholesale
license.
 The person who obtained a license to sell drugs in wholesale, called license wholesale
dealer of drugs.
 License wholesale dealer should forward separate applications to the authority to sell
any registered drug specified in group A & B of schedule II.
 A registered pharmacist or any person employed a registered pharmacist can apply for
retail selling & wholesale.
 A registered pharmacist shall be in-charge of retail selling/wholesale.
 If a person applies to sell drugs in more than one place separate applications to be
forwarded for each place.
 License may not issue for a minor, mentally deficient person or person who addicted to
narcotics.
 Adequate premises equipped with proper storage facilities are concern when issuing
license.

Requirements of retail sale & wholesale of drugs


Every license to sell drugs by retail / wholesale shall contain following conditions.
 Every license holder should not expose, offer for sale or sell any drug bearing state
mark or any other mark indicates state property.
 Schedule II drugs shall not be sold after the expiry date as specified in the label, or
wrapper or container of such drug.
 Allow authorized officers to inspect the premises and to draw samples.
 License is valid for one year. Renewal before 3 months to the expiry.
 The license retail dealer shall exhibit the license issued by the authority and the
original copy of the registration certificate as a pharmacist issued by the SLMC in
conspicuous place.
The license retail dealer shall sell drugs to,
a) A Medical Practitioner (MP)
b) Dental surgeon (DS) registered under the medical ordinance
c) Registered Veterinary surgeon (VS)
d) Any person who produce a prescription from a registered MP, DS or VS.
The license wholesale dealer shall sell drugs in Group B of schedule II to,
a) A MP, DS, registered under the medical ordinance.
b) VS registered under the veterinary surgeons and practitioners act
c) A retail dealer
d) Any person authorized by the authority

The business laws applicable to pharmacy

 Cannot sale any drug which is expired.


 Cannot expose, offer for sale or sell any drug, bearing state mark or any other mark
indicates state property.
 Cannot sell any drugs which are damaged or cracked the packages or unclear expiry
date.
 Proper storage facilities should be maintained. Cool items should be stored in
cool room or refrigerator.
 Place should be air conditioned and high ventilated.
 Grocery items should be separated from the drugs.
 Records should be maintained properly.
 All drugs should be dispensed according to genuine prescription except over the counter
drugs.
 Place should be cleaned and tidy.
 Allow to authorize officers to inspect the places and get the samples.

Roles of authorized officers

 Enter at any reasonable hour to any place where he believes any article is
manufactured, prepared, packaged, re-packed, preserved, sold or stored and examine
any article and take samples thereof.
 Open and examine any receptacle or package that he believes to contain any article
 For examine or search, stop or detain any vehicle in which he believes that any
article is being conveyed.
 Examine any book, documents or other records including electronic data found in
any place and make copies thereof or take extracts there from.
 Seize and detain for such time as may be necessary, article which he believes any
provision of the act or regulation have been contravened.
 No person shall obstruct any authorized officers acting in exercise of his powers
under this act.
