This AGREEMENT made at Bhayander (E), Thane on this ____ day of month of

Hereinafter collectively called “THE LICENSORS” (which expression shall,
wherever the context requires or admits, mean and include their respective legal
heirs, executors, administrators and permitted assigns) of the one part.

hereinafter called THE LICENCE (which expression shall, wherever the context so
requires or admits, mean and include his legal heirs, executors, administrators and
permitted assigns) of the OTHER PART.
WHEREAS the Licensors are absolutely seized possessed of or otherwise well and
sufficiently entitled____________________________________________

referred to as “The said Premises”)
AND WHEREAS the licensee being in need of premises and has approached the
Licensors to give on leave and license basis the said premises for occupation and
use by the Licensee which the Licensors have agreed to do for the temporary period
of 11 months only at the monthly compensation and on the terms and conditions
hereinafter mentioned.
1. The Licensors hereby grant to the Licensee and the Licensee hereby
accepts from the Licensors the Licensee to occupy and use the said
premises.
3. The compensation for the occupation and use of the said premises shall
be Rs.________(Rupees_____________________________) per month
for the licensed period. The Licensee shall pay to both the Licensors the
above compensation for the period for 11 months.
4. The Licensee shall, throughout the term of the licence hereby create,
deposit and keep deposited with the Licensors as and by way of interest
free security deposit of Rs._______ (Rupee __________________only)
and which amount of security deposit shall be refunded, by the
Licensors to the licensee on the expiry or sooner
termination/determination of the license but after adjusting therein any
costs charges and expenses which the Licnesors may be required to
incur by reason of occupation and use of the said premises by the
Licensee and which costs charges and expenses should have been met
and borne by the Licnesee in course of such occupation and use.
5. In addition to the monthly compensation as stipulated above, the
Licensee shall pay electricity, telephone (if any). Cable used in the
licensed premises as shown by separate meter and/.or billed by the
builders Competed Authorities/Society/MSE/ MTNL. The Licensors
shall be liable to pay this society outgoings, NMMC taxes and non-
occupancy charges in respect of the said premises.
7. The Licensee shall use the premises with due care and caution and shall
keep and maintain the same in good order and condition.
8. The Licensee shall keep the interior of the premises and the Licensors
fixtures and fittings, including electrical, sanitary and plumbing fixtures
therein good and tenantable repair and condition. The Licensee shall not
be responsible for any damage by tempest, earthquake, fire military,
mob violence, act of God or any other accident due to irresistible force
beyond the control of the Licensee being excepted.
9. The Licensee shall not make any structural alterations of any kind and
also not erect or build or permit to be erected or built on the said
premises any constructions or erections without the prior permission in
writing of the Licensors and nor to cause any damage to the said
premises or to the fixtures and fittings therein.
10. The Licensee shall not do any act or deed which may cause nuisance and
annoyance to the Licensors or to the other occupants of the premises in
the building wherein the premises are situated.
11. The Licensors shall not be responsible or liable for any theft, loss,
damage or destruction of any property of the Licensee or of any other
person being in the said premises nor for any bodily injury or harm to
any person in the premises from any cause whatsoever.
12. The Licensors shall as members of the society duly observe and comply
with all the rules, regulations and bye-laws of the society and the
Licensee shall also, to the extent applicable to him observe and comply
with such rules, regulations and bye-laws and shall not do or cause to be
done whereby the ownership of the Licensors is jeopardized.
13. The Licensee hereby granted is for the License and the Licensee shall
not assign, transfer or part with the possession of the said premises or
any portion thereof to any other person or party.
14. The Licensee shall not at any time put any claim of tenancy or sub-
tenancy or any other right title in to or in respect of the Licensed
premises under any law presently in force and any laws which may be
enacted hereafter and this Agreement shall not be construed to created
any such right whatsoever in favour of the Licensee.
15. The Licensors shall at all time have the right to enter upon the said
premises for the purpose of inspection or otherwise after giving a
reasonable notice at a reasonable time and in the presence of the
occupant.
17. The agreement shall be subject to the said premises for the Licensee and
his family members commercial purpose only and will not use the
premises for residential illegal or immoral purpose or any other purpose
or purposes.
18. The Licensee shall vacate and give possession along with furniture and
fixture of the said premises to the Licensors on expiry or earlier
termination of this agreement of this license, reasonable wear and tear
excepted.
19. At the time of the Licensee vacating and said premises shall be entitled
to remove all items of furniture except fixed furniture , fixture and
fittings specified in the schedule hereunder written, belonging to the
licensee and brought into the said premises from time to time. The
security deposit as provided in herein will be returned to the licensee
without interest, on handling over possession of the said premises along
with the cleared bills of electricity, telephone and cable, to Licensors or
earlier determination and only property tax paid by the Licensors.
20. The Licensee shall not create any encumbrances of permanent nature, on
the said premises during the period of license. It is also agreed that the
Licensee is not allowed to display his name plate on the exterior of the
said premises.
