We are thankful to all those companies, already issued letters, providing 120 extra days, in addition to 180
days for the settlement of L/B/E, responding to our appeal with reference to our communication Ref :APH/
AIOCD/578/2020 dated 2nd April 2020 and Ref: APH/AIOCD/607/2020 dated 8th May 2020, regarding the
settlement of L/B/E without any deductions to your stockists.
Although all Pharma Companies have instructed to their CFA/Deport/Distribution that L/B/E shall be settled
without any deductions & Credit Note shall be given against receipt of L/B/E goods considering 120 days
extra; over and above normal settlement days of 180 days.
AIOCD had also appealed to consider relaxation in settlement of L/B/E for those stockist located in
containment areas of various states JUTs and still facing challenges of transportation. Principally it’s requested
to all Pharma companies to settle claims without deductions on any reason till normalcy returns.
If there is any ambiguity please instruct to your CFA/Deport /Distributor immediately, so that our members
both Retailers and wholesalers regarding settlement of L/B/E are not put in any loss due to the zero value
credit note because of Covid Period.

Minerals and Micronutrients declared as rational by Prof. Kokate Committee and approved by
DCG(I) - regarding.
Sir,
Please refer to this Directorate’s letter of even numbered dated 12.12.2018 and 08.01.2020 where by all the
State Licensing Authorities were requested to ask the concerned manufactures to follow the procedure as mentioned
in the said letter for obtaining manufacturing licenses directly from SLAs. The list of such rational FOCs containing
1681 FOCs and 450 FDCs were already forwarded with the said letter to the State Licensing Authorities.
In continuation to the said letter, it may be noted that apart from these 1681 FOCs and 450 FOCs, further there are
now more 471 FOCs (attached as Annexure-A) relating to Vitamins, Minerals and Micronutrients, etc., which have
been declared as rational by Prof. Kokate Committee and report of the committee has been accepted by the
Ministry Accordingly with the approval of the Ministry of Health and family Welfare, it has been now decided to
follow the following pathway for grant of product licenses by SLAs for these FOCs:-
1. Applicants shall submit the requisite fees preferably through Bharatkosh for each FOC to COSCO as specified
under Drugs and Cosmetic Act, 1940 and existing Rules thereunder.
2. The applicant shall submit application to the concerned SLA as per the provisions of Drugs and Cosmetics
Rules 1945 for grant of product manufacturing license giving the details of FOC, S. No. of the FOC in the list,
stability studies data (6 months accelerated), Test Specification of the FOC alongwith Method of Analysis as
well as label and other documents as required for grant of product license under Drugs and Cosmetics Rules.
3. State Licensing Authority shall grant the product license of such FOCs without seeking NOC from OCG (I), if
other conditions of license under the Drugs and Cosmetics Rules, which need to be verified by SLA, are
found to have been fulfilled. The SLAs shall verify the quality of such FOCs of each applicant/manufacturer,
before grant of License.
4. Every manufacturer permitted to manufacture these FDCs shall submit the periodic safety update reports
(PSURs) as per New Drugs and Clinical Trial Rules-2019 to the central Licensing Authority as defined in Rule
‘3’ i.e. DCG(I). Failure to submit the PSURs shall be considered as contravention of these Rules.
In view of above, you are requested to ask the concerned stakeholders to follow the above procedure for obtaining
the manufacturing license w.r.t. FDCs declared as rational by Prof. Kokate Committee. You are therefore requested
to ensure that no product license is granted in respect of the FDCs which are not mentioned in the attached list.

State Licensing Authority (SLA) without prior approval from DCG(I)-regarding.
Sir,
This is in continuation to this Directorate letter of even number dated 27.02.2019 whereby a detailed
pathway was issued for obtaining permission from this Directorate in respect of 83 FOGs declared
as rational (copy enclosed). Subsequently, the date for submission of such applications was also
extended vide this office letter dated 19.08.2019. However, there have been concerns that there is
no mention of strength and dosage forms in the said list.
It is pertinent to mention here that as regard to strength and dosage forms of such FOGs mentioned
in 83 rational FOGs list, it is to clarify that if the manufacturer submits copy of product license
issued by SLA to any firm indicating that the product in specific dosage form and strength was
licensed prior to 28.11 .2007, the same will be considered for issuance of permission by this office
in accordance with the defined pathway.
As per the report of DTAB dated 29.07.2020, there are 3 more FOGs which have been considered
as rational under 294 FOGs category. The pathway for obtaining permission w.r.t. these 3 FOGs
will also remain same as already defined under this office letter no. 04-146/2007-DG (Part-I) dated
27.02.2019. The details of these FOGs are as under:-

Further” it has been observed that only a few applicants who are already having manufacturing
licenses for such FOGs issued by SLA have applied for obtaining approval from this office. Now, it
has been decided that manufacturers/stakeholders who are already holding license for these FOGs
from SLA may submit their applications latest by 31.03.2021.
In view of above, you are requested to ask the manufacturers who are already holding licenses of
these (83+03) FDCs under your jurisdiction to submit the applications to this Directorate as per
defined pathway as no further extension will be considered in such cases.

The office of Drugs Controller General (India) received complaints from Consumer Associations in
year 2007 regarding rationality of certain Fixed Dose Combinations (FDC) marketed in the country.
As a part of follow up action of complaints, the office of DCG(I) prepared a list of 294 FDCs and
directions were issued to all States/UTs Drugs Controllers to withdraw these 294 FDCs which were
licensed without approval of DCG(I). The manufacturers association got however stay from the
Hon’ble High Court of Madras in respect of directions issued in the matter.
The matter was then placed in DTAB in the 56th meeting dated 16.01.2008. A Sub Committee was
constituted by DTAB to examine these FDCs. Accordingly the Subcommittee examined these
FDCs and submitted its report to the DTAB. DTAB in its meeting held on 16.02.2015 agreed with
the recommendations of Sub-Committee of DTAB. All Court cases pending in Hon’ble Madras
High Court were transferred to Hon’ble Supreme Court. In this regard Hon’ble Supreme Court
accepted the report of DTAB as per court order dated 15.12.2017.
As per the report of DTAB, there are 83 FDCs considered as rational. The list of these 83 FDCs ,is
already available in CDSCO website with the following link:

In order to regularise these 83 FDCs, which were licensed to manufacture and market by State
Licensing Authority without prior approval from DCG (I), following procedure is required to be
followed :
a. The applicant shall submit Form 44 mentioning dosage form and strength (duly filled, signed
and stamped) alongwith treasury challan of INR 15,000 for each FDC.

b. Name and Composition of FDC
c. Copy of Product Permission issued by SLA to any firm prior to 28.11 .2007 as documentary
evidence.
d. Copy of manufacturing license in Form 25/28 and Form 29 for manufacturers who are not
holding product permission from SLA and want to apply for these FDCs
e. S.No. of FDC as per the list available on website,
f. Stability studies data (06 months accelerated data of 03 batches) and
g. Test specifications of the FDC along with Method of Analysis
All the manufacturers who are already holding licenses from State Licensing
Authorities for such FDCs and did not obtain NOC from DCG (II) are required to submit their
applications to this Directorate at the earliest but hot later than 4 months, failing which their
applications will not be considered and their licenses will be considered as without legal validity.
In view of above, you are requested to direct all concerned stakeholders to follow above procedure
for clearance of the cases. You are also requested to ensure that no product licensed in respect of
these 83 FDCs are issued henceforth without the approval of DCG (I) in favour of the applicant.

supersession of Medical Council of India
Respected Sir,
We are writing in relation to the Telemedicine Practice Guidelines (“Telemedicine Guidelines”),
notified- by Board of Governors in supersession of Medical Council of India by amending the
Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulation, 2002.
1. We understand that Telemedicine Consultation has the apparent objective to ease access to
healthcare for patients and we do encourage adopting technology in the health care services.
However, for telemedicine consultation be effective and in public interest it should be done in
accordance with the provisions of Drugs and Cosmetics Act, 1940 Pharmacy Act, 1948 and
rules and regulations framed there under. We are writing to point out glaring irregularities in
the Telemedicine Guidelines which, if not corrected immediately, would lead to misuse of
telemedicine, and put public health to a great risk.
2. Background of Our Association . Tamilnadu Chemists & Druggists Association is the affiliated
Association with AIOCD. Our main motive and objective is to provide a platform for interaction
with Food Drug Administration and implement good trading process by complying with D&C
Act and Rules. Our Association playa proactive role in containing the menace of spurious
drugs and is a watchdog to prevent the entry of doubtful medicines in market. All the Chemists
and Pharmacists in State of Tamil Nadu are members of our association. The PMO prior to
announcing the nationwide lockdown on account of COVID-19 had consulted our parent
Association AIOCD so that the supply of medicines is not interrupted.

3. The Mashlekar Committee set up by Govt of India to examine the drug regulatory issues in its
report dated November 2003 had consulted AIOCD and had opined that trade associations
like AIOCD play an important role in preventing the sale of spurious drugs in market.
4. Scanned prescription cannot be stamped at the time of dispensing: As per the Telemedicine
Guidelines, doctors can in professional discretion prescribe medicines via tele consultation
by providing ‘photo, scan, digital copy of a signed prescription or e-Prescription to the patient
via email or any messaging platform ‘or by ‘transmitting the prescription directly to a
pharmacy. Needless to say, prescription drugs can be harmful if taken without medical advice
or in wrong dosage.
Therefore, issuing the prescription in tele medicine consultation and the dispensing of such
prescription by pharmacist should entail same professional accountability as in traditional in-
person consultation. However, as explained here in below, the Telemedicine Guidelines insofar as
it seeks to validate photo, scanned, digital copy of a prescription for buying prescription drugs is
against the provisions of Drugs and Cosmetics Act, 1940, the Pharmacy Act, 1948 and Rules
framed there under and warrants an urgent rethinking since it has the potential of affecting
public health on a large scale.
5. It is well known that prescription drugs are dangerous if consumed except in accordance with
medical advice. Many prescription drugs are habit forming, addictive and can be dangerous if
not consumed properly. It is a matter of common knowledge that in India there are numerous
cases of drug abuse, drug misuse and self medication which can give rise to dangers associated
with antibiotic resistance. In this context Rule 65 (11)(c) of the Drugs and Cosmetics Rules,
1945 is important as it provides that at the time of dispensing prescription medicines, the
pharmacist should stamp the medicines as dispensed on prescription. This is so that no other
pharmacist would second dispense the same medicines. The objective being that one
prescription is not dispensed multiple times. The Rule 65( II) is extracted hereunder for
reference:
Rule 65(11):
The person dispensing a prescription containing a drug specified in Schedule H and Schedule
H1 and Schedule X shall comply with the following requirements in addition to other
requirement of these rules.
(a) the prescription must not be dispensed more than once unless the prescriber has stated
thereon that it may be dispensed more than once;
(b) if the prescription contains a direction that it may be dispensed a stated number of times
or at stated intenals it must not be dispensed otherwise than in accordance with the directions;
(c) at the time of dispensing there must be noted on the prescription above the signature of
the prescriber the name and address of the seller and the date on which the prescription is
dispensed.

The Telemedicine Guidelines allow the doctors to issue prescription by sending photograph
of scanned copy of the prescription to patients. The scrumed copy of prescription or photograph
of prescriptions not valid under applicable laws since it cannot be stamped to prevent multiple
dispensation. Such scenario gives rise to many risks, for example:
i. Once prescription is presented in pharmacy, the law requires stamping of prescription by
the pharmacist to avoid multiple dispensing. However, scalmed prescription can lead to
multiple dispensing as it can be used multiple times since there is no mechanism to stamp
such a prescription. The patients can print a fresh copy of the scanned prescription and
use it in another pharmacy.
ii. Multiple dispensing of prescription can also lead to increase in self-medication which
can give rise to dangers associated with it such as generating antibiotic resistance. It is
well know that Antimicrobial resistance (AMR) has emerged as a major threat to public
health. AMR develops when microbes develop mechanisms to evade the action of
antimicrobials. The factors that contribute to AMR include irrational and overuse of
antibiotics. The high burden of AMR in India is driven by multiple factors including over
prescription of antibiotics. Antibiotic over-prescription is driven by a poor understanding
of its dangers and contribution to AMR on the part of the provider as well as patients who
lack knowledge regarding appropriate antibiotic use. It is reported that India carries one
of the largest burdens of drug-resistant pathogens worldwide. In fact NDM-l was reported
in 2008 and the world ascribed it to New Delhi, the capital of India. India is one of the
largest consumers of antibiotics worldwide. For instance, the entire world is blaming
the China for spread of COVID-19 for the due to the inaction of Chinese Administration,
though the COVlD-19 is a virus and not AMR bacteria. The miss utilisation of antibiotic
can result in occurrence of a resilient bacteria with can spread to the world at large.
An outbreak of a new AMR bacteria / superbug will not only cause grave health loss
and economic loss to the country but it can also bring disrepute to the country for not
taking timely and remedial steps.
iii. Anti-depressant drug addiction, dependence on sleeping pills, habit forming prescription
medicines are well known phenomena in India. Multiple dispensing and over dosage of
such medicines can cause impairment of mental faculties and can be fatal.
6. Our Suggestion: To obviate this risk we suggest that the Central Government should establish
a national portal on which the doctors can email prescription and the patients or the pharmacist
can access the prescription by using a unique OTP. The Pharmacist can, after dispensing the
prescription, either deface it or specify the quantity of medicine dispensed on the national
portal itself so that once the medicines are dispensed the prescription cannot be reused. Until
this portal is setup the doctors should not be allowed to issue scanned prescriptions in
telemedicine consultation.
7. Classification of medicines in List O. List A and List B: The telemedicine guide lines classify
medicines into 4 new categories namely List 0, List A and List B, whereas, the Drugs and

Cosmetics Act, 1940 which medical practitioners and chemists are accustomed with has a
different list namely Schedule H, Schedule H1 and Schedule X. We fail to understand the
logic in having two separate lists and how can guidelines supersede the Drugs and Cosmetics
Act, 1940 to make a new lis!. The medical practitioners and chemists are used to following
the list under Drugs and Cosmetics Act, 1940 and the new classification is likely to cause
confusion that can lead to wrongful prescribing or wrongful dispensation.
8. Our suggestion: We suggest that telemedicine guidelines should adopt the Schedule provided
in Drugs and Cosmetics Act, 1940 for classifying the medicines into different categories
instead of making a new list. And the List 0, List A and List B in the Telemedicine Guidelines
should be done away with.
9. Location of the consulting doctor : Whereas in physical consultation the patients usually
consult doctors in the same city or town, however, the Telemedicine Guidelines allow medical
practitioners to provide telemedicine consultation from any part of the country. As a result, it
is possible that a doctor who practices in Chennai provides telemedicine consultation to patients
from Delhi. It appears that while framing guidelines the board did not consider that in India
every region/State has peculiar and seasonal health problems due to difference is topography,
geography, and climate. A medical practitioner practicing in the same region has better
understanding of recent outbreaks or common symptoms in the local population and he can
give a better advice. For example, each year Delhi has an outbreak of Dengue post monsoon.
The Government of Delhi every time issues an advisory in public interest that during this time
the use of drugs like aspirin and Ibuprofen should be restricted and to avoid use of antibiotics
because in initial days the symptoms of dengue are misleading and doctors can prescribe
wrong medication to patients. Only a Delhi based doctor would know this and a doctor who is
not aware of the current situation in Delhi may prescribe the wrong medication in view of the
misleading symptoms of Dengue.
10. Our suggestion: We suggest that doctors should be allowed to do tele consultation only in the
same city of town where they are practicing and in case a patient wants to consult a specialist
doctor in another city or town, the same should be permitted through a three way consultation
between patient, local medical practitioner and the specialist.
11. Unethical prescribing and solicitation of patients: It is already a matter of concern that doctors
receive compensation or incentives from pharmaceutical companies to prescribe medicines.
This has become a bigger problem with the advent of E pharmacies which are providing
telemedicine consultation. As it is, E pharmacies are operating illegally in India and in contempt
of orders dated 12.12.2018, 20.12.2018, 11.01.2019 and 06.02.2019 passed by the Hon’ble
High Court of Delhi in WP (C) No. 11711/2018. To add to the problem, if a patient using e-
pharmacy website or mobile application does not have prescription for the medicines, the
epharmacy website or mobile application connects the patient to an affiliated doctor for
consultation.

These doctors are on the rolls of e-pharmacies. We have seen that these doctors do not undertake
proper consultation and prescribe medicine for the asking to suit the business interest of e-
pharmacies. Such doctors are affiliated to E pharmacies to facilitate the selling medicines. It is
professionally unethical if telemedicine consultation is misused by E pharmacies in this manner
Our Suggestions : The E pharmacies or its affiliates should not be allowed to provide te1e-medicine
consultation, directly or indirectly as it amounts to solicitation of patients by the Doctors and
giving incentives to the Doctors to prescribe medicines.
We hope and sincerely request that these recommendations are considered, and prompt action is
taking by the concerned authorities to safeguard the interest of nation and public health.
