Chapter 2
INTRODUCTION
Who are Rohingyas what is Rohingya Crisis?

The Rohingya crisis is the ongoing genocide from 2017- and present
attributed towards the Arakanese Buddhist militias and Myanmar army
both committing Crimes against humanity.

The Rohingyas are ethinically different from the Burmese both

Phenotypically and Culture wise aided the Britshers during the time when
Burma was part of British India . This started generating animosity with
the native Arakanese people and other Burmese in the country and
gradually during the military junta rule of Burma and 1980 onwards they
were rendered stateless and were subject to violent riots and killings
which just gradually worsened.

There were a spate of timely riots on yearly basis in which Arakanese and
Rohingyaas clashed with each other which involved burning of villages,
mass killings and rapes and all crimes against humanity.

WORSENING CONDITION
It all started with ARSA that is rohingya terrorist group attacked and
killed 30 policemen in Rakhine. A wave of Anti-Rohingya Muslim
sentiements triggered across entire Myanmar. Whilst protest erupted in
Myanmar and in the Rakhine the nationalist Buddhist and the army
collaborated and started the worst attacks against the Rohingyas.

Violent Nationalist Buddhist mobs and Buddhist militias started attacking

the countryside of Muslim majority towns burning, pillaging villages and
razing them to ground backed by the cover fire from Myanmar’s military.
Soon after pillaging the villages they moved towards the small townships
of Muslims Such was the ferociousness and intensity that nearly 24000+
were killed and 18000+ women and girls were raped and sold. This drove a
wave of 5,00,000+ Rohingya immigrants into Bangladesh and even India.
A colony of 30000 Rohingyas developed in New Delhi and Jammu
prompting widespread protests against them.
The displacement figure was close to 7,25,000+ as that of 2019 figure
according to Huffington post.

Chapter 4
SOCIO-LEGAL SOLUTIONS,SUGGESTIONS
Myanmar’s military carried out mass killings and gang rapes of Muslim
Rohingya with “genocidal intent”, and the commander-in-chief and five
generals should be prosecuted for the gravest crimes under international
law, as said by U.N. investigators said.

A report by investigators was the first time the United Nations has
explicitly called for Myanmar officials to face genocide charges over their
campaign against the Rohingya, and is likely to deepen the country’s
isolation.

The investigators called for the U.N. Security Council to impose an arms
embargo on Myanmar, subject its officials to targeted sanctions and set up
an ad hoc tribunal to try suspects or refer them to the International
Criminal Court in the Hague.

The International fact-finding characterized the conflict in Rakhine as

non-international armed conflicts implying that International
Humanitarian Law applies (IHL). The report form 2018 states that a clear
pattern present violations of Int’l Human rights and Humanitarian law
including crimes against humanity. The Rohingya crisis is difficult ot
describe as a two-party conflict. It is better described as systematic
discrimination, denial of human rights and violence aimed at the Rohingya
population, who are actually not considered people of Myanmar.

It should all start with making Myanmar a democratic country and the
power which resides in the current military should be taken away and
given back to the people. A new constitution is a must thing as Myanmar
is a complex case of Military and civil government in which army
Generals enjoy extraordinary powers to enjoy de facto and de jure
impunity for its actions.

IN LAW AND PRACTISE TATMADAW REMAINS THE MOST POWERFUL

INSTITUTION IN THE COUNTRY LARGELY OUTSIDE THE CONTROL OF THE
CIVILIAN GOVT. Therefore security forces must me made accountable to
civilian authorities as it makes constitutional arrangements in Myanmar
incompatible with the rule of law principle.

“A lawful response to ARSA’s attacks would consist of independent and

impartial investigations and public criminal prosecutions in accordance
with national laws and fair trial rights standards – protections commonly
violated throughout the country, the ICJ says ”

The Rohingya crisis is of epic proportions and needs to be treated with

utmost urgency and importance . The leaders at the upcoming APEC and
ASEAN summnits should ne putting the rights of the Rohingya at the top
of their agenda.” Further along there is an urgent need of to call the donor
governments to provide generous support to meet the humanitarian needs
of Rohingya refugees in Bangladesh and India
The Bangladeshi govt should keep its border open to asylum seekers and
not coerce returns, respecting the principles of nonrefoulment, which
prohibits the return of refugees to places where they would be
persecutedor face a real risk of torture, or cruel, inhuman or degrading
treatment.

Bangladesh is constructing a large refugee camp in the Cox’s Bazar

district of the country, which officials have said they plan to surround
with barbed wire. Officials have already suggested that Rohingyas could
be Reloacted to Thengar Char island, an uninhabitated undeveloped
coastal island highly prone to submergence Either situation would deprive
refugees of their rights to freedom of movement, livelihood, food, and
education, in violation of Bangladesh’s obligations under international
human rights law.

The Burmese government  has indicated that Rohingya who wish to return

to the country should live in camps for internally displaced people. Camps
for displaced people and “safe zones” in Burma are not an acceptable
solution for returnees Refugees and internally displaced people who were
arbitrarily or unlawfully deprived of their former homes, lands,
properties, or places of habitual residence have the right to return to their
place of residence or choice, and the to the return of their property.
Burma should respect the right of those who are unable or unwilling to
return to their homes to choose compensation for the loss of their homes
and properties.

Such camps could become permanent, and act as a barrier for returning
refugees and internally displaced people to reconstruct their homes, work
their land, regain livelihoods, and reintegrate into Burmese society.

“At every high-level meeting where this crisis is being discussed, leaders
should call Rohingya refugees what they are: ‘Rohingya refugees,’”
Frelick said. “Governments should not use euphemisms or otherwise mince
words to suggest that these are not refugees deserving of all their rights
as refugees or to deny their ethnic identity and nationality ties to Burma. ”

Conclusion:-
The happenings of the Rohingyas, their sufferings, plight , and story are
completely absent in terms of the students beforehand but everyone
becomes interested with the dosage of slight information to them. It shows
that the tems like genocide, refugees invoke interest amongst students
particulary and with slight providing of information they themselves get
aware of the situation and can answer the logical solutions related to the
questions.
