Course Objectives:

 To equip the students with fundamental knowledge of procedural law.


 To prepare the students with strong conceptual and comparative analytical skills.
 To develop research, analysis, reasoning skills of criminal procedure in students.
 To enable the students to apply the knowledge in legal practice.
Pre-requisites:

Student must have basic understanding of law.

 The Rationale of Criminal Procedure: The importance of fair trial
– Constitutional Perspective of Fair Trial: Articles 14, 20 and 21.
 Definition of various terms,
 Hierarchy of Criminal Courts and Powers
 The organization of Police, Prosecutor, Defense Counsel, Prison
Authorities and their duties, functions and powers.

UNIT II: Pre-Trial Proceedings-I: Arrest & Investigation


 Information regarding commission of offences 20%
 Investigation
 Arrest of the persons and Rights of the arrested persons
 Examination of Witnesses
 Filing of Police Report/ Charge Sheet/Challan

UNIT III: Pre-Trial Proceedings-II

 Magisterial Power to take Cognizance 30%


 Complaints to Magistrate & Commencement of proceedings
 Summons, Warrant of Arrest & Process to compel Appearance
 Proclamation & Attachment & Process to compel the Production
of Things
 Order for Maintenance of Wives, Children and Parents,
Maintenance for Public order and Tranquility
