MEMORANDUM
I. AUTHORITY:
1. Memorandum from PD, NEPPO with attached Letter from City Mayor of Gen. M.
Natividad;
2. Inherent function of the Chief of Police;
3. Visit of City Mayor, and;
4. NAPOLCOM Memorandum Circular No. 2016-002.
6. To identify the actual user between Patrolman Mabait and Police Corporal
Makulit when the incident of computer crash occurred and whether the same was
intentionally done or due to technical glitches.
8. On October 12, 2020 at about 9:00 AM, PLTCOL K M TAYAN, Chief of Police
received a cellular phone call from HON. LEONCIO D. CRUZ, City Mayor of Gen. M.
Natividad to pick-up the newly purchased “MS Windows Computer Set with Epson
Printer” at the General Service Office (GSO) located at the ground floor of City Hall.
9. Said computer set was donated for the exclusive use of this City Police Station
(CPS). Immediately, the undersigned instructed PCMS Larry A Acalam, Supply PNCO
of this police station to proceed to GSO and personally pick-up the computer set. At
about 12:00 noon of the same date, the computer set with printer was duly received and
the same was installed at Operation Section by Mr. Arnold B. Flavio, Computer
Technician and employee of GSO. On the same date, a Station Order was made
designating Patrolman Mabait and Police Corporal Makulit as custodians of the said
computer set wherein Pat Mabait is responsible to use the same in the morning while
PCpl Makulit in the evening. (Tab A - Acknowledgement Receipt and Station Order
No. 10).
10. On October 14, 2020, the undersigned informed the City Mayor that the
donated office equipment is needed to be entered in the PNP Book of Property and it is
indispensable that a Deed of Donation must be executed in favor of this police station.
On the other hand, City Mayor HON. LEONCIO D. CRUZ informed the undersigned that
he intended to visit the police station the next day regarding the present peace and
order situation of the City of Gen. M. Natividad. Thus, Pat Mabait and PCpl Makulit were
instructed to prepare a comparative briefing pertaining to Peace and Order Situation
covering the period January to October 15, 2019 and 2020. Likewise, said PNCOs were
also instructed to make a short program for the formal turn-over of the Donated MS
Windows Computer Set in connection with visit of the City Mayor on October 15, 2020
at about 10:00AM. Unfortunately, the newly donated computer was reportedly crashed
on October 15, 2020 at about 7:00AM. (Tab B - Blotter Report).
11. It was due to the delay of the arrival of City Mayor, the briefing and the program
were finished through the availability of other computers. The program activity formally
starts at exactly 1:00 PM and ended at about 2:30 PM with satisfactory result but the
incident of computer malfunction was brought to the knowledge of the City Mayor.
Immediately after the activity, the undersigned ordered Pat Mabait and PCpl Makulit to
submit their respective explanation letters and tasked the Deputy COP to investigate
the matter. (Tab C - Memorandum re: Submission of Explanation Letter).
IV. INVESTIGATION/FINDINGS:
12. Based on the explanation of Pat Mabait the computer was working properly
when he encoded the crime statistics on October 14, 2020 between 1:00 PM to 5:30
PM. On the evening of the same date, while PCpl Makulit was checking all the data
entered by Pat Mabait and about to finish the same, he noticed the computer screen
turned into blue then automatically shutdown itself and malfunctioned. He also claimed
that he repeatedly turned its power “ON” but still ineffectual. (Tab D - Explanation
Letters).
