The PITA below is formatted for post qualification related to a single (individual) contract.

Sub- These particular instructions and related Information Forms (IF) are intended to complement,
Clause amend, or supplement the provisions in the GITA. In the event of conflict or ambiguity, the
Referen provisions in the PITA shall prevail over those in the GITA.

1.1 The Employer is: Ethiopian Roads Authority.

Name of Project: Bole Junction-Weterdino Horticulture and Bole-Abomsa Design - Build Road
Project

Description of the Works:

The project work is the design and construction of DC5 road surfaced with Asphalt Concrete
(AC). The road will have a carriageway width of 7 m (two lanes of AC each 3.5m width) and
having an approximate length of 30.5km project length; the width of shoulder is 1.5m for flat
and rolling and 0.5m for mountainous and escarpment sections, except in expansive road
stretches which will be paved with a double bituminous surface treatment. In Woreda and
Kebele Seats, the respective typical road cross sections and pavement layers as indicated in
the typical drawings and Employer’s Requirement will be applied.

Bridges and culverts shall be constructed as new with reinforced concrete. Culverts shall have
Inlet and out let structures together with erosion protection as recommended on appropriate
sections.

The sub-base course shall be natural, screened or crushed material or an approved blend of
these materials that meet the requirements of the Specifications. The base course layer shall
be constructed from crushed aggregate which should meet the specification requirements.
The riding surface shall be treated with Asphalt Concrete meeting the requirements of the
specifications.

All required ancillary works, including those specified in ERA standard Technical Specifications
2013 should also be constructed.

1.2 Source of Fund: The Government of the Federal Democratic Republic of Ethiopia (FDRE)

1.3 Bidding Documents: The Bidding documents are as mentioned in the “Bidding documents”.

Types of Contract: is Lump Sum contract for the entire project. Part of the major activity
completed can be paid as payment for Design and Engineer’s Facility Provision, Clearing and
Earth Works, Structures Works, Pavement Works, Road Furniture, Protection Works and
Environmental works as approved by the Supervision Consultant/Employer’s Representative
according to the payment schedule attached in the Bidding Document, Volume I, and Section
VII.

Method of payment: Direct through the Contractor’s Bank Account.
Price is: Adjustable as per the SCC
Time for completion is: 30months (910 Calendar days) including 3 months of mobilization.
2.1 General
The bidder shall also provide the requested documentary evidences listed under Volume I,
Section III, Particular Information to Instruction to Bidders, Sub clause 3.1 with the post
qualification application.

Note:
 During Evaluation, the average Annual Construction Turnover of a Joint Venture (JV) bidder’s “All
parties Combined” shall be determined as follows:
 First, Each JV Partner’s ACT for the respective year will be “summed up” to obtain the Total ACT
of “All Parties Combined” for each year of the last five years;
 Then, the average of each Year’s Total ACTs of “All Parties Combined” (in the last 5 years) will be
taken for the evaluation.
 The value of total certified payments received in each year (i.e. ACTs) shall be adjusted for inflation of
Birr value through multiplying by Cn/Co factor, where Cn is value of 1 US Dollar in Birr on the date 28
days prior to bid submission date and Co is the value of 1 US Dollar in Birr computed using the exchange
rate prevailing on the last date of the respective fiscal year.
 The basis of computing US Dollar value of Birr shall be the selling exchange rate issued by the National
Bank of Ethiopia.
 For foreign bidders, while converting Annual Construction Turnover (ACT) indicated in other currencies
to equivalent amount in ETB, the applicable exchange rate should be the selling exchange rate of
National Bank of Ethiopia for the date ending of each Fiscal Year.
 If a bidder was awarded and/or recommended for award any works/maintenance contract/s by ERA
since August 01, 2016 inclusive, the qualification criteria for Annual Construction Turnover will be the
aggregate of the criteria of the subject project and criteria of the awarded contract/s and/or those to be
recommended to be awarded.
 Annual financial statements shall be prepared by certified auditors but not by an accountant or
accounting firms. Financial statements prepared by accounting firms will not be accepted.
 The audit financial statement prepared by an independent auditor shall be authenticated by Addis
Ababa Chamber of Commerce for local bidders and by appropriate public notary for foreign bidders.
Unauthenticated financial statement will not be accepted.

Note:
 For bidders who have participated as joint ventures or sub-contractors, the amount of
experience will be taken considering their shares accordingly;
 Specific Experience of a bidder obtained through sub-contracting, which is not
authenticated by the project Owner/Employer (Not the prime contractor) will not be
considered. Alternatively, if a bidder has obtained experience by sub-contracting in
projects, it should attach all payment receipts certified by the prime contractor and
also the Tax payment Certification issued to the Ethiopian Revenues and Customs
Authority (ERCA).

than ERA, in addition to the Certificate of Specific Experience (Certificate of
substantial completion), the bidder should attach all payment receipts certified by the
project owner and also the Tax payment Certification issued to Ethiopian Revenues
and Customs Authority (ERCA).

An experience which is not supported by the above documents will not be


considered.

 Moreover, if the bidder is a joint venture formed between local and foreign firms, it
is the Specific Construction Experience criteria set for foreign bidders that shall be
met collectively by “All Parties combined”.

Financial Capabilities

Liquid assets, unencumbered real assets, lines of credit, and other financial means, net of
current commitments, available to meet the total construction cash flow demands of the

2.12 Personnel Capabilities
Bidder shall provide the following:

1. Organization Chart for the Head Office Staff who would be directly concerned with the
Contract.

2. Organization Chart for Site management and key technical supervisory staff,

4. Commitment or evidence that proofs the proposed personnel will be availed to work on
the project

2.14 Litigation History


All pending litigation shall in total not represent more than Thirty Percent (30%) of
the Bidder's net worth and shall be treated as resolved against the Bidder.

2.15 Add History of Non-Performing Contracts


as Sub-Clause 2.15

i.) Nonperformance of a contract did not occur within the last Five (5) years prior
to the deadline for Qualification submission based on all information on fully
settled disputes or litigation. A fully settled dispute or litigation is one that has
been resolved in accordance with the Dispute Resolution Mechanism under the
respective contract, and where all appeal instances available to the Bidder have
been exhausted. In addition to the submitted information, the Employer
reserves the right to obtain any records of non-performance of the Bidders in
the past 3 years from official records within or outside of Ethiopia as a basis for
qualification.

ii.) If a bidder is not performing to the satisfaction of the Employer on the already
awarded contracts with the Employer, then ERA may use its performance
record in the assessment of the Bidders’ qualifications. Besides, if the Employer,
based on full documentary evidence, establishes poor performance by any
other Bidders engaged in similar works in Africa and other developing
countries, on any contracts carried out over the last 5 years, then the Employer
may use this information in the assessment of the Bidders’ qualifications.

iii.) Any Contractor’s performance shall be evaluated based on the ERA’s


contractor’s performance assessment framework and rated accordingly. The
minimum acceptable performance on ongoing contract shall be revised to
reflect the actual situations. The minimum acceptable performance on
ongoing contracts is set from time to time by ERA BOARD.

iv.) If ERA found None performance or poor Performance history of a Bidder at
any stage of the tendering process before signing of the contract agreement
(except for ERA’s Monthly Contractor’s performance assessment frame work,
the result of which is considered only for preceding month before submission
of bid), the bidder will be rejected from the proceeding stage of the
tendering.
3.2 Clarification of Applications

Amend 3.2 as follows:


(i) The joint venture must satisfy collectively the criteria of Clause 2. For this
purpose the following data of each member of the joint venture may be added
together to meet the collective qualifying criteria:

(a) General construction experience for the period of years stated in Sub-
Clause 2.7(a),

(b) Average annual turnover (Sub-Clause 2.7[b] );

(c) Particular experience (Sub-Clause 2.8[a]) and key production rates (Sub-
Clause 2.8 [b]);

(d) Construction cash flow (Sub-Clause 2.9);

(e) Personnel capabilities (Sub-Clause 2.12); and

(f) Equipment capabilities (Sub-Clause 2.13).


(ii) Each partner must satisfy the following criteria individually;

(g) Adequate sources to meet financial commitments on other contracts


(Sub-Clause 2.10),

(h) Financial Soundness (Sub-clause 2.11) and,

(i) Litigation History (Sub- clause 2.14).

(j) History of Non-Performing Contracts (Sub- clause 2.15).

(k) documentary evidences listed under Volume I, Section III, Particular


Information to Instruction to Bidders, Sub clause 3.1
In accordance with the above, the application shall include all related information
required under Clause 2 for individual partners in the Joint Venture.

Note:1) For all qualification requirements; If the bidder is a joint venture formed
between local and foreign contractors, it is the criteria set for foreign bidders that
shall be met by the combined parties in case the criteria is a “joint venture must
satisfy collectively, 3.2(i) above”. Otherwise if the criteria is a “Each partner must

meet the requirement of the criteria set for foreign bidders whereas a member of
the joint venture which has local origin shall meet the requirement of the criteria
set for local bidders.

3.4 Joint Ventures


Partner Limitation: The limit in the number of partners in a joint venture is up to
maximum of 3 (three).

The same bidder may form a joint venture with not more than one bidder.
4 Award of Multiple Projects
The following criteria will be used for award of multiple contracts:

5 Bidders as part of their post qualification document shall submit all the following
information as per Volume-II: Section XI: Qualification of the bidding documents
and forms provided thereto:
a) Signed Qualification application submission form by the authorized person
b) Power of attorney for signatory of the document.
c) Joint venture (JV) agreement or a letter of intent to form a joint venture if
the bid is submitted as JV.
d) Copies of original documents defining the constitution or legal status, place
of registration and principal place of business.
e) Total annual turnover in the civil works construction business expressed as
the sum of payments certified for work performed in each of the last five
years.

f) Performance as prime contractor, management contractor, or
proportionately as member of a joint venture or subcontractor, on works
of a similar nature and complexity over the last Ten years, and details of
other works in hand and present contractual commitments.
g) Major items of contractor’s equipment proposed for carrying out the
Contract
h) The qualifications and experience of key personnel proposed for
administration and execution of the Contract, both on and off site.
i) Any proposal for subcontracting elements of the works where the total
value to be subcontracted is more than 10 percent of the Bid price.
j) Detailed proposals for proposed subcontracting of any highly specialized
elements of the works to named specialist subcontractors.
k) Reports on financial standing of the bidder including profit and loss
statements and auditor’s reports for the past five years.
l) Authority to seek references from the bidder’s bankers.
m) Information regarding any litigation or arbitration resulting from contracts
executed by the bidder in the last five years or currently under execution.
The information shall include the names of the parties concerned, the
disputed amount, cause of litigation, and matter in dispute; and present
status of the dispute resolution.
n) Proposed work methods and program in sufficient detail to demonstrate
the adequacy of the bidder’s proposals to meet the Employer’s
requirement and the completion time.
 Post qualification application submitted without Signed Qualification
Application submission form by the authorized person will be rejected.
 The post qualification application document shall not contain any financial
information of the bid.
6 Post Qualification Evaluation
1. After identifying the successful Bidder by evaluation the bid documents
against the criteria set forth in this Bidding Documents the Public Body shall

conduct post qualification evaluation to establish the current qualification
of the successful Bidder where it feels that it has to be ascertained.
2. Such post qualification evaluation of the successful Bidder may relate to
submission of the documentary evidence specified in Section II: Instruction
to bidders& Section III: Bid Data Sheet and Section XI: Post Qualification
Document, unless satisfactory documents are already included in the Bid,
concerning its current legal, professional, technical, and financial standing
and conformity to the requirements stated in this Bidding Documents.
3. If the successful bidder fails to provide this documentary proof within 7
calendar days following the Public body’s request or if the successful bidder
is found to have provided false information its Bid shall be disqualified, in
which event the Public body shall proceed to the next lowest evaluated Bid
to make a similar determination of that Bidder’s capabilities to perform
satisfactorily.
