11-02-10 Windsor v Maid of the Mist Corporation et al (10-690 and 10-A690): Fraud opined in
US Supreme Court records received by Mr Windsor from the office of Clerk Suter
1. The online dockets of the Supreme Court of the United States note denial of the petition and the
application (10-690 and 10-A690) on January 18, 2011.
2. Petitioner Windsor has not been accorded by Clerk William Suter of the Supreme Court of the United
States due Service and Notice of the denial of his Petition and Application on January 18, 2011, in
apparent violation of Due Process rights.
3. Petitioner Windsor has unsuccessfully attempted to discover valid judicial records of the presumed
January 18, 2011, review and denial of his petition and application. [i ]
4. Attempts on January 18-21, 2011, by Mr George McDermott to access the paper and electronic files of the
US Supreme Court, pertaining to Mr Windsor and others, were denied by the office of Clerk William
Suter in apparent violation of First Amendment rights. [ii ]
5. Consequently, Petitioner Windsor filed a Motion for an Order by the Court on Clerk William S Suter for
Service of Valid Evidence of Denial. On February 8, 2011, the Motion was stamped “Received” by the
office of the Clerk of the US Supreme Court.
6. In response to Mr Windsor’s Motion for an Order, a February 8, 2011 letter was issued on behalf of Clerk
William Windsor, signed by Ms Cynthia Rapp, with no notation of her authority.
7. The enclosure to the February 8, 2011 Ms Rapp letter includes a copy of a record, which is an
unsigned January 18, 2011 Order, denying the Petition (10-690). Such unsigned judicial record is
opined as an invalid one.
8. The copy of the unsigned January 18, 2011 unsigned Order was further stamped “True Copy”. The
stamp was signed by a person, whose name was not printed below the signature line. The authority
of the person was ambiguously stated as “Deputy”, but not - “Deputy Clerk”. The signature “True
Copy” also remained undated. The “True Copy” stamp is opined as an invalid certification of true
copy by the office of Clerk Suter.
In sum: In the February 8, 2011 letter, invalid records are provided to Mr William Windsor on behalf of
Clerk William Suter of the US Supreme Court. Moreover, the February 8, 2010 letter, signed by Ms
Cynthia Rapp, demonstrates ongoing efforts to mislead Mr Windsor that he has been served with valid
records pertaining to the denial of his petition and application (10-690 and 10-A690) by the Supreme
Court of the United States. [ iii , iv ]
Therefore, Joseph Zernik, PhD, [ v ] opines that conduct of the office of Clerk William Suter of the
Supreme Court of the United States in the February 8, 2011 response to the Motion for an Order in the
matter of William Windsor is Fraud.

 1. William M. Windsor ("Windsor") hereby files a Motion for an Order by

the Court on Clerk William S. Suter of the United States ("SCOTUS") for valid

evidence of the January 13, 2011 alleged denial by Justice Thomas of the motion of

William M. Windsor in Supreme Court Docket #10-A690 or 10-690.

2. The letter dated January 13, 2011 by "Staff Attorney" Danny Bickell

appears invalid on its face.

3. Upon information and belief, Danny Bickell is not sworn Deputy Clerk.

4. Danny Bickell did not sign the January 13, 2011 as "Deputy Clerk."

5. Therefore, the January 13, 2011 letter does not constitute valid notice

by the Clerk of SCOTUS.

6. No valid evidence of the denial by Justice Thomas was attached to the

January 13, 2011 letter by Danny Bickell.

7. There is no order issued under seal, in violation of 28 U.S.C. 1691.

The word "process" at 28 U.S.C. 1691 means a court order. See Middleton Paper Co. v.
Rock River Paper Co., 19 F. 252 (C.C. W.D. Wisconsin 1884); Taylor v. U.S., 45 F. 531
(C.C. E.D. Tennessee 1891); U.S. v. Murphy, 82 F. 893 (DCUS Delaware 1897); Leas
& McVitty v. Merriman, 132 F. 510 (C.C. W.D. Virginia 1904); U.S. v. Sharrock, 276 F.
30 (DCUS Montana 1921); In re Simon, 297 F. 942, 34 ALR 1404 (2nd Cir. 1924);
Scanbe Mfg. Co. v. Tryon, 400 F.2d 598 (9 th Cir. 1968); and Miles v. Gussin, 104 B.R.
553 (Bankruptcy D.C. 1989).

8. Therefore, Windsor is requesting an order by the Court for Due Process

Notice and Service by Clerk of the Court William S. Suter on parties in William M

Windsor v. Maid ofthe Mist Corporation) at a1. (10-A690 or 10-690) of the valid

record of denial of the application by Justice Thomas.

9. Windsor submits that there are several forms that such denial of the

application may be in:

 a. Written Order, hand signed by Justice Thomas

b. Hand inscription by Justice Thomas on the face of the Application

of Wzjliam M Wzndsor v. Maid ofthe Mist Corporation, at a1. (10-

690), pursuant to the Rules of the Supreme Court.

c. An electronic record including some form of digital signature by

Justice Thomas.

10. Therefore, Windsor requests service on the parties of whatever form of

record is deemed today by the U.S. Supreme Court and Clerk William Suter as valid

and effectual, good faith and credit evidence of the denial of the Application by

Justice Thomas, be it in any of the forms listed above, or in another form that is

today held valid by SCOTUS and Clerk Suter.

11. Such Notice and Service are overdue, and Windsor asks that it be

executed immediately.

12. Windsor asks that the Motion be docketed pur~uant to Due Process

and that a valid adjudication of the Motion be noticed and served on the parties.

13. Windsor also requests all court records in the internal case

management system of SCOTUS under No. 10-690, subject to page charges,

including all audit data. The audit data is the login name and login time of the

individuals who entered any data in the records.

WHEREFORE, Windsor respectfully requests:

a. that this Motion be granted;

 1. William M. Windsor ("Windsor") hereby files a Motion for an Order by

the Court on Clerk William S. Suter of the United States ("SCOTUS") for valid

evidence of the January 13, 2011 alleged denial by Justice Thomas of the motion of

William M. Windsor in Supreme Court Docket #10-A690 or 10-690.

2. The letter dated January 13, 2011 by "Staff Attorney" Danny Bickell

appears invalid on its face.

3. Upon information and belief, Danny Bickell is not sworn Deputy Clerk.

4. Danny Bickell did not sign the January 13, 2011 as "Deputy Clerk."

5. Therefore, the January 13, 2011 letter does not constitute valid notice

by the Clerk of SCOTUS.

6. No valid evidence of the denial by Justice Thomas was attached to the

January 13, 2011 letter by Danny Bickell.

7. There is no order issued under seal, in violation of 28 U.S.C. 1691.

The word "process" at 28 U.S.C. 1691 means a court order. See Middleton Paper Co. v.
Rock River Paper Co., 19 F. 252 (C.C. W.D. Wisconsin 1884); Taylor v. U.S., 45 F. 531
(C.C. E.D. Tennessee 1891); U.S. v. Murphy, 82 F. 893 (DCUS Delaware 1897); Leas
& McVitty v. Merriman, 132 F. 510 (C.C. W.D. Virginia 1904); U.S. v. Sharrock, 276 F.
30 (DCUS Montana 1921); In re Simon, 297 F. 942, 34 ALR 1404 (2nd Cir. 1924);
Scanbe Mfg. Co. v. Tryon, 400 F.2d 598 (9 th Cir. 1968); and Miles v. Gussin, 104 B.R.
553 (Bankruptcy D.C. 1989).

8. Therefore, Windsor is requesting an order by the Court for Due Process

Notice and Service by Clerk of the Court William S. Suter on parties in William M

Windsor v. Maid ofthe Mist Corporation) at a1. (10-A690 or 10-690) of the valid

record of denial of the application by Justice Thomas.

9. Windsor submits that there are several forms that such denial of the

application may be in:

 a. Written Order, hand signed by Justice Thomas

b. Hand inscription by Justice Thomas on the face of the Application

of Wzjliam M Wzndsor v. Maid ofthe Mist Corporation, at a1. (10-

690), pursuant to the Rules of the Supreme Court.

c. An electronic record including some form of digital signature by

Justice Thomas.

10. Therefore, Windsor requests service on the parties of whatever form of

record is deemed today by the U.S. Supreme Court and Clerk William Suter as valid

and effectual, good faith and credit evidence of the denial of the Application by

Justice Thomas, be it in any of the forms listed above, or in another form that is

today held valid by SCOTUS and Clerk Suter.

11. Such Notice and Service are overdue, and Windsor asks that it be

executed immediately.

12. Windsor asks that the Motion be docketed pur~uant to Due Process

and that a valid adjudication of the Motion be noticed and served on the parties.

13. Windsor also requests all court records in the internal case

management system of SCOTUS under No. 10-690, subject to page charges,

including all audit data. The audit data is the login name and login time of the

individuals who entered any data in the records.

WHEREFORE, Windsor respectfully requests:

a. that this Motion be granted;

 b. that an order by the Court for Due Process Notice and Service by Clerk

of the Court William S. Suter on parties in William M Windsor v.

Maid ofthe Mist Corporation, at a1. (10-A690 or 10-690) of the valid

record of denial of the application by Justice Thomas;

c. that the Motion be docketed pursuant to Due Process and that a valid

adjudication of the Motion be noticed and served on the parties;

d. that Windsor be provided copies of all court records in the internal case

management system of SCOTUS under No. 10-690 or 10A690, subject

to page charges, including all audit data; and

e. that this Court grant such other and further relief as is appropriate.
