PRINCIPLES
 Equipoise rule, in a criminal case, provides that the constitutional presumption of
innocence tilts the scale in favor of the accused where the evidence is evenly
balanced such as when the inculpatory facts and circumstances are capable of two
or more explanations, one of which is consistent with the innocence of the accused
and the other consistent with his guilt, then the evidence does not fulfill the test of
moral certainty and is not sufficient to support a conviction.

FACTS:

Librias was charged with Forcible Abduction with Rape.

According to AAA, the accused wwillfully, unlawfully and feloniously with lewd designs,
abducted her from Mandaue Plaza to Colon St.

According to the accused, he did not force himself upon AAA.

RTC Decision: RTC found that Librias, with the use of force and intimidation, had taken
away AAA from Mandaue Plaza to a house on Colon Street, Cebu City, where they had
sexual intercourse

CA Decision: CA affirmed Librias' conviction in toto.

ISSUE

Whether or not Librias was guilty.

RULING:

The SC ordered the acquittal of Librias.

Where the evidence in a criminal case is evenly balanced, the constitutional presumption of
innocence tilts the scale in favor of the accused.

Where the inculpatory facts and circumstances are capable of two or more explanations, one
of which is consistent with the innocence of the accused and the other consistent with his
