MUBARAT NAMA

THIS DEED OF MUBARAT NAMA is made on 21st October ,2020.

BETWEEN

AFZAL HABIB SARVAIYA S/o HABIB SARVAIYA aged about 29 Years, by faith
Muslim, by resident of Room No. 2/26 Gali No. 12 Lower Pada Parksite Vikhroli West
Mumbai- 400079, having Aadhar No: 381964256824, hereinafter called “HUSBAND” /
“FIRST PARTY” of the ONE PART.

AND

DANISHA YUNUSHBHAI AGAVAN D/o YUNUSHBHAI AGAVAN W/o AFZAL

HABIB SARVAIYA, aged about 25 years, by faith Muslim, by resident of Flat no. 407-B
Govinda Township, Bavisa Faliya, Dadra and Nagar Haveli-396230 having Aadhar No:
282839113101 hereinafter called the “WIFE” / “SECOND PARTY” of the OTHER
PART.

1. That the First Party AFZAL HABIB SARVAIYA married to the second party
DANISHA YUNUSHBHAI AGAVAN before 4 years ago on 21/04/2016 and their
marriage was solemnized according to Muslim Rites and Custom at address of
Ghachi Jamat Khana Umerkui Road Bavisa falia Dadra and Nagar Haveli-396230 .
2. That due to said wedlock there is no child.
3. That soon after their marriage owing to the differences in their tastes, habits, thought
and temperament, the reason well known to them, the relationship between the first
party (Husband) and Second Party (Wife) became bitter and detoriated, frequent,
quarrels resulted in between themselves several reconciliations done by disinterested
local people but any adjustment across between them and their conjugal life became
hell.
4. That in this circumstances the husband and wife (First Party and Second Party) have
mutually agreed and decided that there is no any chance for continuation of the
marital relationship and have further agreed upon the dissolution of the marriage tie
in the form of “MUBARRAT”.
5. That finally after a serious decision from both the parties in the month of June, 2020
think to avoid further detoriation in the relationship which may reflect upon their
families and friends think for separation from each other with their free will and
accord from their marriage tie
6. This Divorce Deed is given by way of Mubarat thus the First Party (husband)
Pronounced to the Second Party (Wife) by uttering his words as “MAIN NE
TUMKO TALAK DIYA , TALAK DIYA, TALAK DIYA”.
7. That the first party to this deed acknowledges that the “Mehar” amount was fixed
Rs.3,176/- (Three Thousand One Hundred Seventy Six Only /-) which the first party
already have paid to the second party, which the receipt of same have been
acknowledge by the Second party.
8. That Second party has filed a Domestic Violence Petition in the Court of Hon’ble
Chief Judicial Magistrate at DNH Silvassa, bearing No. CMA-DV Act/11/2019. It is
agreed and accepted Second Party that as a dissolution of this marriage in form of
KHULLA, she will not file any further claim against the First party pursuant to
above said cause title.
9. That as the dissolution of this marriage in the form of Mubarat Nama, First party
have paid a total sum of Rs. 1,50,000/- (One Lakh Fifty Thousand only /-) for gift
(including al the furniture, bed, vessels etc.) which has been given at the time of their
marriage. No further claims can be made by either parties against each other in
future.
10. That from today i.e. (Date of Execution of this Mubarat Nama) both the husband and
wife have got no any conjugal relationship / or any relationship as because from
today they became GAIR MEHRAM for each other.
11. That from today neither party can put any claim in future against each other as
husband and wife and second party shall not file any maintenance case against the
first party (Husband) in any court in future.
12. That from today both parties are free to marriage anybody anywhere according to
their choice in which no any interference shall be entertained from both the parties
and if they do so, it will be void on the basis of this MUBARAT NAMA.
13. This deed of Mubarat Nama is explained to both the parties in their Vernacular
language.

IN WITNESS WHEREOF both the parties signed in this MEMORANDUM OF

MUBARAT NAMA in presence of witnesses on the day, month and year mentioned earlier.
