DEFENDANT’S MOTION REQUESTING MEDIATION

Defendant(s) ___________________________ asks this court to set this case for

mediation and extend the docket timeline to extend Defendant’s deadline to respond to

dispositive motions until the mediation is complete.

MEMORANDUM IN SUPPORT

Plaintiff filed a Complaint for Foreclosure against me. I would like to keep my home and

I believe a settlement would benefit all parties. Ohio Rev. Code § 2323.06 states:

In an action for the foreclosure of a mortgage, the court may at any stage in the
action require the mortgagor and the mortgagee to participate in mediation as the
court considers appropriate and may include a stipulation that requires the
mortgagor and the mortgagee to appear at the mediation in person.

Therefore, I request this Court set the matter for mediation and require both parties to appear in

person. My request is made to allow the parties to discuss their positions and to see if we could

reach an agreement that benefits both parties.

I request that this court set the case for mediation, and extend the docket timeline to avoid

ruling on any dispositive motions until the completion of the mediation.
