A bill; of rights may be defined as declaration and anumeration of a person’s rights


and privileges which the constitution is designed to protect against violation by the
government, or by an individual or groups of individuals. It is a charter of liberties for the
individual and a limitation upon the power of the state.

CLASSES OF RIGHTS
1. NATURAL RIGHTS – They are those rights possessed by every citizens without being granted by the
state for they are given to man by God As a human being created to his image.
2. CONSTITUTIONAL RIGHTS- They are those rights which are conferred and protected by the
constitution .
3. STATUTORY RIGHTS – they are those rights which are provided by laws promulgated by law-making
body and consequently may be abolished by the same body .

CLASSIFICATION OF CONSTITUTIONAL RIGHTS


1. POLITICAL RIGHTS – They are such rights of the citizens which give them power tom participate
directly in the establishment or administration of the government.
2. CIVIL RIGHTS they are those rights which the law will enforce by the instance of private individuals
for the purpose of securing to them the enjoyment of their means of happiness.
3. SOCIAL and ECONOMIC RIGHTS- they include those rights which are intended to ensure the well –
being and economic security of the individual.
4. RIGHT of THE ACCUSED- they are the (civil) rights intended for the protection of a person accused of
any crime.

Meaning of Due Process of Law


Under the constitution, a person may be deprived by the state of his life, liberty or property
provided due process of law is observed.
But what is meant by due process of law? No exact definition has been given to the expression , the
reason being that the idea expressed therein is applicable under so many diverse conditions as to make
any attempt at precise definition impossible.

ASPECTS OF DUE PROCESS OF LAW


1. PRECEDURAL DUE PROCESS- which refers to the method or manner by which the law is enforced .
2. SUBSTANTIVE DUE PROCESS- which requires that the law itself, not merely the procedure by which
the law would be enforced is fair, reasonable and just.

Procedural Due Process-


1. In Judicial Proceedings –for the most part, procedural due process has its application in judicial
proceedings , civil or criminal. It requires :
a. An empirical court clothed by law with authority to hear and determine before.
b. Jurisdiction law fully acquired over the person of the dependent or property which is the
subject matter of the proceedings.
c. Opportunity to be heard given the defendant.
d. Judgement to be rendered after lawful hearing.
2. In Administrative Proceedings – Due process , however is not always judicial process . In certain
proceedings of an administrative character , notice and hearing may be dispensed with, because of
public need or for practical reasons, the same is not feasible .

SUBTANTIVE DUE PROCESS= due process of law requires that the law is question affecting life, liberty or
property be a valid law.
a. Thus the tax which is imposed for a private purpose constitutes a taking of property without due
process as it is beyond the authority of the legislature to levy.
b. Likewise, the taking of property for private use or without payment of just compensation of tends
substantive due process .

A search of warrant is an order in writing , issued in the name of the People of the Philippines ,
signed by a judge and directed to the peace officer, commanding him to search for certain personal
property and bring it before the court.

If the command is to arrest a person designated , i.e, to take him in custody in order that he
may be bound to answer for the commission of an offense , the written order is called warrant of
arrest .

SCOPE OF THE PROTECTION


1. Persons – the protection is apply to everybody , to citizens as well as aliens in the
Philippines whether accused of crime or not. Corporations are also entitled to the
protection .
2. Houses- the protection is limited to dwelling houses but extend to a garage, warehouse,
shop, store, office an even a safety deposit vault.
3. Papers and Effects – they include sealed letters and packages in the mail which may be
opened and examined only in pursuance of a valid search warrant.

Section 1; The state recognizes the Filipino family as the foundation of the nation. Accordingly , it
shall strengthen its solidarity and actively promote its total development.

Concept of Family – In a broad sense , family is a group of persons united together by ties of
marriage and blood. In a very restricted sense , it is applied to the group form by the spouses and
their children .

IMPORTANCE OF FAMILY TO THE STATE;


1. A BASIC SOCIAL INSTITUTION - the family is the very heart of society men’s system of living
together in this world.
- It is the foundation of the nation which is but a con glomeration of families bound not only
by affinity and consanguinity and common interest but also by a common past and shared
vision of the future.
2. The COMMUNITY’S FIRST SOCIALIZING AGENCY- the source of strength and stability , the
institution where all human values begin .
- The child learns obedience, cooperation , mutual aid, respect for the rights of others and
kindered values .
3. An INSTITUTION OF UNIQUE SOCIAL VALUE; - the unique value of an institution of this
kind to political society is so immediately evident that one of the first duties of the state
should be to protect and strengthen family life.

Article XIV, Section 1- The state shall protect and promote the right of all citizens to
quality education at all levels and shall take appropriate steps to make such education
accessible to all.

Concepts of Education
Education may refer to the process of training the physical, mental and/or moral
faculties of an individual.

PURPOSE; To provide an individual with knowledge, skills competence, or usually , desirable


Qualities of behavior and character to render him fit for the duties of life.

Education may be acquired through a formal course of instruction offered by


institutions established for the purpose, or informally through means outside the formal
school system, such as on –the –job training , exposure to work, experience , self-learning
under out-of-school study programs.

GOALS IN GIVING PRIORITY TO EDUCATION


SEC. 17- OF ARTICLE II MANDATES THE state (government ) to give priority to
education , science and technology, arts culture and sports with the following goals:
1. To Foster Patriotism and Nationalism
Patriotism – is love for or devotion to one’s country.
Nationalism – is an attitude or belief characterized by a sense of national
consciousness of common culture, race and interest of a people who consider
themselves one and distinct from others.

2. To Accelerate Social Progress – The fulfillment by the state of the constitutional mandate
will hasten the attainment of social progress.

3. To Promote Total Liberation and Development- to promote the individual welfare, the
individual should be helped that he may develop harmoniously his physical, moral and
intellectual faculties and hereby liberate himself from the shackles of poverty, ignorance ,
literacy, fear. Disability. And other economic circumstances.
